The Mayor led the Pledge of Allegiance to the Flag.
Pastor Malcolm Macphail, First Assembly of God church, gave
the Invocation.
The city clerk noted that the Agenda had been posted on
November 23, 1994 at 9:15 a.m.
Present: councilmembers: K. A. Mike Gilroy, Paul v.
Kloecker, charles S. Morales, Connie Rogers, suellen C. Rowlison,
Pete valdez, Jr. and Donald F. Gage; 7:00 p.m.
Motion was made by Councilman Gilroy, seconded by council-
man Kloecker that the following items under the Consent calendar
be approved by the following Roll call vote: Ayes: councilmem-
bers: K. A. Mike Gilroy, Paul V. Kloecker, Charles S. Morales,
connie Rogers, Suellen C. Rowlison, Pete valdez, Jr. and Donald
F. Gage:
Denied Claim of Top Hat Industries as recommended;
Approved Budget amendments/transfers as recommended; and
Adopted Resolution No. 94-80 issuing an Accounting Order to
Falcon Cable systems as recommended;

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY REGARDING AN
ACCOUNTING ORDER TO FALCON CABLE SYSTEMS.

Director of Human Resources Valenzuela gave his Depart-
mental Report and at 9:53 p.m. the Mayor reconvened the meeting.
city Administrator Baksa presented and explained a
recommendation to award the bid of carl Chevrolet in the amount
of $14,037.86 for an extended cab compact pick-up truck with mini-
dump body for $5,867.15.
Motion was made by Councilman Gilroy seconded by councilman
Kloecker and carried that the bid of carl Chevrolet be awarded in
the amount of $14,037.86 for an extended cab compact pick-up
truck with mini-dump body in the amount of $5,867.15 as
recommended.
A proposed ordinance regulating graffiti was noted and
further explained by city Administrator Baksa and Director of
Public Works Allen. Discussion was had on the proposed
ordinance.
Motion was made by councilman Gilroy seconded by councilman
Morales and unanimously carried that the ordinance be read by
title only and waived further reading of the ordinance.
Motion was made by Councilman Kloecker seconded by
Councilwoman Rogers and carried that the ordinance be introduced
and published by title and summary.
A recommendation on amendments to the Uniform Fire and
Building Codes/Automatic Fire sprinklers was noted and further
explained by Assistant Fire chief Ledesma.

Motion was made by Councilwoman Rowlison seconded by
councilwoman Rogers and carried that the reading of Resolution
No. 94-81 be waived and that it be adopted.
RESOLUTION NO. '4 - 81
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING
AMENDMENTS TO CHAPTER 38 OF THE UNIFORM BUILDING CODE AND ARTICLE
10 OF THE UNIFORM FIRE CODE REQUIRING THAT SPECIFIED BUILDINGS
3,000 SQUARE FEET OR LARGER SHALL BE PROTECTED BY AN AUTOMATIC
FIRE SPRINKLER SYSTEM.

The following informational items were noted with no
separate discussion on same:
proclamation Issued by Mayor Gage: Dr. Martin Luther King,
Jr. Day - January 16, 1995;
opening for League Director position - peninsula Division
of League of california cities; and
violent crime control and Law Enforcement Act of 1994.
Discussion was had and council agreed and concurred to
schedule a city council 1995 Retreat for January 27 and 28, 1995.
city Administrator Baksa requested council representation
with supervisor Honda regarding Paramedic services with Santa
clara county and noted that a meeting has been scheduled with the
Board of supervisors on Tuesday and with the city of San Jose on
wednesday. councilmembers: Gage, Gilroy and Kloecker noted that
they would represent the city at meetings scheduled regarding
this issue.
Amicus
Acting city Attorney Faber recommended supporting an Amicus
curiae Brief re: Farmers Insurance Group and craig Nelson v.
county of santa clara.
Motion was made by councilwoman Rogers seconded by
councilman Kloecker and carried that the city join Amicus curiae
Brief re: Farmers Insurance Group and craig Nelson v. county of
Santa clara, as recommended.
The Mayor noted a candlelight Walk scheduled for November
30, 1994 at 6:00 p.m. to begin at the Library.
councilman Morales noted that the Salvation Army is seeking
volunteers for their annual holiday campaign.
councilman Kloecker gave an update on the recent election
and approval of keeping the Libraries open.
councilman Kloecker noted that he would represent the city
at the Santa clara county cities Association Meeting on December
7th regarding the Committee on state constitution Revisions and
at the ABAG General Assembly Meeting on December 9, 1994.
