The City Clerk noted that the Agenda had been posted on April 23, 1998 at 3 :00 p.m. Present: Councilmembers: Guadalupe Arellano, Lisabeth A. Gifford, Charles S. Morales, Suellen e. Rowlison, Thomas W. Springer, and K. A. Mike Gilroy; Absent: Councilmember Anthony C. Sudol III - 7:00 p.m. The Mayor commented that Councilman Sudol has the chicken pox. Judy Mireles-Janisch and three Special Olympians invited everyone to the Special Olympics on May 2, 1998 at Gilroy High School from 9:00 a.m. to noon, and presented T-shirts to the Mayor and Councilmembers. The Mayor presented the Volunteer of the Month of April, 1998 Award to Richard Pogue. Adopted Resolution No. 98-21 affirming the decision of the Physically Challenged Board of Appeals requiring accessibility in the 16 unit motel in the Gilroy Roadway Plaza project, pursuant to State law and the Uniform Building Code and denying the appeal of Howard Vierra in regard thereto; RESOLUTION NO. 98-21 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AFFIRMING THE DECISION OF THE PHYSICALLY CHALLENGED BOARD OF APPEALS REQUIRING ACCESSIBILITY IN THE 16 UNIT MOTEL IN THE GILROY ROADWAY PLAZA PROJECT, PURSUANT TO STATE LAW AND THE UNIFORM BUILDING CODE AND DENYING THE APPEAL OF HOWARD VIERRA IN REGARD THERETO. Fire Chief Gillespie reviewed statistics from the Fire Department, including Emergency Medical Services, Emergency Medical Care, and reflex time. AI Nunes spoke regarding the AMR paramedic servicc. The Mayor stated it was the time and place scheduled for a continued Public Hearing on an Affordable Housing Exemption request pursuant to Zoning Ordinance Section 50.62(b)(3) for the purpose of constructing 74 residential units and one on-site manager unit intended for seniors age 55 and above, on property located on the east side of Wren A venue, south of First Street, zoned PO-PUD (Professional Office-Planned Unit Development). American Housing Partners, applicant, M 98-04/ AHE 98-0 I. The staff report was noted and further explained by Planner II Durkin. The Mayor opened the Public Hearing. Paul Filice spoke in favor of the request, and answered questions posed by Councilmembers. (At 8: 12 p.m. Councilman Morales left the Council Chambers, and returned at 8: 14 p.m.) City Attorney Call on noted concerns with the age restrictions. The Mayor closed the Public Hearing. Motion was made by Council member Arellano, seconded by Councilman Morales and carried (Councilman Sudol absent) to direct stafTto prepare a resolution approving the request. The Mayor stated it was the time and place scheduled for a Public Hearing to establish Numerical Limits of Dwelling Units to be Permitted under the requirements of the City of Gilroy's Residential Development Ordinance for the years 1999 through 2003. The staff report was noted and further explained by Planning Services Manager Faus, who answered questions posed by Councilmembers. 716() The Mayor opened the Public Hearing. The Mayor closed the Public Hearing. Motion was made by Councilwoman Rowlison, seconded by Councilman Morales and carried (Councilman Sudol absent) to direct stalfto prepare a resolution establishing Numerical Limits for the years 1999 through 2003, and not hold a competition for 1998. Growth Mgt. The Council discussed appointing a citizen task force to revicw the growth numbers for next year's allocation. Motion was made by Councilman Springer, seconded by Councilmember Gifford and carried (Councilman Sudol absent) to direct staff to prepare a recommendation for the May 18, 1998 Council meeting regarding public input into the five year allocation process. Civic Center Master Plan The Mayor noted a recommendation to approve the Conceptual Master Plan of the Civic Center. The staffreport was noted and further explaincd by Community Development Director Allen. Motion was made by Councilman Morales, seconded by Councilman Springer and carried (Councilman Sudol absent) approving the Conceptual Master Plan of the Civic Center. The Mayor asked if there was anyone in the audience wishing to speak on any item not on the agenda. Rojean Wilson introduced herself: and thanked the Mayor and Council for appointing her to the Santa Clara County Council on Aging Advisory CounciL The following informational items were noted with no separate discussion on same: Legislation: League of California Cities Legislative Bulletin # 14-1998 dated April 17, 1998; and , Memorandum from Captain Lanny Brown regarding Council support of AB 1938 - Alcoholic Beverages License Fees. Customer Service: Memorandums from the Acting Chief of Police to Sergeant Al Morales, Detective Stan Devlin, Officer Ron Latham, and Officer Joe Harrold acknowledging the appreciation for the contribution by "Kathy & The Bad Boyz" at a recent fund raiser and rally; Memorandum from the Acting Chief of Police to Sergeant Morales regarding a citizen's appreciation for Sergeant Morales participating in the Padres con Poder theatrical presentation presented by the Odd Fellow-Rebekah Children's Home; Letter from The Angels' Art League in apprcciation for City staff support during the visit by the Artrain; Lettcr from Bob Cooke, Commander-UNET, to thc Acting Chief of Police in appreciation for the use of three (3) lap top computers and carrying cases, to be used by UNET; 7167 Letter of thanks from Donald W. Rich for the Gilroy Police Department dispatcher and officers who assistcd in patrolling the Greyhound Bus Depot while his sixteen year old son was waiting outside the closed terminal for the next bus; and Letter of thanks from Maria Tamez to Suellen Rowlison for her attendance at the Padres con Poder theatrical presentation. Informational items: Santa Clara Valley Transportation Authority letter announcing a series of transportation planning workshops and public meetings regarding expansion of public transit services in the City of Gilroy; and City of Gilroy Investment Report, March 1998. Pers.Com. The minutes of the Personnel Commission meeting of March 9, 1998 were noted. P&R Com. The minutes of the Parks & Recreation Commission meeting of March 17, 1998 were noted. A&C Com. The minutes of the Arts and Culture Commission meeting of March 17, 1998 were noted. Lib. Com. The minutes of the Library Commission meeting of March II, 1998 were noted. Sr. Adv. Bd. The minutes of the Senior Advisory Board meeting of March 16, 1998 were noted. City Administrator Saksa noted a report by the Planning Division on the regulations of wall murals. He stated that he had met with representatives of MACSA on the cooperative agreement with MACSA on a job training program. He explained that an arrangement with MACSA can be done with little expense on the City of Gilroy's part. He distributed copies of a letter from South Valley Disposal and Recycling, explaining that they would like to go to a quarterly billing cycle. He stated that staff will be giving their opinion on this request, and if any Councilmember has any input to let him know. He distributed the 1998 First Quarter Reports. He commented that there is a facility available for sale as a possible cultural facility (South Valley Community Church) and questioned whether the Council would like staff to look at thc possibility of pur -chasing the building for a cultural facility. Council consensus was to have staff look at the building and also bring back a cost analysis. He stated that the two June neighborhood meeting dates have been confirmed, and staff will get information out regarding these meetings. He stated that Dennis Lalor, South County Housing, would like to brief the Council and Planning Commission on the results of his community meetings regarding the Los Arroyos project. Council agreed to meet at the New Renaissance Center on May 21, 1998 from 6:30-7:30 p.m. if this is convenient for Mr. Lalor. The Mayor noted the 90 day City Council calendar, a list of upcoming meetings. He noted that WalkAmerica will be at Las Animas Park on Saturday, May 2, 1998 starting at 9:00 a.m. He again noted the 20th Annual Special Olympics Track and Field meet at Gilroy High School on Saturday, May 2, 1998 from 9:00 a.m. to noon. Councilwoman Rowlison noted that the local California Conservation Corps (CCC) is up to 10 members. She stated that on Saturday she is attending a CCC orientation for two new members. She stated that she attended a budget subcommittee meeting in Sacramento on resources to repay subvention monies. She noted and distributed ESO information on opportunities such as SPEDY. She noted upcoming water rate hearings. 7168 Adjrnmt. Councilman Morales noted that the 20th anniversary of the Garlic Festival is approaching, and requested a proposal be agendized regarding naming streets for our sister cities. He noted several letters regarding police officers in the customer service area in the agenda. Councilmember Arellano reminded everyone to attend the "Smoothies & Music" event at the New Renaissance Center on May I, 1998 from 3:00 p.m. to 6:00 p.m. to accentuate the positive happenings at the Center. She gave a report regarding recommendations of the JPA Internet Task Force, noting that a decision was made to place a filter on one of the computers on the children's side. She stated that it will take about three months to review filters to decide which one to use. She noted that at their meeting on June 4, 1998, the JP A will look at a suggestion to advertise that it is a filtered system. Councilman Springer reminded everyone of the neighborhood cleanups scheduled on May 2, 1998, including Eigleberry Street, between Ninth and Tenth Streets, and Stoney/Maple Court. He stated that he attended the Parks & Recreation Commission meeting on the skateboard park, noting that the Commission questioned what parameters the Council is looking for in the park, such as entry level park or competition park, fenced, and easily enforced. The Council consensus was that the skateboard park is for recreation and to get the kids otTthe street, with the cost to be under $200,000. The Mayor noted the following meetings/events, including a South County Regional Wastewater Authority meeting tomorrow morning at 7:30 at the wastewater treatment plant: City Council Study Session - Neighborhood Revitalization Strategy, April 30, 1998, 6:00 p.m., Gilroy City Council Chambers, 7351 Rosanna Street, Gilroy, California.
