Regular Meeting June 27, 1994 Gilroy, California The Mayor led the Pledge of Allegiance to the Flag. The Reverend Becky Goodwin, United Methodist church gave the Invocation. The city Clerk noted that the Agenda had been posted on June 23, 1994 at 9:10 a.m. Present: councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, charles S. Morales, Connie Rogers, Suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage; 7:00 p.m. The Mayor welcomed the Gilroy Unified High School Government students - Summer classes. Councilman Gilroy reported on the recent Gilroy city Council/Garlic Pressers Basketball Team Game and introduced Bob Collins and stu Taylor noting that the Mayor has agreed to spend a day in a wheelchair because he did not participate in the event and the city council lost the game even though the Garlic Pressers spotted them 25 points. Motion was made by Councilman Gilroy, seconded by Council- man Kloecker that the following items under the Consent calendar be approved by the following Roll Call Vote: (Removing Item "B" Resolution approving a General plan Amendment to update the Housing Element of the city's General Plan, GPA 90-01) Ayes: Councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage; Adopted Resolution No. 94-54 approving a Tentative Map request of silicon Valley Development, TM 93-05 to subdivide three parcels totalling approximately 3.86 acres into a fourteen lot single family residential subdivision; RESOLUTION NO. 94 - 54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY CONDITIONALLY APPROVING APPLICATION TM 93-05 FOR A VESTING TENTATIVE SUBDIVISION MAP FOR A 14-LOT RESIDENTIAL SUBDIVISION ON APPROXIMATELY 8.17 ACRES, AFFECTING APNS 790-20-069, -070 AND -076, LOCATED ON THE EAST SIDE OF KERN AVENUE EXTENDING TO WREN AVENUE, NORTH OF WELBURN AVENUE. Arcadia Housing Element Res.94-55 GPA 90-01 Pub.Hear. Comp.Fees Res.94-56 6527 Approved Development Agreement #94-17A, Arcadia Development Company, Tract #8563 as recommended. Discussed the Resolution regarding a General plan Amendment to update the Housing Element of the city's General Plan, GPA 90- 01. councilman Gilroy requested a study session prior to approval of same. The Mayor noted that staff and the Housing Task Force will review and make recommendations on each of the policies within the Housing Element prior to Council consideration. councilman Kloecker noted that he would receive an update on ABAG's recommendation regarding the Housing Element and would advise the council on action taken. Motion was made by councilman Valdez seconded by Council- woman Rowlison that the reading of Resolution No. 94-55 be waived and that it be adopted approving a General Plan Amendment to update the Housing Element of the city's General Plan, GPA 90-01. RESOLUTION NO. 94 - 55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING GPA 90-01, AMENDING THE GENERAL PLAN OF THE CITY OF GILROY BY ADOPTING AND ADDING THERETO A HOUSING ELEMENT. PASSED AND ADOPTED this 27th day of June, 1994, by the following vote: AYES: NOES: ABSENT: COUNCILMEMBERS: KLOECKER, MORALES, ROGERS, ROWLISON, VALDEZ and GAGE COUNCILMEMBER: GILROY COUNCILMEMBERS: None; Council requested that the membership of the Housing Task Force Committee be reviewed. At 7:20 p.m. the following Departmental Topics were presented: Planning Director: Train Depot and Old city Hall updates; Resource Management Coordinator: Grant Received on Used Motor oil Program; city-wide Garage Sale Day; and Resource Reduction. At 8:03 p.m. the Mayor reconvened the meeting. The Mayor stated that it was the time and place scheduled for a Public Hearing to consider revisions and adjustments to the Comprehensive Fee Schedule of the city of Gilroy. Director of Public works Allen explained the addendum to the staff Report assisted by city Engineer smelser, recommending that the Commercial categories remain in one category as originally proposed. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposed fees. Mr. Mark Lazzarini, Executive Director of the Building Industry Association, addressed the Council noting his objections to the proposed fees requesting that the council review the proposed fees with BIA prior to adoption of same. The Mayor asked if there was anyone further in the audience wishing to speak on the matter. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. Discus- sion was had by Council. Motion was made by councilwoman Rowlison seconded by Councilman Kloecker that the reading of Resolution No. 94-56 be waived and that it be adopted revising and adjusting the comprehensive Fee schedule as recommended. 6528 Intro.Ord. RESOLUTION NO. 94 - 56 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING A COMPREHENSIVE FEE SCHEDULE REVISING FEES CHARGED BY ALL DEPARTMENTS OF THE CITY. PASSED AND ADOPTED this 27th day of June, 1994, by the following vote: AYES: COUNCILMEMBERS: GILROY, KLOECKER, MORALES, ROGERS, ROWLISON, VALDEZ and GAGE COUNCILMEMBERS: None COUNCILMEMBERS: None NOES: ABSENT: Council requested that Staff review the fees with the Builders' Association including the Local Building Association, chamber of commerce, Hispanic chamber and others interested in this matter to attempt to address the issues of the Building Industry Association. councilman Morales suggested that a Study session of the comprehensive Fee Schedule be televised as information to the public. councilman Valdez requested that the standards for Level of Service be a part of the comprehensive Fee Schedule. Introduction of zoning Ordinance Text Amendment, Z 93-08 was noted. (city of Gilroy) (Public Hearing Held 6-6-94.) Motion was made by Councilman Gilroy seconded by Councilman Kloecker and unanimously carried that the ordinance be read by title only and waived further reading of the ordinance. The Clerk read the ordinance by title only. Motion was made by councilman Kloecker seconded by Councilwoman Rowlison and carried that the zoning Ordinance Text Amendment be introduced and published by title and summary. Introduction of ordinance approving Z 94-05 prezoning property from county Agriculture and General Industrial (M2) to Shopping Center commercial planned Unit Development (C3-PUD) and General Industrial planned Unit Development (M2-PUD) to become a Consolidated C3/M2-PUD (Shopping Center Commercial/General Industrial-planned Unit Development District on property located northeast of U.S. Highway 101 and north of U.s. Highway 152, on approximately 182 acres, Kimball small properties, applicant. (Public Hearing held 6-20-94.) Councilwoman Rowlison inquired of the right-to-farm act. Acting city Attorney Korb noted that they are not completed with their analysis of the matter further explaining same. Motion was made by councilman Kloecker seconded by councilman Valdez and unanimously carried that the ordinance be read by title only and waived further reading of the ordinance. The Clerk read the title of the ordinance. Motion was made by Councilman Kloecker seconded by Councilman Valdez and carried that the ordinance be introduced approving Z 94-05 to be published by title and summary. The Mayor noted discussion of Interviews for the two Library and culture commission appointments for unexpired terms 1-1-95 and 1-1-98 noting two applications were received by the June 24, 1994 deadline. Discussion was had regarding extending the deadline to receive applications for the two appointments. Motion was made by councilwoman Rowlison seconded by councilman Gilroy by the following Roll Call Vote to not extend the deadline for receipt of applications and conduct interviews by council through the telephone and that the matter of appoint- old city Hall P & R Com. 5-17-94 Pers.Ccm. 6-13-94 65?H ment be agendized for the next regular council Meeting (7-5- 94).Ayes: councilmembers: Gilroy, Morales, Rowlison and Gage; Noes: Councilmembers: Kloecker, Rogers and valdez. (At 9:00 p.m. the Mayor declared a Recess in order to change the video tapes and reconvened the meeting at 9:08 p.m.) councilwoman Rowlison requested staff review the proposed charter changes regarding commission duties to be voted upon at the earliest possible Election. city Administrator Protempore Dorn presented a lease for the Old City Hall with R. Hendrickson and explained the terms of said lease. Motion was made by Councilman Kloecker seconded by councilwoman Rogers and carried that the lease for the old city Hall be approved as presented. Motion was made by councilman Kloecker seconded by Council- man Valdez and carried that the classification description for planner III be approved as recommended. Motion was made by councilman Kloecker seconded by councilman Valdez and carried that a Non-Smoking Contract be added to all Miscellaneous Job Descriptions of the Police Department as recommended. Sr-::: ('"'0 JJ GDDC Adjrnmt. city Administrator protempore Dorn noted no update on Water Conservation Program. city Administrator Protempore Dorn noted that an update on the DeBell Maintenance Reserve will to be reagendized July 5, 1994 when the City Administrator is present. Acting city Attorney Korb presented an Opinion regarding Gilroy Downtown Development corporation in relation to Brown Act Issues. He explained that if a councilmember is a voting member of the Board of Directors of the GDDC that the Board meetings of the GDDC must comply with the open meeting provisions of the Brown Act. councilman Kloecker noted that he was appointed to ABAG for an additional two years. councilman Kloecker gave an update on the Youth Center project.
