No. 1 6G67 Regular Meeting June 5, 1995 Gilroy, California The Mayor led the Pledge of Allegiance to the Flag. Pastor Lee Neish, united Methodist Church, gave the Invocation. The city Clerk noted the Agenda had been posted on June 1, 1995 at 11:15 a.m. Present: councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage. - 7:00 p.m. The Mayor introduced David Aceves, Police officer. The Mayor presented John E. Pate, Retired south county Joint Planning Advisory Committee Member with a certificate of service. Motion was made by Councilman Kloecker, seconded by council- man Valdez that the following items under the Consent calendar be approved by the following Roll Call Vote removing Item "E" Recommendation to Declare surplus Equipment: Ayes: Councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, charles S. Morales, connie Rogers, suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage; Minutes of the Regular council Meeting of May 15, 1995; Approved Budget Amendments/Transfers as recommended; Approved revisions to Agreements and Bylaws of the Santa Clara county cities Association as recommended; Minutes of the Regular Council Meeting of May 22, 1995~ and Authorized submittal of a Grant proposal to The David & Lucile Packard Foundation as recommended. ,( Discussed the recommendation to declare surplus Equipment and requested the city offer all surplus equipment to the school District and Gavilan college prior to sale of any of the items. Motion was made by Councilwoman Rogers seconded by council- woman Rowlison and carried that all surplus equipment of the city be offered to the school District and Gavilan college prior to auction or sale of same. Motion was made by councilman Kloecker seconded by councilman valdez that the surplus equipment be so declared as recommended by the following Roll call Vote: Ayes: councilmembers: Gilroy, Kloecker, Morales, Rogers, Rowlison, Valdez and Gage. The Mayor stated that it was the time and place scheduled for the Public Hearing to consider the annual Benefit Assessment for Maintenance District #1, city of Gilroy (country EstateS), 1995-1996 Fiscal Year. The staff Report was noted. The Mayor asked if there was anyone in the audience wishing to speak for or against the proposal. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. Motion was made by councilman Kloecker seconded by councilman Morales that the reading of Resolution No. 95-44 be waived and that it be adopted. Agreement Res.95-46 Ord.95-10 '1'0 ''THq;f\NNUAL' miDGET AND ENGINEER'S REPORT,. OVERRULING PROTESTS AND ORif.ERING THE LEVY AND COLLECTION OF BENEFIT ASSESSMENTS FOR THE FI~CAL YEAR 1995-1996. PASSED AND ADOPTED this 5th day of June, 1995 by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: COUNCILMEMBERS: COUNCILMEMBERS: GILROY, KLOECKER, MORALES, ROWLISON, VALDEZ and GAGE None None ROGERS, ~he Mayor stated that it was the time and place scheduled for th~ Public Hearing to consider the Facility Financing Contract in conjunction with the Energy Service Contract entitled "Agree- ment with city of Gilroy for a Honeywell comprehensive Technical Services Program." The staff Report was noted and further explained by city Administrator Baksa and the city Attorney. Council requested copies of the Report of the Task Force that is monitoring the program. city Administrator Baksa noted their report would be included in the quarterly reports. councilwoman Rogers requested a reply to the former service maintenance contractor's letter. The Mayor asked if there was anyone in the audience wishing to speak on the proposal. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. Motion was made by councilman Kloecker seconded by councilman Valdez that the reading of Resolution No. 95-45 be waived and that it be adopted authorizing the city to enter into certain energy conservation contracts pursuant to State law. RESOLUTION NO. 95 - 45 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AUTHORIZING THE CITY TO ENTER INTO CERTAIN ENERGY CONSERVATION CONTRACTS. PASSED AND ADOPTED this 5th day of June, 1995, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: COUNCILMEMBERS: COUNCILMEMBERS: GILROY, KLOECKER, MORALES, ROWLISON, VALDEZ and GAGE None None ROGERS, Motion was made by councilman Kloecker seconded by Council- man Valdez and carried that the Addendum to the Agreement as presented with the city for a Honeywell comprehensive Technical services Program be approved as recommended. Motion was made by Councilman Kloecker seconded by Council- man Valdez that the reading of Resolution No. 95-46 be waived and that it be adopted authorizing the Lease Agreement, signatories, Designation of Tax Exempt Qualification and Notice of Intent to be Reimbursed. RESOLUTION NO. 95 - 46 A RESOLUTION AUTHORIZING LEASE AGREEMENT, SIGNATORIES, DESIGNATION OF TAX-EXEMPT QUALIFICATION AND NOTICE OF INTENT TO BE REIMBURSED. ORDINANCE NO. 95 -10 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GILROY AMENDING Ord.95-8 Referendum 6669 SECTIONS 50.62(b)(c), 50.66(d), AND 50.67 OF THE GILROY ZONING ORDINANCE RELATING TO THE RESIDENTIAL DEVELOPMENT ORDINANCE. PASSED AND ADOPTED this 5th day of June, 1995, by the following vote: AYES: NOES: ABSENT: COUNCILMEMBERS: KLOECKER, MORALES, ROGERS, ROWLISON VALDEZ and GAGE COUNCILMEMBER: GILROY COUNCILMEMBERS: None The Registrar of Voter's certification of the referendum petition on Ordinance No. 95-8 adding Chapter 19C to the city Code to provide for a Storm and Surface Water Management Enterprise and utility was noted. Motion was made by Councilman Kloecker seconded by Council- man Valdez that the issue as a referendum be submitted on the November 1995 Ballot. Discussion was had by Council on the matter. Motion was made and carried to agendize the matter on a future council Agenda by the following Roll Call Vote: Ayes: Councilmembers Kloecker, Rogers, Rowlison and valdez; Noes: councilmembers: Gilroy, Morales and Gage.); Santa Clara county Traffic Authority Response to Legislative Bills; and city of Gilroy In Appreciation of Arts Council of Santa Clara county and Gilroy Library & culture commissions' Assistance in the south county coalition Arts Conference. 6670 Adjrnmt. ~=".~~~'<'~""""';~"",";_'_'"_"''''''=.,"",,,,,,=-'.'H''''''.'"""""'~~"'''' _""'.''''0 city Administrator Baksa distributed a report of questions and answers of council in regard to the 1995-2000 Financial Plan of the city. councilwoman Rowlison reported on the Rucker school centennial Celebration and noted the Grand Opening of the Arturo Ochoa Migrant Housing Center June 10, 1995. councilwoman Rogers gave an update on the visitors Bureau Meeting and Rucker Centennial celebration. she noted the 125th Anniversary Banner is scheduled to be up June 7 at 9:00 a.m. councilman Gilroy noted the Antique Fair scheduled for June 18 from 9:00 a.m. to 6:00 p.m. in the Downtown Area. councilman Kloecker requested the city obtain information and possible funding on a Federal Railroad crossing Grant Program. Councilman Kloecker inquired of the county Hazardous Materials Advisory committee request for funds and noted that the cities Association may oppose same. It was noted that the matter would be agendized on the June 19 Council agenda. , The Mayor noted the following meetings/events: santa clara County cities Association Special Presentation re: Fiscal crisis In santa Clara County, June 8, 1995 - 7:30 p.~., sunnyvale city Hall; and Grand opening - Arturo Ochoa Migrant Housing center, June 10, 1995 - 11:00 a.m., 915 Arizona circle, CA 95020. councilman Kloecker noted that the ABAG Board of Directors Meeting will be televised.
