Pastor Kevin wilson, Gilroy Bible Church gave the Invocation. The city clerk noted that the Agenda had been posted on october 28, 1993 at 9:49 a.m. Present: councilmembers: K. A. Mike Gilroy, Leonard A. Hale, Paul v. Kloecker, Sara C. Nelson, Suellen c. Rowlison, Pete valdez, Jr. and Donald F. Gage. consent calendar Xmas Decorations Res.93-62 Imprvmts. Dev.Agree. Budget Traffic Impact Fees Teeter plan Res.93-63 Motion was made by councilwoman Kloecker, seconded by councilwoman Nelson that the following items under the Consent calendar be approved, by the following Roll call vote: Ayes: councilmembers: K. A. Mike Gilroy, Leonard A. Hale, Paul V. Kloecker, Sara C. Nelson, suellen C. Rowlison, Pete Valdez, Jr. and Donald F. Gage: Approved request of the Gilroy chamber of Commerce for city to install and remove street pole Christmas decorations and banners; Adopted Resolution No. 93-62 Approving Application for the El Protector Program Grant; RESOLUTION NO. 93 - 62 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING THE APPLICATION AND THE PROJECT AGREEMENT FOR THE EL PROTECTOR PROGRAM. PASSED AND ADOPTED this 1st day of November, 1993 by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: COUNCILMEMBERS: COUNCILMEMBERS: GILROY, HALE, KLOECKER, NELSON, ROWLISON, VALDEZ and GAGE None None; Accepted Improvements for project 94-PW 302, 1993-03, sealing well #3 - Forest Street Park; Approved Development Agreement #93-36, Glen Loma corporation, Arcadia Homes, Inc.; and Approved Budget amendments/Transfers as recommended. Noted a request for reconsideration of Traffic Impact Fee for proposed Medical offices. Noted an updated staff Report further explained by Planning Director Dorn and city Administrator Baksa. Heard from Gary Bruno, representing the applicant, explaining the history of the proposed project and why the project should be defined as a hospital campus. Discussion was had by council on the matter. Motion was made by councilwoman Nelson seconded by Councilwoman Rowlison to accept Alternate recommendation No. 3 for the subject project. Motion amended to accept the advice of the city Attorney to calculate the fee based on a percentage to be determined by the planning Director for the high and low categories. The motion was withdrawn. Motion was made by councilwoman Nelson seconded by councilwoman Rowlison and carried to authorize the Planning Director to establish traffic impact fee for the proposed Medical office project only, with a percentage based on building uses both in the high traffic commercial and low traffic commercial categories depending upon the building uses, specifically for medical offices and hospital related offices. A recommendation on proposed property Tax Apportionment (Teeter plan) was noted and further explained by Finance Director shaw. Motion was made by councilwoman Nelson seconded by councilman Kloecker that the reading of Resolution No. 93-63 be waived and that it be adopted. RESOLUTION NO. 93 - 63 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ELECTING THE ALTERNATIVE METHOD OF DISTRIBUTION OF PROPERTY TAX LEVIES AND !;:;,:J,~~ RDO Energy Conserva- tion ASSESSMENTS. PASSED AND ADOPTED this 1st day of November, 1993, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: COUNCILMEMBERS: COUNCILMEMBERS: GILROY, HALE, KLOECKER, NELSON, ROWLISON, VALDEZ and GAGE None None Discussion was had regarding the RDO application deadline. Motion was made by Councilman Valdez seconded by councilwoman Rowlison and carried that the RDO application deadline be established for May/JUne 1994 for the normal application window. A recommendation to proceed with authorizing a preliminary proposal covering energy conservation was noted and further explained by Resource Management Coordinator Menacho. Mr. Jerry Konner, representing Honeywell, addressed the council and further explained their Municipal services Program for energy conservation. Motion was made by councilman Kloecker seconded by councilman Valdez and carried that authorization be given to approve execution of a letter, subject to the city Attorney's approval, authorizing Honeywell to proceed with a preliminary proposal covering energy conservation, equipment retrofits, and maintenance for city facilities. The Mayor asked if there was anyone in the audience wishing to speak on any matter not on the agenda. Mr. Bill Gould, Architect, 255 N. Market street, San Jose, addressed the Council representing The Santa Clara county Housing coalition, inviting council to a symposium and Mayor's Reception, December 3, 1993 at San Jose State university. ':, % '1 , ,; ..i.' .'1 t.....lt city Administrator Baksa presented a report of unresolved capital improvement issues. council set November 29, 1993 at 7:00 p.m. to discuss capital Improvement issues. city Administrator Baksa noted distribution of the comprehensive Housing plan. city Administrator Baksa informed council that alternative funding for the police Department cannot be from the Golf Course Funds. council set November 30, 1993 at 7:00 p.m. for a council study session for continued discussion of the Anti-violent crime Report. councilwoman Rowlison noted the centennial Year (1993) for Public Health Nurses. councilwoman Nelson noted that she will be giving an update on the visitor Bureau's Retreat. councilman Gilroy noted a council committee meeting has been scheduled regarding the Youth/community Center proposed for the old P.G. & E. building on sixth street at the Rosas Residence, 7340 Alexander street for November 4, 1993 at 8:00 p.m. councilman Gilroy invited council to be the chefs at a Fund Raiser for st. Joseph's Family center on March 12, 1994.
