The city clerk noted that the Agenda had been posted on November 18, 1993 at 8:17 a.m. Present: councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, charles s. Morales, connie Rogers, suellen C. Rowlison, pete valdez, Jr. and Donald F. Gage. Motion was made by councilwoman Kloecker, seconded by Coun- cilman Valdez that the following item under the consent calendar be approved, by the following Roll call vote: Ayes: councilmem- bers: K. A. Mike Gilroy, Paul V. Kloecker, charles s. Morales, connie Rogers, suellen c. Rowlison, Pete valdez, Jr. and Donald F. Gage: Approved the Negative Declaration for the storm Drainage, Sewer and Water Master plans as completed in compliance with CEQA, as reflecting the independent judgement of the city. Adopted Resolution No. 93-68 Authorizing Execution of Grant Appli- cation for Small Business Administration Tree Planting; and Approved Budget Amendment/Transfers as recommended. lj" '"I ' '~'I:\ It~ Youth ctr. open space com.Appmts. cable TV Res.93-69 CHAS plan The Mayor continued the matter of a decision regarding the proposed community/Youth center to be located at the old P. G. & E. Building at sixth and Railroad streets to the December 6, 1993 regular council Meeting because of issues addressed at the November 16, 1993 special Meeting still being investigated. He noted that he would be working with the Recreation service Manager and the neighborhood. councilwoman Rowlison requested the matter of participation in Santa clara county Open Space Authority be tabled until the county representative arrives. Motion was made by councilwoman Rogers seconded by council- woman Rowlison and carried that the deadline to receive addi- tional applications for all commissions and Board Terms expiring January 1, 1994 be extended to December 3, 1993 at 5:00 p.m. city Administrator Baksa gave an update on cable TV regulations. councilman Valdez requested an update on contel's plans if any regarding cable TV services. Motion was made by councilman Kloecker seconded by councilman Valdez that the reading of Resolution No. 93-69 be waived and that it be adopted providing for the regulation of basic service tier rates and related equipment, installation and service charges of any cable television system operating in the city and authorizing execution of certificate of franchise authority to regulate basic cable service rates and initial finding of lack of effective competition. RESOLUTION NO. 93 - 69 A RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY TO PROVIDE FOR THE REGULATION OF BASIC SERVICE TIER RATES AND RELATED EQUIPMENT, INSTALLATION AND SERVICE CHARGES OF ANY CABLE TELEVISION SYSTEM OPERATING IN THE CITY OF GILROY. PASSED AND ADOPTED this 22nd day of November, 1993, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: COUNCILMEMBERS: COUNCILMEMBERS: GILROY, KLOECKER, MORALES, ROWLISON, VALDEZ and GAGE None None ROGERS, HCD Grant Coordinator Rojas explained the Five Year comprehensive Housing Affordability strategy (CHAS) Plan. council complemented HCD Grant Coordinator Rojas for an excellent comprehensive report. councilman Kloecker requested an amendment on Page 25, second sentence of the last paragraph to read: "given the slow economy, we may not reach these figures until 1998". Motion was made by councilman Morales seconded by councilman Valdez and carried that the comprehensive Housing Affordability strategy (CHAS) plan be approved as amended. Open Space Authority 1,,4 ~ "j , i Fire chief's completion of Masters comprehensive; Gilroy visitor's Bureau Minutes from April 1993 through September 1993 and Financial Documents from october 1, 1992 through october 31, 1993; and Sunrise Meadows Homes Construction celebration. The Minutes of the Senior Advisory Board Meeting of October 18, 1993 were noted. The Minutes of the Library & culture Commission Meeting of November 9, 1993 were noted. city Administrator Baksa distributed a location map of the sidewalk repair projects under the recently awarded contract. city Administrator Baksa noted the League of california cities - Peninsula Division is seeking nominations to their League policy committees if any of the council are interested to notify staff by November 30, 1993 deadline. Discussion was had by Council regarding the council Retreat and council agreed to activate the previous council sub-committee for said event to be scheduled in the same manner as the last council Retreat. The Mayor appointed the following councilmembers to vacancies on the Advisory Committees and council representatives: 1. Economic Development committee - Valdez; 2. city/school Liaison committee - Morales & Gilroy; 3. Disaster council - Gilroy; 4. Santa Clara county cities Assoc. Rep. - Kloecker 5. Gilroy Downtown Development Corp. - Gilroy 6. chamber/city Hall of Fame - Morales 7. county General plan Review - Rogers 8. council Housing & Urban Development - Valdez 9. south county Joint Planning Adv. Com. - Rogers 10. (If active) League of calif. cities Rep. to participate in Regional Children's summits - Morales, Alt. (sub- sequently determined committee non-existing.) 11. Housing Board Advisory counsel - Morales councilman Kloecker noted an additional committee under ABAG that he represents the city: Joint Air Quality policy committee and county Transportation - Ad Hoc committee of Mobility. Discussion was had regarding participation in the Santa clara county Open space Authority. The city Attorney noted the city can withdraw from the Authority. Mr. Greg Sellers, staff Analyst for Santa clara county Open Space Authority addressed the council and explained the proposed District and gave an update on same. Retired councilwoman Sara Nelson addressed the council and requested the city respect the will of the people of Gilroy, noting that the electors voted to not join the open Space Authority on Advisory Measure "0". Heard from Miguel Paredes agreeing with the previous speaker. Discussion was had to require additional information regarding the Open space Authority prior to withdrawing from same. (Consensus that no additional information is needed from the county.) councilman Valdez distributed a Progress Report from the city of Paramount re: Gang violence. council Representative Rogers gave updates on the Historical Heritage Committee and visitor's Bureau, noting that the chamber of Commerce will be requesting permission to sub- lease the I.O.O.F. Bldg. councilman Kloecker reported on the ABAG Air Quality policy' committee re: ozone levels and county Transportation commission - Ad Hoc Committee public meeting on bus service for mobility impaired scheduled for December 15, 1993. councilman Kloecker requested the city support NASA Ames Research Center for the new planned Wind Tunnel project to be agendized at the next regular meeting. councilman Kloecker representative of the Santa clara county cities Association, inquired if the city would host their meeting of May 19, 1994. councilman Kloecker gave an update on the ABAG Fall Assembly legislation. councilman Kloecker gave an update on the congestion Management Agency restructuring in January 1994. At 8:40 p.m. the Mayor Adjourned to a Closed Session pursuant to GC Sec 54956.9 (b)(l); potential Litigation old city Hall Lease/Russell & Nancy Hendrickson, former Lessees.
