Associate Pastor Fred Eden, South Valley Community Church, gave the Invocation. The City Clerk noted that the Agenda had been posted on April 30, 1998 at 10:30 a.m., and the Addendum to the Agenda had been posted on May I, 1998 at 12:45 p.m. Present: Councilmembers: Guadalupe Arellano, Lisabeth A. A ward The Mayor presented the Employee A ward for the Month of March, 1998, to Teri Patane, Chemical Control Specialist, Community Development Department, Building, Life, and Environmental Safety Division. Proc.-Harold F. The Mayor noted a proclamation for Captain Harold F. Lawrence Day, April Lawrence 23, 1998, which was previously presented to Captain Lawrence. Day Proc.-NF Day Consent Calendar Budget Minutes Prop.Agree. 98-12;Tract Map 8963, Eagle Ridge The Mayor noted a proclamation for Neurofibromatosis (NF) Day, May 2, 1998, which was previously presented to the National Neurofibromatosis Foundation. Motion was made by Councilwoman Rowlison, seconded by Councilman Springer and carried that the following items under the Consent Calendar be approved by the following Roll Call Vote: Ayes: Councilmembers: Guadalupe Arellano, Lisabeth A. Gifford, Charles S. Morales, Suellen C. Rowlison, Thomas W. Springer, and K. A. Mike Gilroy; Absent: Councilmember Anthony C. Sudol III: Budget Amendments/Transfers as recommended; Minutes of the Regular Council Meetings of April 20 & 27, 1998; and Property Improvement Agreement No. 98-12, and Tract Map for Tract 8963, Eagle Ridge, Portion of APN 810-24-005, Eagle Ridge Development Company, LLC. Lib.Com.Report Victor Valdez, Jr., Library Commission Vice-Chairperson, reviewed the statistics regarding attendance at the library and the number of questions posed to the staff. He noted an increase in the number of patrons, especially Spanish speaking patrons. He stated that the Commissioners are planning to visit Redwood City and Tiburon libraries in preparation for review for the library expansIOn. Bid-Museum City Administrator Baksa presented recommendations to award the bid of Paint/Repair Aspen Specialties in the amount of $34,800.00 for the Gilroy Museum Painting and Repair Project #97-ASD-492. AB 1986 In answer to a question, Fleet & Facilities Manager White noted there is a color scheme which has been approved, that it is prescribed in the bid, but it can be revised. Councilmember Arellano requested that the Historic Heritage Committee review the colors prior to painting. Motion was made by Councilmember Arellano, seconded by Councilwoman Rowlison and carried (Councilman Sudol absent) that the bid by Aspen Specialities in the amount of $34,800.00 be awarded for the Gilroy Museum Painting and Repair Project #97-ASD-492, subject to the review by the Historic Heritage Committee of the paint colors. The Mayor asked if there was anyone in the audience wishing to speak on any matter not on the agenda. There was no comment from anyone in the audience. The Mayor noted a request for Council to take a position in opposition to and for AB 1986 (Pajaro River Watershed Flood Prevention Authority) to be withdrawn. Motion was made by Councilmember Arellano, seconded by Councilmember Gifford and carried (Councilman Sudol absent) to send a letter in opposition to AB 1986, with a copy to be forwarded to the Santa Clara Valley Water District. 71/'0 AB 2354 AB 2488 The Mayor noted a request for Council to take a position in opposition to AB 2354 (Development Fees). Motion was made by Councilmember Arellano, seconded by Councilmember Gifford and carried (Councilman Sudol absent) to send a letter in opposition to AB 2354. The Mayor noted a request for Council to take a position in opposition to AB 2488 (Developer Fees and Exactions "Roughly Proportional"). Motion was made by Councilmember Arellano, seconded by Councilmember Gifford and carried (Councilman Sudol absent) to send a letter in opposition to AB 2488. City Administrator Baksa distributed information on SB 837 and stated that staff will be watching this bill. He also explained that staff sent a letter out on the Vehicle License Fee bill, since it needed an immediate response. Councilwoman Rowlison noted that May 27 is Local Government Day in Sacramento, in case any Councilmembers want to go. The Mayor requested Councilmembers call the City Clerk if they are interested. The following informational items were noted with no separate discussion on same: Legislation: League of California Cities Legislative Bulletin # 15-1998 dated April 24, 1998; and League of California Cities Urgent Communication regarding Vehicle License Fees, and City of Gilroy letters to legislators relating our concerns. Customer Service: Letter of thanks from Martha L. Martinez, Principal, EI Roble School, for the attendance of Community Service Officer Munoz at their PeaceBuilder Launch- off Assembly; Letter of appreciation from Robert Tapella, Garlic City Billiards, to Corporal Brett Johnson and Officer Daniel Zen for assistance with a vandalism case; Certificate for Jeff Watterson, 1997-1998 Team Gilroy Volunteer of the Year; and Letter of thanks from Martha L. Martinez, Principal, EI Roble School, to Corporal Dan Renville for his continued support in the Adopt a School Program. Informational items: South County Regional Wastewater Authority Ongoing Engineering Activities, April 28, 1998 SCRW A Board Meeting; Memorandum from League of California Cities regarding Important Emergency Medical Services (EMS) Legislation Update; and Letter from Maureen Hunter in support of a skateboard park. City Administrator Baksa announced the United Neighborhoods South County Conference, Building Foundations for Healthy Neighborhoods, Saturday, May 16, 1998, Brownell Academy. He reported on the research on the Central Fire vs. the City Fire Department, and noted that until the paramedic/ambulance service issue is sorted out, there is no reason to look at going with County, because it will not save us any money. GPUC 7171 The Mayor noted the 90 day City Council calendar, a list of upcoming meetings. He reminded everyone that Friday, May 8, is Seniors' Day. He also reminded everyone of the Memorial Day celebration. He stated that the March of Dimes WalkAmerica walk-a-thon and the National Neurofibromatosis Foundation dinner was on Saturday. Councilman Springer stated that the Special Olympics was an outstanding event. He remarked on the neighborhood cleanup on Eigleberry on Saturday. Councilmember Gifford stated that she will not be in town for the Memorial Day celebration. She stated that she attended the Special Olympics event, and that it was delightful. Councilman Morales congratulated the participants, coaches, parents and peace officers who were at the Special Olympics. He thanked Ms. Vasques for organizing the Eigleberry Street cleanup. He encouraged everyone to support the Memorial Day celebration. He stated that funding is needed for the Gilroy Hawks. He congratulated Mayor Gilroy for the award the Mayor received last week at the Exchange Club. He noted the Hispanic Chamber of Commerce Ambassador's Ball on Friday. Councilwoman Rowlison distributed copies of a resource card from the Gilroy Community Collaborative. She commented on the opening of Hunting Hollow, the new entrance to Coe Park. She noted the Housing Industry Foundation programs available to assist with rent. The Mayor requested Councilmembers take their copy of the budget when leaving the meeting. The Mayor noted an update by the City Council representatives regarding the General Plan revision. Council discussed the three proposed policies for the General Plan Update Committee, noting possible minor changes. Motion was made by Councilmember Arellano, seconded by Councilwoman Rowlison and carried (Councilman Sudol absent) to approve the Gilroy General Plan Update Committee Non-Participation Policy, as amended to include in the fourth paragraph "...the Chairperson or Staffby 5:00 p.m...." and under Grounds for Dismissal-Regular Meetings amend the wording as follows: "...from the regularly scheduled monthly meetings...". Councilmember Arellano suggested that the Committee seems to be bypassing the Council, and suggested that all the alternates be promoted to full general membership. Motion was made by Councilwoman Rowlison that the Gilroy General Plan Committee General Plan Committee Member Replacement Process be approved with an amendment to add an additional section that the Committee's recommendation be forwarded to the City Council for approval, and the motion died for lack of a second. Council consensus was to have Councilmembers Springer and Sudol review and revise the documents and bring them back for approval.
