The Mayor led the Pledge of Allegiance to the Flag.
Pastor Mike Zubowski, South Valley Community Church, gave the
Invocation.
The City Clerk noted that the Agenda had been posted on
July 11, 1996 - 9:30 a.m.
Motion was made by Councilman Morales, seconded by Councilman
Springer that the following items under the Consent Calendar be approved,
removing items "C" SCRW A Budget and "D" CaliPers Medical Plan, by the
following Roll Call Vote: Ayes: Councilmembers: K. A. Mike Gilroy, Charles S.
Morales, Connie Rogers, Suellen C. Rowlison, Thomas W. Springer, Pete Valdez,
Jr. and Donald F. Gage:
Minutes ofthe Regular Council Meeting of June 24, 1996;
Approved Budget Amendments/Transfers as recommended;
Approved Tract Maps 8850 and 8851 - Longmeadow/Santa Teresa/
Arcadia Development Company as recommended; and
Approved Property Improvement Agreements 96-14, 15 and 16 - Old
Orchard Co. and Gilroy Associates as recommended.
Discussed and approved South County Regional Wastewater Authority
(SCRW A) Budget as recommended; and
Discussed and motion was made by Councilwoman Rowlison seconded by
Councilwoman Rogers that SCRWA Budget be approved and the reading of
Resolution No. 96-47 be waived and that it be adopted re: eligibility for part-time
employees to participate in the CaliPERS Medical Plan as recommended by the
following Roll Call Vote (Items C & D): Ayes: Councilmembers: Gilroy, Morales,
Rogers, Rowlison, Springer, Valdez and Gage.

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ELECTING
TO BE SUBJECT TO PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL
CARE ACT ONLY WITH RESPECT TO MEMBERS OF A SPECIFIC
EMPLOYEE ORGANIZATION AND FIXING THE EMPLOYER'S
CONTRIBUTION FOR EMPLOYEES AND THE EMPLOYER'S
CONTRIBUTION FOR ANNUITANTS AT DIFFERENT AMOUNTS.
PASSED AND ADOPTED this 15th day of July, 1996, by the following vote:
AYES: COUNCILMEMBERS: GILROY, MORALES, ROGERS,
ROWLISON, SPRINGER, VALDEZ and GAGE
NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: None
Noted an Ordinance rezoning from Al to C3-PUD on approximately 5
acres, Greg Mussallem, Applicant, Z 96-05. (Public Hearing held July 1, 1996)
Mayor Gage excused himself from this item because he was absent at the Public
Hearing.
Motion was made by Councilman Gilroy seconded by Councilman Springer
and unanimously voted to read the ordinance by title only and waived further
reading of the ordinance. (Mayor Gage absent.)
Motion was made by Councilman Gilroy seconded by Councilman Sprin~er

and carried that the ordinance be introduced approving rezoning of Z 96-05 to be
published by title and summary. (Mayor Gage absent.)
H. Cerda
Appeal
The Mayor stated it was the time and place scheduled for the appeal of
Hipolita Cerda on the decision ofthe Police Department denying a vendor license.
Neither Mr. Hipolita Cerda nor his representative was present. Acting City
Attorney Faber noted the reasons for the Police Department denial of the license
cannot be made unless Mr. Hipolita Cerda or his representative waives this ruling
and allows the reasons to be made public.
Motion was made by Councilwoman Rogers seconded by Councilman
Valdez and carried that the appeal of Mr. Hipolita Cerda regarding the decision of
the Police Department denying a vendor license be continued to July 22, 1996
because neither Mr. Cerda nor his representative were present to speak on the
matter.
The Mayor asked if there was anyone in the audience wishing to speak on
any matter not on the agenda. There was no comment from anyone in the
audience.
League Conf. Council designated Councilwoman Rowlison as Voting Delegate and
Councilwoman Rogers Alternate Delegate for the League of California Cities
Annual Conference in Anaheim, October 13-15, 1996.

Discussion was had regarding V 96-04 Nob Hill and CUP 96-04 Garlic
City Club and whether the ABC license was transferred from an existing card room

in the City. Acting City Attorney Faber noted he would investigate the matter.

Minutes of the Gilroy Economic Development Corporation Board of
Director's Meeting June 27, 1996;
Police Department's Employee ofthe Month of February, 1996, Roy Alba,
Community Services Officer;
Minutes of the Gilroy Visitors' Bureau Advisory Council Meeting of June
13, 1996 and Financial Transactions through May 31, 1996; and
Proclamations Issued by Mayor Gage: Childhood Lead Poisoning
Prevention Week - July 21-27,1996; Pollution Prevention Week - September 16-
22, 1996.
The Minutes of the South County Regional Wastewater Authority
Meetings of June 6th and 18, 1996 were noted.
City Administrator Baksa noted an Update on the Water Conservation
Program.
Council continued discussion on the proposed Impact Fees and
Comprehensive Fee Schedule.
City Administrator Baksa noted a report on Golf Course Fees further
explaining same. Council agreed with the proposed increase in green fees and
concurred with the recommendation to table increase in the membership fees to
review on a calendar year basis by a Task Force. Councilman Valdez suggested a
reduction of green fees for Seniors also be studied. Councilman Gilroy suggested
that competitive rates be reviewed. Councilwoman Rowlison suggested that an
Advisory Task Force Group be established to include Parks & Recreation
Commissioners.
Council agreed that a 2% increase in the Traffic Impact Fees be approved
and that the impact fees be reviewed contingent upon the General Plan Review and
as part ofthe review, do the Traffic Element. Councilwoman Rowlison suggested
that a Citizen Task Force Committee be selected at the same time other
Commission appointments are reviewed and selected.
City Administrator Baksa noted a report on Sewer Development Impact
Fees.
Councilman Springer inquired of fees proposed for roof and water heater
inspections. City Administrator noted he would have the BLES Staff explain the
proposed fees at the next regular Council meeting.
City Administrator Baksa noted the Shapell proposed Time Table for
development. Noted the August 21 and 22, 1996 informational meetings with
Shapell developers.
Councilman Gilroy gave a report on the City/School Liaison Co~t\~
Meeting. Items presented at the meeting will be distributed to Council and ,.,
agendized at a later meeting.
City Administrator Baksa noted City Staff and School Administrators have
been meeting to discuss their and our problems. This proposal is the frrst step and
next will be discussion of joint use of facilities.
Councilman Springer congratulated Captain Guisiana on his and the Police
Department's efforts.
Councilwoman Rowlison gave a report on the California Conservation

Corps and explained their program for youth in preparation of the employment
world and recommended the City participate in their program when requested.

Annual League of California Cities Conference - Anaheim - October 13-15,
1996.
Council agreed to review the Police Department Goals and Objectives prior
to the July 22, 1996 regular meeting (5:30 p.m. to 7:00 p.m.)
Council concurred with a scheduled tour of Las Animas Hydrological
issue; Tennis Courts, Uvas Project, etc. from 5:30 p.m. to 7:00 p.m. on August 5,
1996 regular Meeting date.
At 8:55 p.m. the Mayor adjourned to a Closed Session re: Conference with
City Attorney - Based on existing facts and circumstances, in closed session under
Government Code Section 54956.9(c) the City Council has decided to initiate or is
deciding whether to initiate litigation of a single matter.
The Mayor reconvened to Open Session; and further adjourned the
meeting.
