Father Jim wilson, st. stephens' Episcopal Church, gave the Invocation. The city Clerk noted that the Agenda had been posted on December 1, 1994 at 8:35 a.m. Present: councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage; 7:00 p.m. The Mayor presented Certificates of Acknowledgment and Appreciation for emergency care to Debbie Maaslanka and Marlene sutton, noting Alice Dutro ill and not present to receive Certificate. The Mayor acknowledged Rod Kelley school students, thanking council in attendance at their Flag Ceremonies. Motion was made by councilman Gilroy, seconded by Council- man Kloecker that the following items under the Consent calendar be approved by the following Roll call vote: Ayes: Councilmem- bers: K. A. (Public Hearing held 11- 21-94.); RESOLUTION NO. 94-82 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING TM 94-04, FOR A TENTATIVE SUBDIVISION MAP FOR A 112-LOT RESIDENTIAL SUBDIVISION WITH FOUR REMAINDER LOTS ON APPROXIMATELY 69.8 ACRES LOCATED SOUTH OF LONGMEADOW DRIVE, BETWEEN CALLE DEL REY AND RANCHO HILLS DRIVE, APNS 783-21-014, -029, - 035, -036, AND 783-41-060. (Public Hearing held 11-21-94.); RESOLUTION NO. 94 - 83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING TM 94-05, FOR A TENTATIVE SUBDIVISION MAP FOR A 64-LOT RESIDENTIAL SUBDIVISION ON APPROXIMATELY 14 ACRES, LOCATED WEST OF THOMAS ROAD, NORTH OF SANTA TERESA BOULEVARD, APN 808-20-004 AND A PORTION OF APN 808-20-006. ROGERS, The Mayor stated that it was the time and place scheduled for a Public Hearing to consider 1994 Residential Development Ordinance applications. Mayor Gage relinquished the Chair to Mayor Protempore Kloecker due to a conflict of interest regarding the ROO application process. The staff Report previously distributed was noted and further explained by city Administrator Baksa and Planning Director Dorn. Mayor Protempore Kloecker asked if there was anyone in the audience wishing to speak for or against the RDO applications. The following representing RDO applications addressed the council: RD 94-1 Shapell Industries: william E. Ayer recommending council accept the recommendation of the Planning commission; RD 94-2 valley Title company: Louis Tersini request ability to continue their project on an on-going basis; RD 94-4 Farotte Construction: Jack Kent distributed a letter requesting all of the projects in the northwest quad receive a reasonable amount of units to continue development through the 1990s and beyond; RD 94-5 Thomas Road properties: Jack Kent requesting council accept the recommendation of the Planning commission; RD 94-6 Theodore schaal and John Filice: Ted schaal requesting council make more units available for ongoing projects (20 units 1996; 20 units 1998; 23 units 1999; 77 units 2000); RD 94-7 Glen Lorna corporation: Jack Kent urges Council to accept the recommendation of the Planning commission; RD 94-12 silicon valley Diversified Inc.: Geary coats distributed letter requesting additional points be awarded Park Commons VI further explaining reasons for same; RD 94-13 sandro Benassi: Geary coats distributed letter requesting additional points be awarded Cypress courtyard further explaining reasons for same; RD 94-15 and RD 94-16 coast Range Development Inc.: Gary Filice urges Council to allow equal allotments for large and small categories. Noted that they would donate $20,000.00 to th~ Youth Center or other worthy charity in order to compete with larger projects and receive points in categories that smaller Tree Ord. Economic Impact studies GPA 94-03 Res.94-84 6589 projects are unable to receive points. Noted that RD 94-16 applicant has been working with south county Housing and requests council consider as an in-fill type project; RD 94-18, cheng/wang: Deborah ungo-McCormick distributed letter to council requesting review previous allocations to possibly regain units from inactivity and that allocations be given to large and small projects based upon separate categories for each; and Ted schaal noted that he is reserving Lots 18 and 20 in his project for smaller builders. , . Mayor Protempore Kloecker suggested that no decision on the allocations be made at this meeting; that new information be studied and a decision be made at the December 19th regular council Meeting. council concurred, closed the Public Hearing and continued council action to the December 19, 1994 regular meeting. council agreed to tabulate their individual ratings and return to staff by 5:00 p.m. December 8, 1994. Discussion was had regarding a proposed Tree Preservation ordinance. Discussion was had on the matter. council directed staff to develop a Gilroy Educational Awareness Program for tree preservation to attempt to raise the level of awareness of property owners rather than adopt an ordinance at this time. An informal policy on preparation of Economic Impact studies was noted. council approved same by the following Roll call Vote: Ayes: councilmembers: Gilroy, Kloecker, Rogers, Rowlison and valdez; Noes: councilmembers: Morales and Gage. Discussion was had regarding an Economic Impact study for a General plan Amendment (GPA 94-03) to commercial zoning on First street near Santa Teresa Boulevard further explained by Planning Director Dorn. Geary coats, addressed the council representing the applicant, noting that the developer for GPA 94-03 does not have specific users for the project. (At 9:30 p.m. councilwoman Rowlison left the council Chambers.) councilman Valdez requested Council discuss the matter of not allowing commercial west of south valley Freeway. It was suggested that this be a topic of discussion at the council Retreat. council agreed that Economic Impact studies be required at the time a specific user/occupant is known for a specific project by the following Roll call Vote: Ayes: councilmembers: Gilroy, Kloecker, Rogers and valdez; Noes: councilmembers: Morales and Gage; Absent: councilmember: Rowlison. At 9:35 p.m. the Mayor declared a recess and reconvened the meeting at 9:40 p.m. councilwoman Rowlison returned and took her seat at the council table. Motion was made by councilman Kloecker seconded by council- man Valdez that the reading of Resolution No. 94-84 be waived and that it be adopted designating the Santa clara county Transit District as the congestion Management Agency and authorized execution of the Joint Powers Agreement for the administration of the Santa clara county congestion Management Program as recommended by councilman Kloecker. PASSED AND ADOPTED this 5th day of December, 1994, by the following vote: AYES: COUNCILMEMBERS: GILROY, KLOECKER, MORALES, ROGERS, ROWLISON, VALDEZ and GAGE NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None Motion was made by Councilman Kloecker seconded by council- man Valdez and carried that the Administrative code for the Santa Clara County Transit/CMA be approved as recommended by Councilman Kloecker. The Report of the Planning commission Meeting of December 1, 1994 was noted. The Report of the Personnel commission Meeting of November 14, 1994 was noted. Motion was made by councilwoman Rogers seconded by council- man Morales and carried that the following be approved as recom- mended: Extend the Promotion List for corporal until December 1995; Job Description for Purchasing Agent; and Job Title Changes for Equipment Maintenance Supervisor to Fleet Manager and Associate civil Engineer to civil Engineer. Adjrnmt. i l GJ~i city Administrator Baksa presented and explained Sewer and Water Flow Reports. city Administrator Baksa gave an update on the Issue and distributed a news article regarding same. Kloecker noted that this issue would be discussed at Clara County cities Association in January. Paramedic Councilman the Santa Councilwoman Rogers requested the city Council/Managers Team Workshop be discussed at the Council Retreat. councilman Kloecker gave an update on the CalTrain users. councilman Kloecker noted that he would report back to council on the Santa clara county cities Association visit to Sacramento on December 7, 1994. The Mayor noted the following meetings: Gilroy city council study session, December 12, 1994 - 7:00 p.m. Council Chambers, city Hall, 7351 Rosanna Street, Gilroy, CA 95020 re: Review Storm Drain utility concept; Information re: Flood Study; and Discuss councilmembers Pay Increase; Gilroy city council study Session for Interviews of Applicants for commission Appointments, December 13, 1994 - 7:00 p.m., Employees' Lounge, city Hall, 7351 Rosanna street, Gilroy, CA 95020 re: Library & culture Commission; Parks & Recreation commission and Personnel commission; Gilroy City council study session for Interviews of Applicants for commission and Board Appointments, December 14, 1994 - 7:00 p.m., Employees' Lounge, city Hall, 7351 Rosanna street, Gilroy, CA 95020 re: Building Board of Appeals; Handicapped Access Board; and Planning commission. council requested verification of commission applicants being registered voters of the city prior to interviews. At 10:07 p.m. the Mayor adjourned the meeting to a Closed session re: Conference with Real Property Negotiator pursuant to Government code Section 54956.8, further explained by the Acting City Attorney.
