The City Clerk noted that the Agenda had been posted on July 1, 1993 at 9:18 a.m. Present: Councilmembers: Mike Gilroy, Leonard A. Hale, Paul V. Kloecker, Suellen C. Rowlison, Pete Valdez, Jr. and Donald F. Gage. Absent: Councilmember: Sara C. Nelson. Discussed proposed ordinance re: purchases of recycled paper products. Motion was made by Councilman Hale seconded by Council- man Kloecker that Ordinance No. 93-13 be adopted. ORDINANCE NO. 93 - 13 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GILROY AMENDING SECTION 2.41 OF THE GILROY MUNICIPAL CODE TO REFLECT CITY POLICY WITH RESPECT TO PURCHASES OF RECYCLED PAPER PRODUCTS. Motion was made by Councilman Valdez seconded by Council- woman Rowlison and failed by the following Roll Call Vote to accept Analysis "E" through 1994: Ayes: Councilmembers: Kloecker, Rowlison and Valdez; Noes: Councilmembers: Gilroy, Hale and Gage; Absent: Councilmember: Nelson. Motion was made by Mayor Gage seconded by Councilman Gilroy and carried by the following Roll Call Vote to reconsider Analysis Res.93-39 City Rental Units Wheeler Housing License Agreement Gang Task Force f,' . "F": Councilmembers: Gilroy, Hale, Rowlison and Gage; Noes: Coun- cilmembers: Kloecker and Valdez; Absent: Councilmember: Nelson. Motion was made by Mayor Gage seconded by Councilmember Gilroy to adopt Resolution No. 93-39 accepting Analysis "F" as recommended for the RDO Build-Out Schedule; RESOLUTION NO. 93 - 39 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ESTABLISHING A BUILDOUT SCHEDULE FOR 1994 THROUGH AND INCLUDING 2003. PASSED AND ADOPTED this 6th day of July, 1993, by the following vote: AYES: NOES: ABSENT: COUNCILMEMBERS: GILROY, HALE, ROWLISON, and GAGE COUNCILMEMBERS: KLOECKER and VALDEZ COUNCILMEMBER: NELSON Discussion was had regarding the City'S present policy on rental units. Motion was made by Councilman Kloecker seconded by Council- man Valdez and carried that the City continue with the present policy on its rental units; specifically, to offer same when available to City Employees prior to advertising to the public. Councilmembers: Gilroy and Rowlison voted "no" on the motion. The City Attorney explained a Loan Subordination for Wheeler Housing Corporation. Motion was made by Councilman Hale seconded by Councilman Kloecker and carried that the Loan Subordination for Wheeler Housing Corporation be approved as explained by the City Attorney. The Mayor relinquished the Chair to Mayor Protempore Rowlison to avoid any possible conflict of interest in the following request: Noted a request of Gilroy Spices - Garlic Capital Products for approval of a License Agreement further explained by the City Attorney. Mr. Gary Steinmetz, owner of Gilroy Spices, addressed the Council further explaining his request. Motion was made by Councilman Hale seconded by Councilman Kloecker and carried that a License Agreement be approved with Gary Steinmetz for Gilroy Spices to sell his current stock of Garlic Capital Products with a previous logo similar to the City of Gilroy'S Seal; licensee to pay attorney's fees up to a maximum of $150.00 for preparation of said agreement. The Mayor continued to preside over the meeting. The following informational items were noted with no separate discussion on same: Correspondence re: 1993 State Budget: Updated Analysis from the Ways & Means Committee on the 1993-94 Budget, Assemblyman Areias; Customer Service: Susan E. Howe, Applicant for Administrative Assistant in appreciation; and Planning Department's Status of the City'S Long-Range Applications. The Minutes of the Gang Task Force Committee Meeting of June 23, 1993 were noted. At 8:18 p.m. Councilman Hale left the Council Chambers. (;., .l~ Adjrnmt. Council set July 28, 1993 at 7:00 p.m. for a Council Study Session to discuss the Violent Crime Report of the Police Department, noting same is to be televised. City Administrator Baksa distributed notes from the Council Study Session of April 12, 1993 on Strategic Plan. At 8:21 p.m. Councilman Hale returned and took his seat at the Council table. City Administrator Baksa distributed a League of California Cities Bulletin on SB 1234 and AB 1622 noting letters would be forwarded local legislators in opposition to both bills. Council had no objection. City Administrator Baksa requested the following Councilmem- bers return their copies of the Capital Improvement Budget: Gilroy, Nelson, Rowlison, Valdez and Gage; and the following Councilmembers return their copies of the Financial Plan 1993- 1998: Gilroy and Nelson. City Administrator Baksa noted a Hazardous Materials Spill Training given by Fire Chief Gillespie. The Mayor noted an invitation to Council to meet with the Governor in Sunnyvale and to RSVP Gloria at 246-6600. The Mayor noted Anti-Pornography video tapes available for Council review and that same could be obtained from the City Clerk. Councilman Kloecker inquired of the recent write-off of Garden Valley's utility bills. The City Attorney noted that she would give an update on the bankruptcy case at a future meeting. The Mayor noted the following meetings: Gilroy City Council Study Session, July 12, 1993 - 7:00 p.m., Gilroy Senior Center, 7371 Hanna Street, Gilroy, CA 95020 re: Strategic Planning; Gilroy City Council Interviews for Planning Commission Applicants, July 13, 1993 - 6:00 p.m., Council Chambers, City Hall, 7351 Rosanna Street, Gilroy, CA 95020; Leadership Forum, July 15, 1993 - 7:30 a.m. to 9:00 a.m., Gilroy Senior Center, 7371 Hanna Street, Gilroy, CA 95020. re: Bicycle Safety Regulations/Traffic Enforcement Issue; and Joint City Council/Gilroy Unified School District Board Meeting, July 21, 1993 - 5:30 p.m., Council Chambers, City Hall, 7351 Rosanna Street, Gilroy, CA 95020. Councilman Kloecker noted ABAG's special lending program re: seismic purposes; employee term life at employee's expense; and Pac Bell program regarding ownership of telephones. At 8:35 p.m. the Mayor adjourned to a Closed Session re: Exposure to Litigation in accordance with Section 54956.9(b)(1) of the Government Code, re: Confidentiality of Peace Officer's Records.
