He noted existing ADA problems that still need to Board of be completed at City Hall. He noted problems at the Museum and the parks. Appeals Report 7058 Bid- Traffic Sig. Community Development Director Allen answered questions from the Council Interconnect regarding the bid for the Traffic Signal Interconnect Project (97-CDD-471) Project Monterey Street - Third Street to Tenth Street and Tenth Street - Church Street to Chestnut Street. Motion was made by Councilman Morales, seconded by Councilman Springer, and carried that the bid by Steiny arid Company, Inc. in the amount of $156,700 be awarded for the Traffic Signal Interconnect Project (97-CDD-471) Monterey Street- Third Street to Tenth Street and Tenth Street - Church Street to Chestnut Street. Bid-Performing The Staff Report was noted and further explained by City Administrator Baksa Arts Center and Community Development Director Allen on the Performing Arts Center. Motion was made by Councilwoman Rowlison, seconded by Councilman Valdez, and carried that the City will proceed on the analysis of the Strand Theater as a Performing Arts Center and the bid by AMS Planning & Research in the amount of $30,000 be awarded for the Consulting Services to Prepare Needs Analysis, Conceptual Plan, Structural Analysis, Revenue Projections and an Operational Cost Analysis for a Performing Arts Centef. Councilman Valdez requested a tour for the Councilmembers of the Strand Theater. Pub. Hearing Mayor Protempore Rogers stated it was the time and place scheduled for a Public Mod. to Villa Hearing on the 1997/1998 FY Community Development Block Grant Modification to Esperanza Villa Esperanza Project Proposal. The Staff report was noted and further explained by City Administrator Baksa. Mayor Protempore Rogers asked if there was anyone in the audience wishing to speak for or against the proposal. There was no comment from anyone in the audience. Mayor Protempore Rogers closed the Public Hearing. Motion was made by Councilman Morales, seconded by Councilman Valdez, and carried to approve the modification to the Villa Esperanza project. TOT-RV Parks The Staff Report was noted and further explained by City Administrator Baksa and City Attorney Callon regarding an Ordinance Amending Chapter 25A of the Gilroy City Code to Include Recreational Vehicle Parks Among the Businesses that are Required to Collect and Remit the City's Transient Occupancy Tax and to Impose Successor's Liability for the City's transient Occupancy Tax. Motion was made by Councilman Springer, seconded by Councilman Morales, and carried that the ordinance be introduced and published by title and summary approving the Amendment to the Transient Occupancy Tax for Recreational Vehicle Parks. Peddlers Ord. The Staff Report was noted and further eXplained by City Administrator Baksa and Administrative Services Director Dorn regarding an Ordinance Repealing in its Entirety Chapter 16A of the Code of the City of Gilroy and Replacing it with a New Chapter 16A Entitled Peddlers, Solicitors, Vendors and Other Transient Businesses. Al Pinheiro, representing the Chamber of Commerce Government Review Committee, noted areas of the ordinance that still need more work regarding use in commercial areas, Christmas tree lots, and the need for identity permits. Bill Lindsteadt, 8174 Kelton Drive, Economic Development Corporation Director, spoke regarding concerns with the ordinance. By a vote of 4-2 (Councilmembers Rowlison and Springer voting no) Council agreed to prohibit push carts vendors in all commercial zones. It was agreed that the issue will be brought back to Council in two weeks. 7' ('Ii,l:': q \.., ,.! ' San Ysidro Park The Staff Report was noted and further explained by City Administrator Baksa and Public Safety Facilities and Parks development Manager Headley regarding approval of San Y sidro Improvements Park Public Safety Improvements. Motion was made by Councilman Morales, seconded by Councilman Valdez, and carried to approve the Proposed San Y sidro Park Public Safety Improvements. Mayor Protempore Rogers called for a short break at 8:55 p.m., after which she recalled the meeting to order. Crosswalk-Kern The Staff Report was noted and further explained by Community Development Avenue and Director Allen regarding the request for a crosswalk at the intersection of Kern Greystone Ct. Avenue and Greystone Court. Ellen deSilva, 830 Greystone Court, explained her request. Domeni Koloporto, Kern Avenue, stated a sign "Keep Clear" could be placed near Greystone Court. Motion was made by Councilman Springer, seconded by Councilwoman Rowlison and carried to install a three-way stop sign at Kern Avenue and Culp Drive, with a school approved crosswalk (Councilwoman Rogers voting no). It was suggested that this topic be reviewed with the Gilroy Unified School District at the next retreat. Summerhill- South Co. Housing The Staff Report was noted and further explained by Planner II Durkin, who noted the approved request and the proposed changes for a request for a revision to South County Housing's RDO exemption for the Summerhill Project, east of Santa Teresa Boulevard, adjacent to the future Longmeadow Drive extension. Holly Wonder, South County Housing, explained the project. Motion was made by Councilman Gilroy, seconded by Councilman Morales and carried to approved the request (Councilman Springer voting no). Mayor Protempore Rogers asked if there was anyone in the audience wishing to speak on any matter not on the agenda. There was no comment from anyone in the audience. The report of the Parks & Recreation Commission meeting of September 16, 1997 was noted. City Administrator Baksa discussed the preliminary State Block Grant funding for Police. Council agreed to put the money into one or two police officers, which would allow ACT to operate seven days a week. council agreed to a workshop to review the Police Department Facility Master Plan on December 10, 1997. Mr. Baksa noted a tour of the new gold course area for LAFCO on November 18, 1997 at 10:15 a.m. Council set November 19 at 7:00 p.m. (or 6:00 p.m. depending on the Gilroy Unified School District retreat) regarding CDBG priorities. Council agreed to a Gilroy "\ Unified School District retreat on November 18 or November 19, 1997. Mr. Baksa distributed notes from the reduced lot size meeting, which will become the work plan for small lots. He distributed a press release on crime statistics. He distributed the residential development staff report for Glen Lorna for Council to review. He noted there was a meeting on grant writing last Friday, that staff will hear from others, and will end up with a contract with one vendor. He requested Council contact the City Clerk regarding reservations for the OMI dinner at the League conference, and also to carpool if anyone is interested. In response to a question, Councilmembers Valdez, Morales, and Rowlison stated that they would like a tour of the Strand Theater. Mayor Protempore Rogers stated that there will be a Joint Ventures Silicon Valley Roundtable on Friday, October 17 in Sunnyvale from 8:00 to 9:30 a.m., but no Councilmember stated that they would be able to go. She requested the new traffic engineer evaluate the intersection at orchard and Tenth Street for safety. She announced that last Friday, MACSA opened their new program at San Ysidro Park. She mentioned a successful Art Shoe at the Strand Theater last weekend, and also the Super Heroes Parade and Faire on Saturday. She stated that she had enjoyed being the temporary mayor, and announced that Councilman Valdez will become the mayor protempore tomorrow. Councilman Valdez stated that Congresswoman Lofgren donated two computers to MAC SA. Councilwoman Rowlison thanked the City Clerk for the new binders for the Council packets, and distributed binder clips to the other Councilmembers for their use to take home papers from the packets. She noted that the Disabled Students Program is now in the Library and not in temporary trailers. She announced openings on County committees. Councilman Morales congratulated Councilman Gilroy on his election as president of the Legion of Valor recipients. Councilman Valdez noted that because of his election, Councilman Gilroy will have breakfast with President Clinton. He commended Mayor Protempore Rogers for the efficiency of her meetings. He asked about a letter from Mr. Cuomo, and Councilman Gilroy stated that he will get a copy of it for Councilman Valdez. Councilman Gilroy stated there is a City-wide Christmas event planning meeting tomorrow at 5 :30 p.m. He stated that the Chamber is also looking at a Memorial Day parade, and a meeting for this will be on Wednesday at 5:30 p.m. Councilman Springer requested that the County boards and commissions openings be advertised on Channel 34. He asked about Falcon negotiations and City Administrator Baksa reviewed the progress.
