A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AUTHORIZING
THE POLICE CHIEF TO DETERMINE WHETHER PUBLIC CONVENIENCE AND
NECESSITY ARE MET IN REGARD TO ALCOHOLIC BEVERAGE LICENSING.
PASSED AND ADOPTED this 27th day of November, 1995 by the
following vote:
RESOLUTION NO. 95 - 86
Motion was made by Councilman Springer seconded by Council-
woman Rowlison that the reading of Resolution No. 95-86 authoriz-
ing the Police chief to Determine Public Convenience and necessity
re: ABC licensing be waived and that it be adopted with the
correction to remove "or his authorized representative" from the
resolution.
Discussed the resolution authorizing the Police Chief to
determine whether public convenience and necessity are met re:
alcoholic beverage licensing through the Alcohol and Beverage
Control.
Approved agreements for sale of city-owned remainder parcel
on Mantelli Drive to South County Housing.
Motion was made by Councilman Gilroy, seconded by Councilman
Morales that the following item under the Consent Calendar, be
approved removing Item B re: Resolution on ABC licenses by the
following Roll Call Vote: Ayes: Councilmembers: K. A. Mike Gilroy,
Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Thomas w.
Springer, Pete Valdez, Jr. and Donald F. Gage:
The Mayor recognized and introduced the Pop Warner Football
Team - Gilroy Browns, noting they recently won their third consec-
utive Pop Warner Pacific Northwestern Regional Championship in
Reno, Nevada, and are scheduled to participate in the Super Bowl
Championship in Orlando, Florida, on December 7, 1995 and are
requesting community donations to assist them in attending this
event.

Councilwoman Rogers requested the city Administrator review
the current Alcohol Beverage control procedures of ABC license
rules for council discussion.
At 7:35 p.m. community Development Director Allen and city
Engineer Smelser gave the community Development Departmental
Report. At 8:40 p.m. the Mayor reconvened the meeting.
city Administrator Baksa presented and explained bids
received for emergency generators recommending award of Bayside
Equipment in the amount of $37,264.00.
Motion was made by councilwoman Rowlison seconded by
councilman Morales and carried that the bid of Bayside Equipment
be awarded in the amount of $37,264.00 as recommended.
At 8:50 p.m. the Mayor declared a recess and reconvened the
meeting at 8:55 p.m.
councilman springer presented a potential curfew Center
proposal of Concerned citizens for community Safety requesting
staff review and make a recommendation to council, further
explained by Monte Mederios including the current San Jose curfew
ordinance and Center.
The Mayor asked if there was anyone in the audience wishing
to speak on the matter.
cecil Taylor, orchard Drive, addressed the council and
discussed the present Police Department procedure regarding the
curfew regulations that he had experienced and cautioned council
to seriously study any additional curfew regulations.

city Administrator Baksa noted a demonstration of the Gilroy
Police Department Entry Team scheduled for December 7, 1995 at
5:00 p.m. at the Rifle Range located at the end of souths ide Drive
near the Wastewater Treatment Plant.
city Administrator Baksa noted an ABAG Police Training
scheduled December 14 to January 8, 1996 and to contact sergeant
Smithee if interested.
city Administrator Baksa gave an update on the Gilroy
Unified school District's request for safety security to be
further discussed jointly after January 1, 1996.
councilman Morales thanked all who contributed to the
Salvation Army.
councilman Valdez welcomed Acting city Attorney, Andrew
Faber.
councilwoman Rogers gave an update on the Hazardous
Materials Meeting. she also noted the Santa clara county cities
Association will be honoring retired councilmembers (Councilman
Kloecker) and newly elected councilmembers (councilman springer)
at their December 14, 1995 Holiday Dinner Meeting and urged
councilmembers to RSVP to the city clerk.
councilman springer noted the locations where non-profit
organizations can operate car washes is included in the council
packet. Discussed city/school use of facilities jointly for
further discussion at the Joint city/school Liaison committee in
January.
councilwoman Rowlison reported that the local chamber of
Commerce and she recently met with the Mayor and city Manager of
watsonville to pursue possible joint meetings for cooperative
efforts between the two cities noting the chamber'S Executive
Director would be presenting same to the Gilroy visitor's Bureau
for discussion.
