The Mayor led the Pledge of Allegiance to the Flag.
Deaconate Michael Carson, St. Mary's Catholic Church, gave the
Invocation.
The City Clerk noted that the Agenda had been posted on January 29,
1998 at 9:40 a.m.
Present: Councilmembers: Guadalupe Arellano, Lisabeth A. Gifford, Charles
S. Morales, Suellen C. Rowlison, Thomas W. Springer, Anthony C. Sudol III, and
K. A. Mike Gilroy - 7:00 p.m.
Motion was made by Councilman Springer, seconded by Councilwoman
Arellano and carried that the following items under the Consent Calendar be
approved, by the following Roll Call Vote: Ayes: Councilmembers: Guadalupe

Budget Amendments/Transfers as recommended;
Minutes of the Regular Council Meetings of January 20 and 26, 1998.
Adopted Resolution No. 98-9 of the City Council of the City of Gilroy
adopting the CalTrans Office of Local Programs pre-approved DBE Program and
authorizing the City Administrator to designate a DBE Liaison Officer;
RESOLUTION NO. 98-9
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
ADOPTING THE CAL TRANS OFFICE OF LOCAL PROGRAMS PRE-
APPROVED DBE PROGRAM AND AUTHORIZING THE CITY
ADMINISTRATOR TO DESIGNATE A DBE LIAISON OFFICER.
PASSED AND ADOPTED this 2nd day of February, 1998, by the following vote:

Pers. Com. Rosalinda Lopez, new Chairperson of the Personnel Commission, noted that
Report Chris Ordaz is the new Vice-Chairperson and that Debi Murray is a new member.
She noted on-going activities that the Commission is working on, including
upcoming training on the Brown Act, a report by the City Administrator on the
reorganization, and an upcoming retreat. She noted that the Personnel Commission is
not involved in the hiring process for the Police Chief.

Generator
City Administrator Baksa presented recommendations to award the bid of
Bayside Equipment Company in the amount of $49,034.50 for the Diesel Electric
Generator, Project No. 97-ASD-486.
Motion was made by Councilwoman Rowlison, seconded by Councilman
Morales and carried that the bid by Bayside Equipment Company in the amount
of$49,034.50 be awarded for the Diesel Electric Generator, Project No. 97-ASD-
486.

The Mayor noted a discussion regarding possible removal from the Parks and
Recreation Commission of Commissioner Joe Lee Rayborne.
Joe Lee Rayborne read a letter regarding his request to be removed from the
Parks and Recreation Commission, noting he does not have the time to continue
to serve at this time.
Motion was made by Councilman Morales, seconded by Councilmember
Arellano and carried to accept, with regrets, Joe Lee Rayborne's resignation from
the Parks and Recreation Commission.
The Mayor asked if there was anyone in the audience wishing to speak on any
matter not on the agenda. There was no comment from anyone in the audience.
The following informational items were noted with no separate discussion on
same:
General Plan Update:
Report of the General Plan Update Committee Meeting of January 21, 1998.
Council discussed the format of the report, and that the wording should reflect
the Committee's recommendations for the Council to act on.
Leonard Pugh, Chairperson of the General Plan Update Committee (GPUC),
reviewed the recommendation of the GPUc. He requested the Council provide to
the Committee, in writing, the Council's current procedure that they wish the
GPUC to follow for appointments to the Committee.
It was requested that the recommendation to approve alternates to fill Citizen-
at-Large positions on the General Plan Update Committee be agendized for the
next meeting.
(At 7:40 p.m., Councilman Morales left the Council Chambers, and returned
and took his seat at 7:42 p.m.)
Customer Service:
Letter from Marie Fernando expressing her appreciation for the opportunity to
work for the City of Gilroy;
Letter from Assemblymember Frusetta extending his congratulations to Randy
Newell on being named Employee ofthe Month for November, ] 997; and
Letter from Kathleen Franger, United Way of Santa Clara County, thanking
the City of Gilroy for their support of the 1997-98 United Way campaign.
Informational items:
Letter to Governor Wilson from the City of Gilroy in support of increased
funding for the Arts in California;
League of California Cities Legislative Bulletin #3-1998 dated January 23,
1998;
Letter of invitation from Assemblymember Frusetta to a town hall meeting 011
February 19, 1998 from 7:00 p.m. to 9:00 p.m. at the Monterey County Board of
Supervisors on the 1998-99 State Budget; and
Letter to Falcon Cable TV from Gilroy City Attorney's Office regarding
Falcon's investigation for "Black Boxes."
City Administrator Baksa distributed Marilyn Manning's report from the
retreat.

City Attorney Callon distributed a summary of the amendments made to the
Brown Act.
The Mayor noted the 90 day City Council calendar, a list of upcoming
meetings. He noted that the February 12, 1998 study has been cancelled.
The Mayor noted a discussion by the Council to interview applicants for the
Parks and Recreation Commission. Council set February 17, 1998 at 6:00 p.m. in
the Council Chambers to interview applicants for the Parks and Recreation
Commission.
The Mayor noted St. Joseph's Center St. Patrick's Day dinner on March 21,
1998 at 7:00 p.m. at St. Mary's Hall, and requested Councilmembers to help serve.
Councilwoman Rowlison noted a letter to the City Administrator from Marie
Fernando. She commented that the City of Gilroy employees raised $3,781 for
United Way. She invited citizens and Councilmembers to a meeting sponsored by
the Santa Clara County Cities Association on Thursday at 7:30 p.m. at the
Sunnyvale City Hall regarding "Why People Don't Trust Government."
Councilman Morales noted that he had represented the Mayor and Mayor
Protempore at the Police Department Overview Study Session, and that it had
been a good report. He stated that Victory Outreach is looking for citizens to hire
their workers.
Councilmember Gifford announced that she will be the representative and
Councilwoman Rowlison the alternate for the Domestic Violence Task Force,
which reverses the names on the Council minutes of January 20, 1998.
Councilman Springer noted item two on page two and item three on page
three in the League of California Cities Legislative Bulletin, requesting the City
write a letter in opposition to AS 270 and supporting AB 726, and the Council
concurred.
