Father Jim wilson, saint stephen's Episcopal Church gave the Invocation. The city Clerk noted that the Agenda had been posted on April 21, 1994 at 8:59 a.m. Present: councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Pete Valdez, Jr. and Donald F. Gage; 7:00 p.m. Boy Scout Troop #792 presented the Mayor with a Flag and the Mayor presented certificates of Appreciation to Leaders and Boy Scout Members of Troop #792, Girl Scout Troop #398 and 4-H participants. shelly Myers, Recreation Coordinator and special olympics participant presented the Council with T-shirts and invited them to the May 7 special olympics Event at the High school for their Track and Field Event at 9:00 a.m. Motion was made by Councilman Kloecker, seconded by councilman Valdez that the following items under the Consent calendar be approved by the following Roll call Vote: Ayes: Councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage; Approved Budget Amendments/Transfers as recommended; Denied Claim of Darrell Beach as recommended; Approved Tract Map Development Agreement #94-12, Arcadia Development Company as recommended; and Adopted Resolution No. 94-36 Issuing an Accounting order re: Falcon Cable Rate setting Process as recommended. ADOPTED this 25th day of April, 1994, by the following NOES: ABSENT: COUNCILMEMBERS: GILROY, KLOECKER, MORALES, ROGERS, ROWLISON, VALDEZ and GAGE COUNCILMEMBERS: None COUNCILMEMBERS: None; At 7:14 p.m. the Departmental Reports were given by the Finance and Public works Departments re: Life cycle costing: f~ 1 b Bids RDO Numerical Limits RD 92-12 Director of Finance; Property Manager/purchasing Agent; Equipment Maintenance supervisor and Information systems coordinator. The Mayor reconvened the meeting at 7:56 p.m. sergeant Brown presented and explained a recommendation to approve purchase of a video Imaging system for the Police Department, further explained by city Administrator Baksa. Motion was made by councilman Kloecker seconded by council- man Morales and carried that the proposal of TFP, Inc. be awarded in the amount of $71,000.00 for a video Imaging system for the Police Department as recommended. The Mayor stated that it was the time and place scheduled for the public Hearing to establish numerical limits of dwelling units to be permitted under the requirements of the city of Gilroy's Residential Development ordinance for the years 1994 through 2003. The staff Report was noted and further explained by Planning Director Dorn. Discussion was had by Council on the matter. the Mayor declared a recess in order to change the reconvened the meeting at 9:13 p.m. At 9:02 p.m. video tape and Discussion was had by council regarding the Exempt category. city Administrator Baksa noted that same would be presented to council in Mayor June. The Mayor asked if there was anyone in the audience wishing to speak on the matter. Mr. Jim Hoey, 7554 princevalle street, representing the Building Association of Gilroy, addressed the council and noted that later in the agenda they would be requesting a study session with the council regarding the requirements of the Residential Development ordinance. ,.t The Mayor asked if there was anyone further in the audience wishing to speak. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. Discussion was had by Council. Motion was made by councilman Kloecker seconded by Council- man Valdez that the following numerical limits be established for the following years: (directing staff to prepare a Resolution to include the following:) '94-226; '95-297; '96-327; '97-2003/350 each; totalling 3,300 units. councilman Gilroy made a friendly amendment seconded by councilwoman Rogers by the following Roll call vote: to change each of the years from '99 through 2003 from 350 units to 300 units each (accepted by the original makers of the motion.): Ayes: Councilmembers: Gilroy, Kloecker, Rogers, Rowlison, valdez and Gage; Noes: councilmember: Morales. continued discussion was had on proposed changes to RD 92- 12, silicon valley companies, further explained by Planning Director Dorn recommending the modifications to RD 92-12 be approved as presented. Geary coats, representing the applicant, addressed the council and further explained the proposed modifications to RD 92-12. councilman Kloecker noted no objection to the modifications after further review; however, believes that the third phase of 96 units should be re-competed for under the RDO process. Mr. coats noted that the applicant is aware that they would have to compete for the additional 25 units in the third phase, but not for the entire 96 units because 71 of those have already been allocated. Maint.Dist #1 (country Estates) Res.#94-37 Economic Impact policies .. \ ti Guadalupe Arellano, Planning commissioner, addressed the council and noted that she is opposed to the addition of 25 units to this development as modifications and gave objections to the new plan as proposed. Director of Public works Allen answered questions regarding the traffic, crosswalks, and signals in relation to the proposed development. Motion was made by councilman Gilroy seconded by council- woman Rowlison and carried by the following Roll call Vote to approve modifications and proposed changes to RD 92-12, silicon valley companies as presented: Ayes: Councilmembers: Gilroy, Morales, Rowlison and Gage; Noes: councilmembers: Kloecker, Rogers and valdez. A preliminary Annual Levy Report of the Annual Benefit Assessment for Maintenance District No.1, city of Gilroy (country Estates), 1994-1995 Fiscal Year was noted and further explained by city Administrator Baksa. Motion was made by councilman Kloecker seconded by Councilman Gilroy that the reading of Resolution No. 94-37 be waived and that it be adopted of Intention to Adopt Engineer's Report for the 1994-1995 Fiscal Year and Levy and Collect Annual Benefit Assessments. RESOLUTION NO. 94 - 37 RESOLUTION OF INTENTION TO ADOPT ENGINEER'S REPORT FOR THE FISCAL YEAR 1994-95 AND LEVY AND COLLECT ANNUAL BENEFIT ASSESSMENTS WITHIN MAINTENANCE DISTRICT NO.1, CITY OF GILROY. PASSED AND ADOPTED this 25th day of April, 1994, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: COUNCILMEMBERS: COUNCILMEMBERS: GILROY, KLOECKER, MORALES, ROWLISON, VALDEZ and GAGE None None ROGERS, At 11:06 p.m. the Mayor declared a recess in order to change the video tape and reconvened the meeting at 11:12 p.m. Discussion was had on the Draft policy on Economic Impact Policies. councilman Kloecker requested that "in the same facility" be added to No.3. councilwoman Rogers suggested that fiscal analysis be added as to how the sales tax revenue to the city would be affected economically and fiscally. councilman Valdez requested further discussion as to the location of where the proposed policy would apply. city Administrator Baksa noted that this issue should be discussed at a later date. councilman Gilroy agreed if this discussion could be scheduled at an early date. The Mayor asked if there was anyone in the audience wishing to speak on the proposal. Patti Hale, Economic Development chairperson of the Gilroy chamber of Commerce, addressed the council and requested that council refrain from adding another requirement and fee for development. She also requested that council involve their committee in Study sessions regarding business related matters. Ernie Olivares, CEO and President of the chamber of Commerce, addressed the council and requested that the chamber be involved in adoption of city policies of this nature and that developers should also have input. 1;'1 Bldg.Assoc. Garlic Pressers Jane Howard, 3300 Canada Road, Gilroy, small Business owner and member of the Chamber, addressed the Council and noted opposition to additional regulations for businesses. Gary Walton addressed the Council and noted opposition to the city determining what free market should be and opposition to additional regulations. councilman Gilroy agreed that closer working relations with the Chamber on issues such as this matter is needed. Councilman Morales agreed to include the chamber and Hispanic Chamber in policy issues of this nature pertaining to businesses. Motion was made by Councilman Valdez seconded by Councilman Kloecker and failed by the following Roll Call Vote to accept the draft policy on Economic Impact Reports as presented: Ayes: Councilmembers: Kloecker and valdez; Noes: Councilmembers: Gilroy, Morales, Rogers, Rowlison and Gage. Motion was made by Councilwoman Rowlison seconded by councilman Morales and carried that this matter be discussed at the Joint study session of May 12, 1994 with the Gilroy Chamber of Commerce Board of Directors prior to action on the proposed policy and that the chamber invite the Hispanic Chamber representatives to said meeting. Mike Kennedy, 7625 Las Padres ct., representing the Build- ing Association of Gilroy, non-profit organization, addressed the council noting said organization was formed because the present RDO affects small builders in Gilroy and they wish to meet with the city to discuss same. city Administrator Baksa noted that he and Planning Director Dorn would meet with this group. Gary walton, local building contractor, addressed the Council and noted that the in-fill category requirements are not feasible for small contractors. Mark starritt, 710 Fourth Street, addressed the Council and explained the reasoning for formation of the Builders' Associa- tion of Gilroy, noting that a meeting with the city's staff is agreeable; however, requested a meeting with the council at some point in time. The Mayor noted that staff would meet with representatives of the Builders' Association and a meeting can be scheduled with Council at a later date. Council accepted an invitation of the Gilroy Garlic Pressers Inc. to participate in an Exhibition Wheelchair Basketball Game and requested staff obtain suggested dates for the event. Councilman Kloecker noted the city's response to SB 3305. It was noted that the Parks and Recreation commission March 15, 1994 Regular Meeting was cancelled due to lack of a quorum. The Minutes of the senior Advisory Board Meetings of February 18, 1994 and March 21, 1994 were noted. The Minutes of the Library and culture commission Meetings of March 8, 1994 and April 12, 1994 were noted. councilwoman Rowlison noted Library & culture commissioner Tinsley's intention to resign. city Administrator Baksa distributed the Quarterly Reports to council. city Administrator Baksa distributed a Draft of council's vision statement noting that other goals are being studied by staff and requested council contact him if there are any problems with same. Discussion was had regarding the schedule of city council August 1994 Meetings. Motion was made by Councilwoman Rogers seconded by council- woman Rowlison and carried that all regular Council meetings in August 1994 be cancelled except August 1, 1994. Councilman Gilroy voted "no" on the motion. councilman Kloecker requested a proposed summary schedule of agenda items for May and June 1994. councilman Kloecker noted that the county of Santa clara has apologized for not notifying the city of the proposed changes in the transit bus lines schedule and that action on the proposed revisions has been tabled for two weeks.
