Minutes 1998/01/26 Posting Agenda Roll Call New Emp. Vol. Award 7 1 f'"' , ~-j Regular Meeting January 26, 1998 Gilroy, California The Mayor led the Pledge of Allegiance to the Flag. The City Clerk noted that the Agenda had been posted on January 22, 1998 at 11: 17 a.m. Present: Councilmembers: Guadalupe Arellano, Lisabeth A. Gifford, Charles S. Morales, Suellen C. Rowlison, Thomas W. Springer, Anthony C. Sudol III, and K. A. Mike Gilroy - 7:01 p.m. The Mayor introduced new employee David Vogel, Maintenance I - Street Division, Community Services Department. The Mayor presented the Volunteer of the Month of January, 1998 Award to Wal-Mart Volunteer Sales Associates including Samie Weaver, Gary Herrera, Beth, David Diaz, Sonia Delgado, Theresa Gutierrez, Randy Reiling, Rachel Villalobos, Becky Cortez, Manuel Muro, Rachel, Gracie Torres, Ermalinda Garza and manager, Al Slavin. Proc.-American The Mayor noted a proclamation for American History Month - February, History 1998, and Maureen McManus accepted the proclamation, with the help of Month Sean McManus and Gregory Stevens, who were dressed in period costume. Consent Calendar Def.Comp. Adv. Com. Budget Motion was made by Councilman Springer, seconded by Councilman Morales and carried that the following items under the Consent Calendar be approved, by the following Roll Call Vote: Ayes: Councilmembers: Guadalupe Arellano, Lisabeth A. Gifford, Charles S. Morales, Suellen C. Rowlison, Thomas W. Springer, Anthony C. Sudol III, and K. A. Mike Gilroy: Appointment to Deferred Compensation Advisory Committee; and Budget Amendments/Transfers as recommended. Com. Servo Community Services Director Connelly reviewed planned projects for the Report coming year including Thomas Road Sports Park Master Plan, skateboard park master plan, renovation of San Ysidro Park, Willey House landscaping, and begin the foundation for the youth advisory board. John Garcia reviewed the youth recreation scholarship fund program. Janet Wohlgemuth, crew supervisor, reviewed the work of the California Conservation Corps. Scot Lang, Operations Services Supervisor, thanked the representatives of the California Conservation Corps for their work in Gilroy. He reviewed the work being done to development park standards. He explained the process of peer review for the various facilities. AB 48l1SB 718 The Mayor noted a letter from Assemblymember Mike Honda urging support 'of AB 481, which would enact the Comprehensive Childhood Lead Poison Prevention Act of 1997 and its companion bill in the Senate, SB 718. Motion was made by Councilmember Arellano, seconded by Councilman Morales and carried to send a letter of support of AB 481 and SB 718. 71 / t') Meeting Deletion The Mayor noted an Ordinance of the City of Gilroy amending Section 2.13 (a) of the Gilroy City Code regarding regular meetings of the City Council. Motion was made by Councilman Morales, seconded by Councilman Sudol and carried to read the Ordinance by title only and waive further reading of the Ordinance. Motion was made by Council member Arellano, seconded by Councilman Morales and carried (Councilman Springer voting no) to introduce the Ordinance approving the amendment to Section 2.13 (a) of the Gilroy City Code. Z 97-06 The Mayor noted an Ordinance of the City Council of the City of Gilroy pre- zoning certain property Ml (Limited Industrial) described as APNs 835-04-047, 048,049,050, application Z 97-06. Joao Tang, applicant. Motion was made by Councilman Springer, seconded by Councilman Sudol and carried to read the Ordinance by title only and waive further reading of the Ordinance. Motion was made by Councilman Sudol, seconded by Councilman Springer and carried to introduce the Ordinance approving the prezoning. Golf Course The Mayor noted possible discussion ofreconsideration by LAFCO of inclusion of the proposed City Golf Course within the Urban Service Area boundary. City Attorney Callon gave a report regarding discussions with the landowners. Bill Gates, attorney for the property owner, noted there are various possibilities for compromise, but nothing satisfactory can be seen to be worked out at this time. Council discussed leaving the item on the LAFCO agenda and informing them we are willing to do an Urban Growth Boundary and they might table their action. Motion was made by Councilmember Arellano, seconded by Councilman Sudol and carried to withdraw the matter from the LAFCO agenda. RD 92-29 The Mayor noted a request to amend the RDO Performance Agreement for RD 92-29, Country Estates. City Administrator Baksa gave an overview, and the staff report was noted and further explained by Planning Services Manager Faus. City Attorney Callon explained that the City Council must find that the lack of performance is due solely to circumstances beyond the control of the applicant. Bill Gates, attorney for the applicant, reviewed issues relating to this project in relation to the proposed new golf course vs. expansion of the current golf course, which has created a delay. He noted that the applicant agrees with the staff recommendation. Motion was made by Councilmember Arellano, seconded by Councilman Morales and carried to shift the 1995 allocation of 27 units to 1998. The Mayor asked ifthere was anyone in the audience wishing to speak on any item not on the agenda. There was no comment from anyone in the audience. Greg Toscano The Mayor noted a letter from Greg Toscano requesting discussion of the Community Services Department Youth Basketball Program, and specifically selection procedure for coaches. Mr. Toscano was not present to explain his request to the City Council. 7 1 '7 I Motion was made by Councilman Springer, seconded by Councilman Sudol and carried to take no action. ADA Funding The Mayor noted a request from the City of Gilroy Physically Challenged Appeals Board for a change in funding allocation for ADA improvements. Motion was made by Councilmember Arellano, seconded by Councilman Sudol and carried to consider this at Capital Improvement Budget (CIB) time. Marilyn Manning Consensus of the Council was to have the Mayor write a letter of appreciation and recommendation to Marilyn Manning regarding the Council retreat. The report of the General Plan Update Committee Meeting of December 17, .1997 was noted. Customer Service: Letter from Bruce Sweeney commending the coaches of the Winter Pony Baseball League; Letter of thanks from Marilyn Manning, Ph.D. for the opportunity to work with the Council at their retreat; and Letter of thanks from Neland Doughty for assistance from the Fire Department. Informational items: Letter from the Board of Supervisors, County of Santa Clara, announcing Supervisor Blanca Alvarado, Chairperson for 1998 and S. Joseph Simitian, Chairperson Pro Tempore for 1998; Letter from Assemblymember Frusetta recognizing Councilwoman Rowlison for her outstanding example and unselfish deeds; League of California Cities Legislative Bulletin #2-1998 dated January 16, 1998; and City of Gilroy Investment Report, December 1997. The minutes of the Planning Commission meeting of December 4, 1997 were noted. The minutes of the Parks & Recreation Commission meeting of December 16, 1997 were noted. The minutes of the Arts and Culture Commission meeting of December 9, 1997 were noted. The revised minutes of the Library Commission meeting of November 12, 1997 were noted. The minutes of the Library Commission meeting of December 10, 1997 were noted. City Administrator Baksa answered questions regarding the Police Chief recruitment, distributed a profile, and requested the Councilmembers return the completed profile to him by Friday. The Mayor requested the Acting Police Chief make decisions, take actions, and make changes as needed, and the Council will support him in his decisions. 7 1 1 8 ARTRAIN Adjrnmt. Consensus of the Council was to set March II, 1998 as the quarterly City Council/Gilroy Unified School Board workshop. Consensus of the Council was to set February 20, 1998 as the City Council! Police Department Retreat. City Administrator Baksa distributed the Fourth Quarter 1998 reports. The Mayor noted the 90 day City Council calendar, a list of upcoming meetings. He distributed information on the skateboard facility. He discussed neighborhood meetings, and appointed a subcommittee of himself with Councilmembers Arellano and Morales to develop a process for the meetings. He noted that he will be attending "Scotland the Brave" in San Jose on Wednesday even mg. Councilmember Arellano stated that on Wednesday, the AAUW will host a sister to sister conference working with girls at the New Renaissance Center. She noted a certificate for Councilwoman Rowlison that is in the packet from Assemblymember Frusetta. The Mayor noted a request for City Council support for the ARTRAIN, April 7-9, 1998. Motion was made by Councilmember Arellano, seconded by Councilman Sudol and carried to co-sponsor the event to allow for insurance coverage, but not sign the agreement. Councilwoman Rowlison thanked Councilman Springer for writing a letter in support of funding the arts. She requested that, in the future, if someone wants a letter of support, they submit a draft of the letter for the packet. Consensus of the Council was that this be a policy.
