Pastor Lee Neish, Methodist Church, gave the Invocation. The City Clerk noted the Agenda had been posted on June 27, 1996 - 9:30 a.m. Present: Councilmembers: K. A. Mike Gilroy, Charles s. Z 96-05 The Mayor Protempore presented the Gilroy Police Reserves with the Volunteers of the Month Award for June 1996 . Motion was made by councilman Gilroy, seconded by councilman springer that the following item under the Consent calendar be approved, by the following Roll call Vote: Ayes: Councilmembers: K. A. The Mayor stated that it was the time and place scheduled for a Public Hearing to consider an appeal on the decision of the Planning commission to amend the zoning Map and prezone from Al (County Agriculture) to C3-PUD (Shopping Center commercial-planned Unit Development on approximately 5 acres located on the east side of San Ysidro Avenue, north of Leavesley Road, Z 96-05. The staff Report was noted and further explained by planner Durkin. The Mayor protempore asked if there was anyone in the audience wishing to speak for or against the proposal. city of saratoga P.& R.Com. P.& R.Com. 5-21-96 Handicap Bd. of App. Channel 34 6833 Ms. Gloria Ballard, representing MH Engineering and the applicant addressed the council noting her presence to answer questions. The Mayor Protempore asked if there was anyone further in the audience wishing to speak on the matter. There was no comment from anyone in the audience. The Mayor protempore closed the Public Hearing. Motion was made by councilman Gilroy seconded by councilman Morales and carried that staff be directed to prepare an ordinance approving Z 96-05. A letter from the city of saratoga requesting the city's support of a letter regarding power outages and electric utility service was noted. council took no action on the matter. A letter of resignation from parks & Recreation commissioner Greg castello was noted. council set July 19, 1996 for deadline to accept applications for the vacancy on the Parks & Recreation commission. Motion was made by councilman springer seconded by councilwoman Rowlison and carried that Gregory castello's resignation be accepted with regret. The following informational items were noted with no separate discussion on same: customer Service: Inter-Office Memo of Appreciation to officer Kim Merrill for Skillful Efforts in Recent police Incident; Letter of Recognition to local Scout for Eagle scout Achievement; League of california cities Legislative Bulletin #24 - 1996; and Minutes of the Economic Development corporation Board of Directors' June 20, 1996 Meeting. The Minutes of the Parks & Recreation commission Meeting of May 21, 1996 were noted. The Minutes of the Senior Advisory Board Meeting of May 20, 1996 were noted. The Minutes of the Arts & Culture commission Meeting of June 11, 1996 were noted. The Minutes of the Library commission Meeting of May 8, 1996 were noted. The Minutes of the Handicap Board of Appeals Meetings of June 13 and 20, 1996 were noted. councilman springer inquired about the possible problem of securing a quorum for this Board. Discussion was had on the matter. Mayor protempore Rogers suggested the secretary contact members as to their availability prior to scheduling a meeting. Discussion was had regarding channel 34 policy issue further explained by the Public Information coordinator McCann. Motion was made by councilwoman Rowlison seconded by councilman Gilroy and carried that the citizen request to show a videotape of a santa clara county Board of Supervisors' meeting be denied and that the public Information coordinator respond to said request. city Administrator protempore Dorn noted the planning commission and city council are invited to an informational 6834 Adjrnmt. meeting with shapell regarding their Tentative Map on August 21, 1996 at 10:30 to 1:30 p.m. at the Senior center, lunch provided. Councilman Gilroy noted he would not be present and Councilman springer suggested the meeting be videotaped for those councilmem- bers unable to attend and council indicated that they desired additional meetings with TV exposure to better inform the council and public regarding this issue. The city Attorney noted a request by the 1995-96 Santa Clara county Grand Jury for response from city council on its Final Report, "Review of the Implementation of the new Brown Act by Local Governmental Agencies." Discussion was had by council on the matter. council instructed the city Attorney to reply to the Grand Jury's recommendations and requested staff obtain written procedures of the four cities noted in the Grand Jury Report including hand-out presently being furnished to the public by the Santa clara valley Water District for Council review of these model agencies. councilman Morales urged a "safe" July 4th and welcomed his mother-in-law visiting from the state of Kentucky. councilman Gilroy noted an article in the Western cities Magazine re: economic development and urged council to review same. councilwoman Rogers gave an update on the Joint Powers Library Committee Meeting and their approval of the Budget and future expansion of the Gilroy Library.
