The Mayor led the Pledge of Allegiance to the Flag.
Pastor Robert Langley, First Baptist church, gave the
Invocation.
The city clerk noted the Agenda had been posted on
May 2, 1996 - 9:10 a.m.
Present: councilmembers: K. A. Mike Gilroy, charles S.
Morales, connie Rogers, Thomas w. springer, Pete valdez, Jr. and
Donald F. Gage; Absent: councilmember: suellen C. Rowlison.
The Mayor presented the Employee Award for the Month of
March 1996 to Ken Berri, public works' Inspector - community
Development Department.
The Mayor presented certificates of service to J. J. Mireles
and Daniel zuniga, volunteers from the Youth Center that assisted
at the Peace summit. Angel zepeda was not present to receive his
certificate.
At 7:07 p.m. councilwoman Rowlison entered and took her seat
at the council table.
Motion was made by councilman valdez, seconded by council-
woman Rogers that the following item under the Consent calendar be

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY RESETTING
NUMERICAL LIMITS FOR MAXIMUM TOTAL NUMBER OF RESIDENTIAL DWELLING
UNITS TO BE BUILT DURING EACH OF THE YEARS 1994 THROUGH 2003,
INCLUSIVE.

Minutes of the Regular council Meeting of April 1, 1996; and
Approved Improvement Agreement No. 96-05, The vineyards,
Unit III, Kaufman and Broad, Monterey Bay, Inc. as recommended.
city Administrator Baksa presented a proposal on plan
examining and field inspection services recommending award of
proposal to CMA.
Motion was made by councilman springer seconded by
councilman Morales and carried that the proposal be awarded CMA
for plan examining and field inspection services as recommended.
Angel zepeda arrived at 7:12 p.m. and the Mayor presented
him a certificate of service for his assistance at the Peace
summit.
city Administrator Baksa presented a recommendation on bids
received for fence construction and installation.
Motion was made by councilwoman Rowlison seconded by
councilman Morales and carried that the fence construction and
installation bid be awarded West Coast in the amount of $52,700
for fences at various locations as recommended.
An ordinance approving rezoning from R1 to R1-PUD on
approximately 10.3 acres, was noted for property located on the
south side of Farrell Avenue between Church and Monterey Streets,
Z 95-10, South county Housing, Applicant, was noted. (Public
Hearing held and approved April 15, 1996.)
Motion was made by councilwoman Rogers seconded by
councilman Gilroy and unanimously carried that the reading of the
ordinance be read by title only and waived further reading of the
ordinance. The title of the ordinance was read.
Motion was made by councilman Gilroy seconded by
councilwoman Rogers and carried that the ordinance approving Z 95-
10 be introduced and published by title and summary.
Motion was made by councilman Gilroy seconded by
councilwoman Rogers that the reading of Resolution No. 96-27 be
waived and that it be adopted.
RESOLUTION NO. 96 - 27
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING A
TENTATIVE MAP FOR THE SUBDIVISION OF 62 RESIDENTIAL LOTS ON PARCEL

An ordinance approving rezoning from A1 to R1-PUD and
combine designated R1-PUD property with existing R1-PUD and R3-PUD
property in order to create a consolidated PUD combining district
on approximately 38 acres, was noted for property located on the
west side of Thomas Road, north of Babbs Canyon Creek, Z 95-09,
Thomas Road properties, Ltd., applicant.
Motion was made by Councilman Gilroy seconded by Councilman
Morales and unanimously carried that the ordinance be read by
title only and waived further reading of the ordinance. The title
of the ordinance was read.
Motion was made by councilwoman Rowlison seconded by
Councilwoman Rogers and carried that the proposed ordinance be
introduced approving Z 95-09 and published by title and summary.
An ordinance approving a pre zoning from County Agriculture
to C3 (Shopping Center Commercial-Planned Unit Development) on
approximately 10 acres, on property at 8620 San Ysidro Avenue,
north of Leavesley Road, Z 96-03, Ninomiya Nursery Co., Applicant,
was noted. (Public Hearing held and approved April 22, 1996.)
Motion was made by councilwoman Rowlison seconded by
councilwoman Rogers and unanimously carried that the ordinance be
read by title only and waived further reading of the ordinance.
The title of the ordinance was read.
Motion was made by Councilwoman Rowlison seconded by
councilman Valdez and carried that the ordinance approving Z 96-03
be introduced and published by title and summary.
city Administrator Baksa presented and explained a
recommendation on Leavesley Road widening bid further explained by
city Engineer Smelser.
Tim Gorche, Association Plumbing, addressed the Council and
noted the city is presently negotiating in regard to his property.
Motion was made by Councilwoman Rowlison seconded by Coun-
cilman Morales and carried that approval be given to proceed with
the Leavesley Road widening Bid advertisement as recommended.
Councilwoman Rogers complimented Staff for meeting with all the
affected property owners in attempts to solve the issues.
An ordinance modifying the Traffic Impact Fee Ordinance was
noted and further explained by city Administrator Baksa and
community Development Director Allen.
Motion was made by councilwoman Rowlison seconded by
councilman Gilroy and unanimously carried that the ordinance be
read by title only and waived further reading of the ordinance.
Motion was made by councilman Gilroy seconded by Council-
woman Rowlison and carried that the ordinance modifying the
Traffic Impact Fee Ordinance be introduced and published by title
and summary as recommended.
The Mayor asked if there was anyone in the audience wishing
~o speak for or against any item not on the agenda. There was no
comment from anyone in the audience.
A request from victory Outreach regarding non-profit
organizations' car wash events was noted.
Discussion was had on the matter.

The Minutes of the Housing Element Implementation Task
Force, April 11, 1996 Meeting were noted.
council set a study session of May 13, 1996 at 7:00 p.m. to
discuss sound Wall Task Force and Agriculture Preserve Task Force
recommendations. council requested that the Planning commission
be invited.
Discussed Ride Alongs/Observation of police Actions.
Established no policy and left the matter up to council's
appropriate discretion.
The Mayor gave an update on the April 25, 1996 Peace summit
and thanked council attendees.

Councilwoman Rowlison gave an update on a Joint Ventures
silicon Valley mee~ing and cultural Planning committee Meeting
noting the Arts Council of Santa clara county steering committee
to oversee Culture Planning.
Councilman Morales recommended the Council meet with Bill
Lindsteadt, Economic Development Director for his plans and views.
councilman Valdez noted senior Day May 3rd and city Council
to sell newspaper for senior Fund raiser and also noted the
Hispanic chamber Ambassador's Ball that evening.
Councilwoman Rogers noted an Open House of the social
Services Building of the County for Gilroy Family Center.
councilwoman Rogers gave a report on attendance of a Gilroy
Unified school district election convention and complimented Jack
Dailey, staff and participants.
councilman Gilroy reported on a successful special 0 Track
Meet on Saturday.
Councilman Gilroy urged the Police Department's report of
goals to be expedited as needed by Council for addressing the
concerns brought up at the Council/Manager Retreat.
Councilman springer agreed with Councilman Gilroy regarding
the Police Department's goals and requested that the school
Board's consultant present enrollment projections to Council.
Councilman springer noted a Downtown summit Meeting/Town
Meeting on May 19, 1996 at the senior center, 1:30 to 4:30 p.m.
councilwoman Rogers reported on a Downtown Meeting to be co-
sponsored by GDDC, Chamber, AAUW and Hispanic Chamber on May 21,
1996.
The Mayor noted concerts in the Downtown Business area, one
concert to be sponsored by the Council.
Councilman springer requested that any hearings regarding
changes in service of the cal Train service be held in Gilroy for
South County residents. Councilman Valdez noted that he would
investigate same.
The Mayor noted the following meetings/events:
santa Clara county cities Association selection Committee
Meeting of May 9, 1996 - 7:00 p.m., sunnyvale city Hall to appoint
ABAG Executive Committee representatives; LAFCO representatives
and solid Waste commission representatives; and
Gilroy Planning commission Annual Retreat, June 1, 1996 -
9:00 a.m. to 4:00 p.m., IOOF Children's Home.
At 9:07 p.m. the Mayor adjourned to a closed Session re:
North v. city of Gilroy, Ninth Circuit Case No. 94-15283.
The Mayor reconvened the meeting noting no action taken at
the closed session and further adjourned the meeting.
