Invocation Posting Agenda Roll call Volunteers Consent calendar Res 95-25 6637 Regular Meeting March 27, 1995 Gilroy, California The Mayor led the Pledge of Allegiance to the Flag. Pastor Malcolm MacPhail, New Hope community Church gave the Invocation. The city Clerk noted that the Agenda had been posted on March 23, 1995 at 9:17 a.m. Present: councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage. - 7:00 p.m. The Mayor presented certificates of Appreciation for March 1995 to Megan Perry, Roger Kilian, Jared snyder, Gary Muraoka and Aaron Avila (police Department) for the Volunteer service Program. Motion was made by councilman Kloecker, seconded by Council- man Gilroy that the following items under the Consent calendar be approved by the following Roll Call Vote: Ayes: Councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, Charles S. Morales, Connie Rogers, suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage; Adopted Resolution No. 95-25 establishing 1995 salary schedule for Firefighters Local 2805; RESOLUTION NO. 95 - 25 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ESTABLISHING 1995 SALARY SCHEDULES FOR GILROY FIREFIGHTERS LOCAL 2805. PASSED AND ADOPTED this 27th day of March, 1995, by the following vote: AYES: COUNCILMEMBERS: GILROY, KLOECKER, MORALES, ROGERS, 6638 carnival Budget Pub.Hear. GPA 93-4 Pub.Hear. GPA 93-03 NOES: ABSENT: ROWLISON, VALDEZ and GAGE COUNCILMEMBERS: None COUNCILMEMBERS: None; Granted permission to Davis Amusement Cascadia to operate a carnival at Wal-Mart as recommended; and Approved Budget Amendments/Transfers as recommended. At 7:15 p.m. the Fire Department gave their Departmental Report and the Mayor reconvened the Meeting at 7:50 p.m. The Mayor stated that it was the time and place scheduled for the continued Public Hearing to consider a General Plan Amendment request to amend the General plan Map from Industrial Park to General Services Commercial, on approximately 5 acres, for property located at 8690 San Ysidro Avenue, between Leavesley Road and Las Animas Avenue, Greg Mussallem & Ivan Zubow, applicants, GPA 93-04. (continued from 9-6-94 and 3-20-95; Public Hearing held 3-20-95 and Council action continued to March 27, 1995.) Mr. Keith Higgins, Traffic Engineer, addressed the Council further explaining the traffic studies made regarding this project. Discussion was had by Council on the matter. Motion was made by Councilman Kloecker seconded by Council- man Valdez that Staff be directed to prepare a Resolution approv- ing GPA 93-04 and GPA 93-03 and adopting a Statement of overriding consideration and making CEQA findings and adopting mitigation monitoring program. Before voting on the motion the Mayor re-opened the Public Hearing and asked if there was anyone in the audience wishing to speak on the proposal. Gloria Ballard, MH Engineering representing the applicants, addressed the council further explaining their request for approval of the project. The Mayor asked if there was anyone further in the audience wishing to speak. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. The motion was restated directing Staff to prepare a Resolution approving GPA 93-04 and adopting a Statement of overriding consideration and making CEQA findings and adopting mitigation monitoring program by the following Roll Call vote: Ayes: councilmembers: Kloecker, Morales, Rogers and valdez; Noes: Councilmembers: Gilroy, Rowlison and Gage. At 9:12 p.m. the Mayor declared a Recess and reconvened the meeting at 9:17 p.m. The Mayor stated that it was the time and place scheduled for the continued Public Hearing to consider a General plan Amendment request to amend the General plan Map from Industrial park to General Services commercial, on approximately 10 acres, for property located at 8620 San Ysidro Avenue, between Leavesley Road and Las Animas Avenue, David Ninomiya, Ben Koda and Ann Koda, Applicants, GPA 93-03. The Mayor re-opened the Public Hearing and asked if there was anyone in the audience wishing to speak for or against the proposal. Mr. David Ninomiya, Applicant, addressed the council further explaining his project. Z 95-01 Ag.Preserve Lib & cult. Housing Task Force 6639 The Mayor asked if there was anyone further in the audience wishing to speak. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. Motion was made by councilman Kloecker seconded by council- man Valdez that staff be directed to prepare a resolution approv- ing GPA 93-03 by the following Roll Call Vote: Ayes: Councilmem- bers: Kloecker, Morales, Rogers and Valdez; Noes: Councilmembers: Gilroy, Rowlison and Gage. The Mayor noted the ordinance approving Z 95-01, amending the city of Gilroy zoning Map from Al (Agriculture) to R1-PUD (single Family Residential-planned unit Development) on approxi- mately 9.06 acres for property located on the east side of Santa Teresa Boulevard and the easterly terminus of Longmeadow Drive, Gerard & Lambert, Inc., applicants. (Public Hearing held 3-20-95). Motion was made by councilman Kloecker seconded by councilman Valdez and unanimously carried that the title of the ordinance be read waiving further reading of the ordinance. Motion was made by councilman Kloecker seconded by councilman valdez and carried that the proposed ordinance be introduced and published by title and summary. The Mayor recommended that councilman Kloecker be appointed as the council representative for the Agriculture Preserve study committee. Motion was made by councilman Valdez seconded by councilwoman Rogers and carried that councilman Kloecker be appointed as the council representative on the Agriculture Preserve study committee as recommended. The Mayor asked if there was anyone in the audience wishing to speak on any matter not on the agenda. There was no comment from anyone in the audience. The Minutes of the Library & culture commission Meeting of March 14, 1995 were noted. The Golf Course News, February-March 1995 was noted. city Administrator Baksa distributed a list of candidates for the Housing Element Implementation Task Force requesting council return their selections to the city Clerk by March 31, 1995 for appointment at the next regular council Meeting of April 3, 1995. City Administrator Baksa explained the General Fund Revenue Report. l GGI10 Adjrnmt. The Mayor noted the south county Regional Wastewater Authority Meeting March 28, 1995. councilwoman Rogers gave an update on the Gilroy Visitors' Bureau activities and noted separate Bank account established for same. councilman Kloecker noted the Santa Clara county cities Association General Membership Meeting, April 13, 1995 in Santa Clara re: california Constitution Revision commission. councilman Gilroy noted that he attended the ground breaking ceremonies for the Veterans Hospital in the southern part of the county to be completed in approximately 1 1/2 years.
