Martin re:Sewer Regular Meeting November 4, 1996 Gilroy, California The Mayor noted Council were in a continued Adjourned Closed Session pursuant to GC Section 54957 re: Performance Evaluation of the City Administrator and no action taken. The Mayor led the Pledge of Allegiance to the Flag. Pastor Robert Langley, First Baptist Church gave the Invocation. Present: Councilmembers: K. A. Mike Gilroy, Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Thomas W. Springer, Pete Valdez, Jr. and Donald F. Gage - 7:07 p.m. The City Clerk noted that the Agenda had been posted on October 31, 1996 - 10:40 a.ill. Bill Lindsteadt addressed the Council and gave an update on the Economic Development Corporation programs. The Mayor recommended that the claims of Roberta Schanding and Lindsey Crocker be removed from the Consent Calendar to discuss same in Closed Session. Motion was made by Councilman Springer, seconded by Councilman Morales that the following items under the Consent Calendar be approved removing claims of Roberta Schanding and Lindsey Crocker from Item B to discuss same in Closed Session by the following Roll Call Vote: Ayes: Counci1members: K. A. Mike Gilroy, Charles S. Morales, Connie Rogers, Suellen C. Rowlison, Thomas W. Springer, Pete Valdez, Jr. and Donald F. Gage: Approved Budget Amendments/Transfers as recommended; Denied Claims of Gloria Webster and Albert Nunes as recommended; and Accepted Improvements for Underground Diesel and Gasoline Fuel Tank Removal, Project 9-AS 428 as recommended. Library Commissioner, Leah Halper addressed the Council and gave a report and update of the Library Commission, noting goals and accomplishments and Commissioners Lai and Khandwala present in the audience. Noted Zoning Ordinance Text Amendment amending Sections 18.30 ComnWf~~al Use Table; 46.40 Density Exceptions; and 50.41 Architectural & site Apprpy~~, Z 96-06. (Public Hearing held 10-21-96.) City Administrator Baksa and Comm\Plity Development Director Allen answered questions of Council. Motion was made by Councilwoman Rowlison seconded by Councilman Moral~s l\rtdWlm,llmous1y carried that the ordinance be read by title only. The Clerk read the title of the proposed ordinance. Motion was made by Councilwoman Rowlison seconded by Councilwoman Ro gers and carried that the ordinance be introduced and published by title and sunnciry'approving the Zoning Ordinance Text Amendment, Z 96-06. A request of Jeff Martin for Sewer Connections for the Meadows Subdivision located at the southeast corner of Santa Teresa Boulevard was noted and further explained by Community Development Director Allen. Discussion was had by Council on the matter. LAFCO 6881 Motion was made by Councilman Morales seconded by Councilman Springer and carried that the request of Jeff Martin for Sewer Connections for the Meadows Subdivision be approved as presented. Councilwoman Rogers voted "no" on the motion. The Mayor asked if there was anyone in the audience wishing to speak on any item not on the agenda. Ms. Pamela Jones, Falcon Court, addressed the Council and noted concerns and questions regarding the Northwest Quad and Shapell Project. Ms. Kit Tucker, 9440 Eagleview Way, addressed the Council and noted that she and the residents concur with Pamela Jones' concerns about the density in Deer Park and Carriage Hills and requested an explanation of how the density was determined. The matter was referred to Staff to reply to Pamela Jones' concerns. The following informational items were noted with no separate discussion on same: Customer Service: Letter from Sandi Nelson in Appreciation of Gilroy Police Department for their Efforts to Clean-Up the South Monterey Road Area; Letter from Cass Peterson in Appreciation for the Actions of the Police Department; Bill Lindsteadt, Executive Director Economic Development Corporation, In Appreciation of Sandra Sammut for Assistance with Downtown Beautification Day; Letter from Elaine C. Long re: South County Housing "Center for Community Connection" and their proposal for Old City Hall; Letter from Susan Valenta, Executive Director of the Gilroy Chamber of Commerce in Appreciation for the Opportunity to have been a part of the Annual Fourth of July Fireworks' Program; Letter from Kimberly Kloessar regarding Gilroy's Proposed Recycling Program; State Board of Equalization's Third Quarter Sales Tax Digest reflecting Second Quarter Sales, Third Quarter Collections; Information from Pamela Jones; South County Housing Community Meeting, November 6, 1996, Gilroy Senior Center, Hanna Street; and San Jose Newspaper Article, October 31, 1996 re: Gilroy Police Department's Anti-Crime Team, (ACT). Acting City Attorney Faber explained the City Attorney's report on revisions to proposed LAFCO filing requirements. Councilwoman Rowlison noted the PeaceBuilders' Community Forum, Tuesday, November 19, 1996 from 7 :00 p.m. to 9 :00 p.m. at the Gilroy Unified School District Board Room, 7810 Arroyo Circle, Gilroy, CA. Councilman Valdez noted the Transportation Agency and Joint Powers Board were in Gilroy visiting today as a preview for their December 13, 1996 meeting. Councilman Valdez invited Council to the Veterans' Day Celebration at the 68S~~ Adjrnmt. Veteran's Building, 74 W. 6th Street noting Councilman Gilroy to be the guest speaker, November 11 th at 11 :00 a.m. Councilwoman Rogers noted that she and Councilwoman Rowlison participated with the Youth Development Task Force and gave an update on same. Councilman Gilroy noted a successful Trick or Treat Event on Halloween throughout the City. Councilman Springer concurred with Councilman Gilroy and suggested the City have Youth Center plans for Halloween in 1997 as it will be on a Friday night. At 8:47 p.m. the Mayor adjourned to a CLOSED SESSION: CONFERENCE WITH REAL PROPERTY NEGOTIATOR pursuant to Gov't. Code Section 54956.8. Property: Old City Hall, Sixth & Monterey Streets, Gilroy, CA. Negotiating Parties: Bickerson's Inc.; MCJM Inc. and South County Housing. Matter under negotiation: Lease and negotiations concerning price and terms of payment. The Mayor reported no action taken in Closed Session and reconvened the regular meeting. Councilman Valdez left the Council Chambers because ofa conflict of interest. Motion was made by Councilman Gilroy seconded by Councilman Morales and carried that Staffbe directed to negotiate with South County Housing for a Lease of the Old City Hall Property.
