Minutes 1996/04/15 i- ~ Invocation posting Agenda Roll call New Emp. co.crime Task Force Consent Calendar 678D Regular Meeting April 15, 1996 Gilroy, California The Mayor led the Pledge of Allegiance to the Flag. Pastor Lee Neish, united Methodist church, gave the Invocation. The city Clerk noted that the Agenda had been posted on April 10, 1996 - 11:00 a.m. Present: Councilmembers: K. A. Mike Gilroy, Charles s. Morales, connie Rogers, suellen c. Rowlison, Thomas w. springer, Pete Valdez, Jr. and Donald F. Gage; The Mayor introduced new employee, Lynn Lawrence, Clerk Typist I - police Department. supervisor Ron Gonzales gave a presentation regarding Crime in Santa Clara county and requested council endorse their proposal. Motion was made by councilman valdez seconded by council- woman Rogers and carried that the city council supports the county crime Task Force proposal as explained by supervisor Gonzales. Rowlison, Thomas w. springer, Pete Valdez, Jr. and Donald F. Gage: Minutes of the Regular Council Meeting of March 25, 1996. The Mayor stated that it was the time and place scheduled for the continued Public Hearing on a rezoning from R1 to R1-PUD on approximately 10.3 acres, on property located at the southwest corner of Farrell Avenue and Monterey street, Z 95-10, South County Housing, applicant. (continued from 3-18-96.) ~ The staff Report was noted and further explained by planner Durkin. Discussion was had by council regarding exempt projects and impact in terms of the effect on the school's needs. The Mayor asked if there was anyone in the audience wishing to speak on the proposal. The following persons addressed the Council: Holly wonder, representing South County Housing further explained the proposed project and addressed the issue of the school impact fees. Patrick Moore, 9111 Church street, thanked the staff and community, Council, etc. for addressing the potential problems and noted consensus of most of the issues but expressed concern with no local neighborhood park in the area. Rick Barmore in favor of the project noting that south County Housing has addressed all neighborhood concerns and issues. Terri wenig, representing the school District noted the Dis- trict supports the affordable housing project but expressed concern of the District to re-visit the definition of affordable housing and to allow the school District to participate and address the issue as affordable housing has a great impact on the District. Councilman valdez noted that a study session of the council/school Board and both staffs should be scheduled. The Mayor asked if there was anyone further in the audience wishing to speak. There was no response from anyone in the audience. The Mayor closed the Public Hearing. Discussion was had by council on the rezoning proposal. Councilman Valdez requested a modification to the mitigation measures to address the ohlone Indian geological site. The city Attorney advised that the mitigation measures should not include same at this time until staff determines if this can be legally imposed. The Mayor requested staff research this matter. Motion was made by councilman Valdez seconded by Council- woman Rowlison and carried that the Negative Declaration has been considered and that it be approved, and findings have been made that there is no substantial evidence that the project will have a significant effect on the environment and that the Mitigation Monitoring Program be adopted as presented and modified. Motion was made by Councilwoman Rowlison seconded by councilman Morales and carried that Staff be directed to prepare an ordinance approving the rezoning of Z 95-10 as modified. The Mayor stated that it was the time and place scheduled for the continued Public Hearing on a Tentative Map request to subdivide parcels totalling approximately 10.3 acres into a 62 lo~ Single Family Residential subdivision on property as noted in the rezoning hearing for Z 95-10, TM 95-05, South county Housing Applicant. . A/S 95-31 RDO Numerical Limits I RDO Amend- ments 6791 The staff Report was noted and further explained by planner Durkin. community Development Director Allen explained the traffic signal proposal relating to the project. councilman springer expressed a need for crosswalks for children from the neighborhood using Las Animas Park. staff noted that traffic counts will be made after completion of the project to determine the number of warrants. The Mayor asked if there was anyone in the audience wishing to speak on the proposal. The following persons in the audience addressed the council: Rick Barmore inquired of the back water area and park for the neighborhood children in the area. Pat Moore spoke to the proposed barrier noting that same could be removed when a school is completed on Farrell Avenue. Marie Juncker, south county Housing Executive Director, spoke to the process and noted appreciation of neighborhood participation in solving the issues concerning this project. The Mayor asked if there was anyone further in the audience wishing to speak. There was no comment from anyone in the audience. The Mayor closed the Public Hearing. council discussion was had regarding conditions 28 and 29. Motion was made by councilman springer seconded by council- man Morales and carried that staff be directed to prepare a resolution approving said Tentative Map request as modified speci- fically conditions #28 and #29, TM 95-05, South county Housing. At 9:10 p.m. the Mayor declared a Recess and reconvened the meeting at 9:18 p.m. The Mayor deviated from the regular agenda in order to complete the Architectural and site Design process of A/S 95-31, South County Housing. The staff Report was noted and further explained by planner Durkin. Discussion was had by council on the matter of rearrangement of the models and council concurred with staff to determine same to allow for flexibility. Motion was made by councilman springer seconded by council- man Gilroy and carried that staff be directed to prepare a resolution approving A/S 95-31 as recommended with twenty-four conditions as noted. The Mayor continued with the regular order of the agenda and noted that it was the time and place scheduled for the Public Hearing to establish Numerical Limits of dwelling units to be permitted under the requirements of the city of Gilroy'S Residential Development ordinance for the year 1997-2003. The staff Report was noted. The Mayor opened the Public Hearing and noting no one present in the audience wishing to speak on the matter, closed the Public Hearing. The Water Conservation Program update was noted. city Administrator Baksa gave an update on Municipal Resource Consultants re: City'S Property Tax Audit Report. City Administrator Baksa distributed a Traffic Impact Fund Reimbursement memo regarding proposed ordinance change further explained by Community Development Director Allen. Council set May 1, 1996 for a study session re: Economic Development Incentives. Councilwoman Rowlison reported on possible establishment of a Youth Corp. Councilman Morales gave an update on the Agricultural Preserve Task Force. Councilwoman Rogers gave an update on the Santa Teresa Corridor study Task Force noting a Joint study session with council/planning and Parks & Recreation commissions would be in order with Santa Teresa property owners within the next two months to discuss their recommendations. Councilman Gilroy noted senior Day May 10, 1996 at 6:00 a.m. and council to volunteer to sell newspapers for their fund raiser.
