Pastor Richard Garcia, south valley community church, gave the Invocation. The city clerk noted that the Agenda had been posted on september 14, 1995 - 10:30 a.m. Present: councilmembers: K. A. Mike Gilroy, Paul V. Kloecker, charles S. Morales, connie Rogers, suellen C. Rowlison, Pete valdez, Jr. and Donald F. Gage~ 7:00 p.m. The Mayor noted the volunteer of the Month of August, 1995 - Edith Moskowite, senior Craft store - community services Department, unable to be present. Motion was made by Councilman Kloecker, seconded by Council- man Gilroy that the following items under the Consent calendar, be approved by the following Roll Call Vote: Ayes: councilmembers: K. A. Gage; Adopted Resolution No. 95-67 naming future north-south "collector" street located perpendicular to Mantelli Drive, north of Rod Kelly school, "Hirasaki Street"~ RESOLUTION NO. 95 - 67 A RESOLUTION OF THE CITY COUNCIL OF FUTURE NORTH-SOUTH COLLECTOR STREET MANTELL I DRIVE, NORTH OF ROD KELLEY PASSED AND ADOPTED this 18th day of following vote: AYES: COUNCILMEMBERS: THE CITY OF GILROY NAMING A LOCATED PERPENDICULAR TO SCHOOL, "HIRASAKI STREET". september, 1995, by the NOES: ABSENT: GILROY, KLOECKER, MORALES, ROGERS, ROWLISON, VALDEZ and GAGE COUNCILMEMBERS: None COUNCILMEMBERS: None~ Approved a request of South county Housing for a 34 unit RDO exemption, Mantelli Drive, as recommended; Approved MOU's for Firefighters Local 2805, IAFF, Fire Unit July 1, 1994 - June 30, 1996~ and Approved Budget Amendments/Transfers as recommended. The city Attorney presented and explained a recommendation to order foreclosure action on delinquent parcels within the North Forest street Assessment. Motion was made by Councilman Kloecker seconded by councilman Valdez that the reading of Resolution No. 95-68 be waived and that it be adopted. PASSED AND ADOPTED this 18th day of september, 1995, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: COUNCILMEMBERS: COUNCILMEMBERS: GILROY, KLOECKER, MORALES, ROWLISON, VALDEZ and GAGE None None ROGERS, 6 t'1 (J ") , (;" Country Limits Council on Aging city Administrator Protempore Dorn presented and explained a committee approval of a statement of Public convenience and Necessity for Country Limits to obtain a liquor license at 7588 Monterey street for council review. Discussion was had by Council on the matter. council requested agendizing review of city's policy pertaining to city Council's previous designation of the Police chief as delegate to determine whether or not Public convenience and Necessity are met to a subordinate agency re: Alcoholic Beverage control licensing. The Mayor asked if there was anyone in the audience wishing to speak regarding the Country Limits, Inc. application. The applicant of Country Limits, Inc. addressed the council requesting a statement of Public convenience and Necessity from the city for an on-site liquor license for sale of beer only, fur- ther explaining the process he followed for the ABC license at 7588 Monterey street. Dennis Hagins, addressed the Council explaining his reason- ing to ABC in protest of the ABC License at 7588 Monterey street. Matthew Drummond, 7500 Chestnut street, addressed the council noting he forwarded a letter of protest to ABC regarding this license and explained his reasoning for same, noting his letter was received by ABC a day late. Frank Plesek, 6505 Hastings Place, co-owner of country Limits, Inc., addressed the Council explaining the proposed busi- ness practice for control and security if the ABC license is approved. Discussion was had by council on the matter. Motion was made by councilman Kloecker seconded by Council- woman Rowlison that council approve forwarding a statement of Public Necessity and Convenience to the Alcoholic Beverage control Board for an ABC license for on-sale of beer only at 7588 Monterey street for country Limits, Inc. as recommended by staff (noting the letter of protest was considered at an open meeting prior to council action) by the following Roll call Vote: Ayes: councilmem- bers: Kloecker, Morales, Rogers and Rowlison~ Noes: Councilmembers Gilroy, Valdez and Gage. A letter from Joan sothcott resigning as Representative on the council on Aging of Santa clara County was noted. The Mayor stated and Council agreed to allow 30 days for applicants to apply for this appointment with notification to senior citizens and advertisement on channel 34. councilmembers noted that they were not interested in this appointment. (councilman Kloecker suggested that the city be kept informed regarding this project and the Water District should speak to council on this issue.) Noted the Minutes of the Housing Element Implementation Task Force Meeting of August 30, 1995. city Administrator protempore Dorn noted an update on the Water Conservation Program. city Administrator protempore Dorn distributed copies of the new city Vendor's Guide to Council. city Administrator Protempore Dorn reported that the Packard Family Foundation Grant application was received for training citizens volunteering for Emergency Services issue. councilmem- bers Kloecker and Rogers suggested that next year the city apply for the League's Putnam Award for the City's Volunteer projects. The city Attorney reported on the North v city of Gilroy case before the 9th District Federal Court of Appeals, decision pending. The Mayor noted the Exhibition wheelchair Basketball Game scheduled for september 30, 1995 needs to be rescheduled due to a conflict that he has. other councilmembers concurred. The Mayor thanked everyone responding to his recent tragedy. councilman Morales reported on a recent meeting of the south county Agriculture Preserve Task Force. councilwoman Rogers requested staff determine if the chamber of Commerce has an annual outside audit, for council review. councilwoman Rogers complimented the Gilroy Downtown Development corporation for the successful Downtown Fiesta september 17, 1995. 6704 Adjrnmt. Councilwoman Rogers noted she attended one of the cable TV workshops and complimented its success. councilwoman Rogers noted the banner celebrating the 125th Anniversary of the City has been re-installed and noted a Super Heroes' Parade october 7, 1995. councilman Kloecker reported the Transit Board expects a decision in regard to the validity of Measure A in early October. Councilman Gilroy reported on the successful Youth Center Fund Raiser Golf Tournament september 8. Councilman Gilroy reported the Regional President of Kaufman and Broad reported to him the city Staff is the most professional and easy to deal with of all the cities in his region. councilman Gilroy complimented the city Staff on the recent city-wide yard sale project. Councilwoman Rowlison reported on a recent cultural plan Workshop at the Castro Valley Ranch noting the Arts' Council of Santa Clara County will be preparing a document for distribution as a result of the workshop.
