Pastor Bob Achilles, Trinity Bible Church, gave the Invocation. The city clerk noted that the Agenda had been posted on september 22, 1994 at 8:46 a.m. Present: councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage; 7:00 p.m. The Mayor presented certificates of Appreciation to Richard Kaiser, project Chairman, and Karen Riso, club President of the Gilroy Kiwanis club for installation of the circular sidewalk around the Wheeler community Center Tot Lot. Motion was made by Councilman Kloecker seconded by council- man Gilroy that the following items under the Consent calendar be approved removing Item "B" resolution approving GPA 93-02, by the following Roll Call Vote: Ayes: Councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Pete Valdez, Jr. and Donald F. Gage: Approved Budget Amendments/Transfers as recommended; and Adopted Resolution No. 94-72 approving Reorganization of uninhabited Territory (city of Gilroy Property) "Miller Avenue Reorganization 94-01 of the city of Gilroy, containing 15.732 acres of uninhabited territory. RESOLUTION NO. 94 - 72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ORDERING THE REORGANIZATION OF APPROXIMATELY 15.732 ACRES OF LAND EAST OF MILLER AVENUE AND SOUTH OF CHRISTMAS HILL PARK, FOR ANNEXATION TO THE CITY OF GILROY AND DETACHMENT FROM THE SOUTH SANTA CLARA COUNTY FIRE DISTRICT (MILLER AVENUE REORGANIZATION 94-01). 'J . ,} At 7:08 p.m. a Public Works Departmental Report was given by Director of Public Works Allen re: Chip seal program/survey; Equipment Maintenance Supervisor Miller re: city's Corp. Yard Expansion/Improvement project; and City Engineer Smelser re: Transportation capital Improvement projects. At 8:07 p.m. the Mayor reconvened the meeting. A request of the Gilroy chamber of Commerce for conceptual approval of the City's participation in an Economic Development Program was noted and further explained by city Administrator Baksa. Discussion was had by Council on the matter. Patti Hale, representing the Gilroy chamber of Commerce Economic Development committee, addressed the Council requesting the city's partnership for participation in the proposed program further explaining same. At 9:00 p.m. the Mayor declared a Recess and reconvened the meeting at 9:10 p.m. sherri stuart, representing the Gilroy Chamber of Commerce Economic Development Committee focus group, addressed the Council further explaining the proposed program requesting the city's participation. Gary Bowe, 5097 El Dorado Drive, addressed the council requesting the city's support in the program. Further discussion was had by council on the matter. Motion was made by councilman Gilroy seconded by council- woman Rowlison and carried that the matter of the city'S parti- cipation in the Economic Development Program be continued to the November 7, 1994 regular Council Meeting in order to allow time to explore availability of funding. Park Supervisor Headley gave a presentation on Las Animas Park Frontage Improvements and Babbs Creek project. Discussion was had and explained by Director of Public Works Allen regarding the need to remove some species of oak trees within the alignment of Thomas Road improvement adjacent to Babbs Creek Project. Director of Public works Allen presented and explained the staff Report and information regarding the draft anti-graffiti ordinance and proposed schedule for adoption. Discussion was had by Council on the matter. Council agreed to further discuss same at a study Session on October 10, 1994 together with presentation of the previously scheduled session on the city of Salinas' Gang Advisory Committee. Andy Faber, Acting city Attorney was directed to determine from the city of Davis how their anti-graffiti program penalties are regulated by the Vehicle Code and process for requiring state and county to pay expenses incurred when their buildings are targets of graffiti. Council directed staff to determine if other cities with anti-graffiti ordinances have realized a decrease in graffiti from their regulations. Councilman Kloecker requested staff contact the county regarding repeated graffiti at the bus stops at the senior Center and at sixth and Rosanna streets and their time line for removing same through their recent contract for maintenance of these bus stops. 656G P & R Com. 8-16-94 Pers.Com. Motion was made by councilman Kloecker seconded by councilman Valdez and carried that the list for Police Records Technicians be abolished as recommended. Planning Director Dorn presented and explained a staff recommendation for flexibility in negotiating the first year's deadlines for RDO performance agreements. Council requested that they be informed of any changes in RDO performance agreement completion dates and update on allocation backlogs.. city Administrator Baksa and Planning Director Dorn gave an update on status of Garlic country U.S.A. proposed project. council requested a written summary of the traffic, sewer and water impacts of the proposed project as presented. city Administrator Baksa distributed a staff report on the Community survey results to be discussed at the september 27, 1994 Council study Session. councilwoman Rowlison inquired of the status of the Theatre Angel's Grant Funds. The Mayor noted he is pursuing the matter with supervisor Honda's office. Adjrnmt. 6561 The Mayor reported on the recent golf tournament for community Youth Center fund raiser and its success. councilman Gilroy complimented and thanked John Garcia and staff for their assistance and success of the tournament. councilman Kloecker noted the CMA and ABAG are discussing Land Use Planning issues and that staff notify council of Technical Advisory committee policy issues relating to land use planning prior to supporting/opposing same. Discussion was had regarding the recent newspaper article on law enforcement at the outlet Center.
