The Mayor led the Pledge of Allegiance to the Flag.
There was no Pastor present to give the Invocation.
The city clerk noted that the Agenda had been posted on
March 30, 1995 at 10:05 a.m.

The Mayor introduced New Employee: Cheryl carreiro, publicI
safety Communicator I.
The Mayor presented a Proclamation to South valley
counseling for Tobacco Free Families Month - April, 1995.
Motion was made by councilman Kloecker, seconded by council-
man Valdez that the following items under the consent Calendar be
approved by the following Roll Call Vote: Ayes: councilmembers: K.
A. Mike Gilroy, paul v. Kloecker, Charles s. Morales, connie
Rogers, Suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage;
Minutes of the Regular Council Meeting of March 20, 1995;
Approved Budget Amendments/Transfers as recommended; and
Adopted Resolution No. 95-26 aending Conflict of Interest
code of the city. The city Attorney presented a revised copy of
the resolution to council, noting that the change is for clarity
purposes only.

RESOLUTION NO. 95 - 26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ADOPTING A
CONFLICT OF INTEREST CODE WHICH INCORPORATES BY REFERENCE THE FAIR
POLITICAL PRACTICES COMMISSION'S STANDARD MODEL CONFLICT OF
INTEREST CODE.
PASSED AND ADOPTED this 3rd day of April, 1995 by the following

city Administrator Baksa presented a recommendation on a
proposal of Mieger, Mineweaser & Associates for the willey House
Renovation project consultant for design services not to exceed
$35,964.00.
Motion was made by councilman Kloecker seconded by council-
man Valdez and carried that the proposal of Mieger, Mineweaser &
Associates for the willey House Renovation project consultant for
design services be approved as recommended, not to exceed
$35,964.00.
The Mayor stated that it was the time and place scheduled
for a public Hearing to consider establishing numerical limits
under requirements of the Residential Development Ordinance for
1996 through 2003.
The staff Report was noted and further explained by planner
II Durkin.
The Mayor asked if there was anyone in the audience wishing
to speak on the matter. There was no comment from anyone in the
audience. The Mayor closed the Public Hearing.
Motion was made by councilman Kloecker seconded by
councilman Gilroy and carried that staff be directed to prepare a
resolution establishing numerical limits for 1996-2003 as
recommended by staff.
The ordinance adding chapter 19B to the city code to provide
for a storm and Surface Management Enterprise and utility was
noted.
The Mayor noted correspondence from G. R. Cooke suggesting
alternative methods for improvement funds and from Jim Hoey
requesting the matter be placed on the ballot.
Discussion was had by council on the matter.
Motion was made by councilman Kloecker seconded by
councilman Valdez and unanimously carried that the title of the
ordinance be read and waived further reading of the ordinance.
The Clerk read the title of the ordinance.
The Mayor asked if there was anyone in the audience wishing
to speak on the matter with new information.
The following addressed the council:
cal LeNeave requesting the matter be placed on the ballot.
Miguel Paredes requesting the ordinance be placed on the
ballot and not as an advisory measure.
Tom springer, 7300 Orchard Drive, proposed the city
establish a Benefit Assessment District requiring a vote of the
electorate.
Discussion was had by council on the matter and requested
staff investigate the matter of a Benefit Assessment District
prior to the second reading of the ordinance on April 17, 1995.

Motion was made by Councilman Kloecker seconded by
Councilman Valdez and carried that the ordinance be introduced and
published by title and summary by the following Roll Call Vote:
Ayes: Councilmembers: Kloecker, Morales, Rogers and valdez; Noes:
councilmembers: Gilroy, Rowlison and Gage.
The Mayor recommended appointment of councilman Kloecker to
the CalTrain-Gilroy Policy Advisory Board.
Motion was made by Councilman Gilroy seconded by council-
woman Rogers and carried that councilman Kloecker be appointed as
the council Representative to the Cal-Train Gilroy policy Advisory
Board as recommended and requested by the Santa Clara Transporta-
tion Agency.

The Minutes of the south County Regional Wastewater
Authority Meeting of January 10, 1995 were noted.
city Administrator Baksa noted the Reorganization Proposal
of the city is anticipated to be presented to council at their
April 24, 1995 regular meeting.
council concurred with changing the location of the April
10, 1995 Study session to the Employees' Lounge noting the time
change to 7:30 p.m.
councilwomen Rowlison and Rogers reported on the First
Annual Art Faire in the community Youth Center.
councilman Morales noted the Victory Outreach Pancake
Breakfast Fund Raiser.
councilman Kloecker noted the Exchange club Ceremonies
honoring Public Safety officers and opening Ceremonies of the
Little League that he attended as Mayor Protempore in the Mayor's
absence.

councilmen Kloecker urged council to attend the Santa clara
county cities Association General Membership Meeting April 13,
1995 regarding state constitution Revision Commission.
councilman Gilroy noted that he would be absent from the
April 4, 1995 Gang Task Force Meeting.
