Motion was made by councilman Morales seconded by council-
woman Rowlison that the reading of Resolution No. 95-84 be waived
and that it be adopted approving and adopting the Registrar of
Voters' Canvass of the General Municipal Election and a Consolida-
ted Special Municipal Election and declaring result of said
Election.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING
AND ADOPTING THE REGISTRAR OF VOTERS' CANVASS OF THE GENERAL
MUNICIPAL AND A CONSOLIDATED SPECIAL MUNICIPAL ELECTION AND
DECLARING RESULT OF SUCH ELECTION HELD IN THE CITY OF GILROY ON
NOVEMBER 7, 1995.
RESOLVED, by the city Council of the city of Gilroy,
California that~
WHEREAS, by order of this Council a general municipal
election and a consolidated special municipal elections were held
and conducted in the city of Gilroy and consolidated special
election were held on Tuesday, the 7th day of November, 1995 as
required by law and the charter of said City as amended~ and
WHEREAS, it appears that notice of said general municipal
election and consolidated special election was duly a~d legally
given~ voting precincts were properly established; election
officers were appointed and election supplies furnished~ and in
all respects the election was held and conducted and the votes
cast thereat received and canvassed, and the returns thereof made,
determined and declared in time, form and manner as required by
the Charter of said City as amended and the general laws of the
State providing for and regulating municipal elections in said
City~ and
WHEREAS, the Registrar of Voters did conduct the canvass of
the returns of said municipal elections and did count the absentee
ballots cast thereat, pursuant to direction and order of the city
Council of said city; and
WHEREAS, said canvass was duly completed and the results
thereof were certified by the Registrar of Voters and submitted to
this Council.
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, as follows:
1. Said municipal elections were held and conducted in the
City of Gilroy, county of Santa Clara, State of California on
Tuesday, November 7, 1995 in the time and in the form and manner
as required by law.
2. That there were established twelve (12) voting precincts
for the purpose of holding said municipal elections consisting of
either regular election precincts established for holding state or
county elections, or a consolidation of some or all of such
precincts, as follows:
CONSOLIDATED PRECINCT NO. 3951, comprising state and county
precincts designated Precinct Numbers 3951 and 3966 as
established by the santa clara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3952, comprising state and county
precincts designated Precinct Numbers 3952 and 3955 as
established by the Santa Clara county Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3953, comprising state and county
precincts designated Precinct Numbers 3953 and 3956 as

3. The canvass of the returns of the votes cast and the
counting of absentee ballots cast in said city for the offices of
city councilmembers and Referendum Measure I and charter Amendment
Measures J through 0 was duly held by the Registrar of Voters in
accordance with the order of the Council and in accordance with
law and said Registrar of Voters has executed a certi.ficate
certifying to the results of such canvass, which certificate is
hereto attached, marked Exhibit "A" and by this reference is made
a part hereof. Said certificate has been examined and is hereby
approved and adopted by this council as the official canvass of
said municipal election.
4. The whole number of votes cast in said city of Gilroy at
said municipal election was 4,770 (including 658 absent2e votes).
5. The names of the persons voted for, the offices for
which thlaY were voted, the number of votes recei.ved by each of
said persons in each of said precincts and by absentee votes, are
shmm on said Exhibit "A", hereto attached.
6. The measures voted upon, the number of vo~es received in
favor of and against said measures in each of ~aid precincts and
by absentee votes, together with the whole number of votes which
each measure received in the entire city, are shown on said
Exhibit "A", hereto attached.
7. At said general municipal election and consolidated
special election held in the city of Gilroy on November 7, 1995,
the following persons were elected to the following offices:
DONALD F. GAGE was elected Mayor of the city Council to hold
office for a term of four years, from and after Monday, November
20, 1995, and continuing until his respective successor shall
qualify.
K. A. MIKE GILROY was elected a member of the city council
to hold office for a term of four years, from and after Monday,
November 20, 1995, and continuing until his respective successor
shall qualify.

SUELLEN C. ROWLISON was elected a member of the city council
to hold office for a term of four years, from and after Monday,
November 20, 1995, and continuing until her respective successor
shall qualify.
THOMAS W. SPRINGER was elected a member of the city Council
to hold office for a term of four years, from and after Monday,
November 20, 1995, and continuing until his respective successor
shall qualify.
8. At said special municipal election the following measure
was defeated:

CERTIFICATE OF ELECTION RESULTS

County of Santa clara
I, Dwight M. Beattie, Registrar of Voters of the County of
Santa Clara, State of california, hereby declare that a GENERAL
MUNICIPAL ELECTION was held in the CITY OF GILROY on November 7,
1995 for the purposes of electing the Mayor and three members to
the city Council, and submitting Measures I, J, K, L, M, N, and 0
to the voters of said city~ and to wit:
"I" Adopts Ordinance No. 95-08 adding , Chapter 19C to the Gilroy
city Code to provide for a storm and surface water management
enterprise and utility.
"J" Amends the City Charter to delete obsolete procedural referen-
ces to the first city Charter election held in 1960, specifically
deleting Section 104 (city officers and employees in the year of
1960), Section 402 paragraphs 2 and 3 (initial terms of office for
Mayor and Councilmembers), Section 1005 (status of existing
employees in the year 1960), Section 1403 (setting the date of the
first election), and Section 1501 (holding the charter election).
"K" Amends the city Charter Section 202 to allow the city to
expand its power to contract with public or private agencies for
municipal services for any function of the city, not just for
administrative functions.
"L" Amends the city charter Section 402 to change the date by
which the City Council and Mayor'S terms of office are measured
from the first Tuesday following their election to the first
regular meeting of the city Council following the certification of
the election results by the duly authorized election official.
"M" Amends the city charter Section 403 to delete references to a
requirement that has been held to be unlawful by the courts of the
State of california, specifically, the requirement that a person
must be a resident of the City for at least two years before he or
she can be nominated for or hold office on the city Council.

"N" Amends the city charter section 908 and adds section 909 to
divide the Library and culture commission into two separate
commissions, namely the Library commission and the Arts and
culture commission, and to clarify and establish the duties of
each commission.
"0" Amends the city charter section 1106 to limit the city council
to set any ad valorem property tax and tax rate only if not
prohibited by state law.
That the official canvass of the returns of said election
was conducted by the office of the Registrar of Voter in
accordance with the appropriate provisions of the Elections Code
of the state of california; and
That the state of Votes cast, hereto attached, shows the
whole number of votes cast for each candidate for said Mayoral and
Council seats, and for and against Measures I, J, K, L, M, N, and
o in the city of Gilroy, and in each of the respective precincts~
and that the totals shown for each candidate are true and correct.

The staff Report on a recommendation to approve A/S 95-18
for a PUD Design Review to allow the construction of 12 detached

Avenue, Mark Hewell, applicant, was noted and further explained by
planner stice.
Motion was made by councilwoman Rogers seconded by council-
man springer and carried that staff be directed to prepare a
Resolution approving A/S 95-18.
The Reports of the Housing Element Implementation Task Force
Meetings of october 26, 1995 and November 6, 1995 were noted.
city Administrator Baksa gave an update on the school
District's recommendation for a Police officer at the High school
for security purposes.
city Administrator Baksa noted that the CDBG schedule would
be agendized for Council to select priorities for the citizens'
Advisory Committee.
The Mayor Appointed councilwoman Rogers Mayor pr~tempore
effective December 1, 1995 through August 1, 1996 and noted that
councilman Morales would be appointed next term.
The Mayor thanked Councilman Valdez for assistance in
obtaining the grant for the Youth Center.
Councilman Morales noted Salvation Army is ~eeking
Volunteers for the holiday fund solicitation and are requesting
frozen turkeys for the holidays - 200 Fifth street.
Councilman Morales noted the Concerned citizens for
community safety meeting scheduled for November 15, 1995 and a
recommendation to be presented Council.
councilman Morales gave an update on the South county
Agriculture Preserve study Task Force Meeting and postponed his
report to follow the next meeting and gave a copy of the Urban
Growth Boundaries to be agendized for council review.
Discussed cancelling the November 27, 1995 regular meetin9.
Noted Concerned citizens group intended to make their presentat~on
at that regular council Meeting~ therefore the meeting was not
cancelled.
councilwoman Rogers reminded council to return the ABAG
survey by November 27, 1995.
councilman springer noted the Concern citizens for community
Safety will be presenting a recommendation concerning the curfew
center at the November 27, 1995 regular council Meeting.

The Mayor noted the following Meetings/Events:
council Interviews for commission Appointments, December 12,
1995 - 7:00 p.m., council chambers, 7351 Rosanna street, Gilroy.
council extended the deadline for receipt of applications to
December 1, 1995 at 5:00 p.m.
At 7:55 p.m. the Mayor wished everyone a "Happy
Thanksgiving" and adjourned the meeting.
