Mayor Pro Tern Sudol noted a Study Session that was held on a review ofthe
1998 Police Department Survey which followed the closed session.
Mayor Pro Tern Sudol announced that the Council had adjourned from a
Closed Session regarding Conference with Real Property Negotiator, pursuant to
Government Code Section 54956.8 and that no action had been taken.

Mayor Pro Tern Sudol presented the Employee Award for the Month of
December, 1998, to Rachel Munoz, Community Service Officer, Police
Department.
Mayor Pro Tern Sudol noted Presentation ofa Volunteer Award to City
Administrator Jay Baksa from the California Parks and Recreation Society District
IV.
Mayor Pro Tern Sudol presented a proclamation to Kerry Dexter for Kerry
Day, February 1, 1999.
Mayor Pro Tern Sudol noted a Presentation by the Gilroy Karazenpo Karate
Club on their 40th Anniversary. Beth Noble read a history of the Club and several
parents read letters or awards in support of the Club. Doug Noble spoke on behalf
of the Club.
Motion was made by Councilman Morales, seconded by Councilmember

Mayor Pro Tern Sudol noted a resolution on TM 98-04 for Charles S.
Schramm.
Councilmember Gifford recused herself from voting on this issue due to the
fact that she lives close to this project, and stepped down from the dais.
Debby Bright questioned whether a traffic study was done for this project.
The City Attorney explained that the staff report did contain an analysis of the
traffic issues.
Motion was made by Councilmember Arellano, seconded by Councilman
Morales and carried that the reading of Resolution No. 99-11 be waived and that it
be adopted.

Lien Procedure Mayor Pro Tern Sudol noted a memorandum regarding South Valley Disposal
and Recycling bills and lien procedures.
The City Administrator reviewed the request by South Valley Disposal and
Recycling for a lien procedure. The City Attorney reviewed the informational
memo on a lien procedure.
John Nicoletti, South Valley Disposal & Recycling, Inc., stated that they have
notified all property owners of the lien procedure possibility.
Council consensus was that the City Attorney research a process that the
property owner will receive the refuse bill, and a lien procedure with be reviewed
with notification to the property owner.
New Renaissance Mayor Pro Tern Sudol noted a request by The New Renaissance Centre to
Center enter into an interim lease arrangement with the City of Gilroy for use of the Old
City Hall.
The City Administrator reviewed the request.
Motion was made by Councilmember Gifford, seconded by Councilman
Morales and carried (Mayor Gilroy absent) to approve the request for a term of90
days, finding that this is a special circumstance in that the Council values the
services of the tenant as a caretaker.
Council Salaries Mayor Pro Tern Sudol noted an Ordinance ofthe City Council ofthe City of
Gilroy repealing Ordinance No. 95-04 and providing for salaries for members of
the City Council.
Motion was made by Councilman Springer, seconded by Councilman Morales
and carried (Mayor Gilroy absent) to read the Ordinance by title only and waive
further reading of the Ordinance. The City Clerk read the Ordinance by title only.
Motion was made by Councilman Springer, seconded by Councilman Morales
and carried (Mayor Gilroy absent) to introduce the Ordinance providing for
salaries for members of the City Council, with amendments and adjustments to the
ordinance regarding the Consumer Price Index.
Mayor Pro Tern Sudol asked if there was anyone in the audience wishing to
speak on any item not on the agenda. There was no comment from anyone in the
audience.
Councilwoman Rowlison noted legislation on animal shelters and noted that
letters were sent to our legislators regarding requesting legislation for 1999. She
stated that we should invite our legislators each year to a Council meeting.

Councilman Springer requested letters be sent to our legislators on AB 83
regarding home businesses and SB 10 regarding storm drains reiterating our
position. He also requested the letter from Mrs. Keaveney be sent to the General
Plan Update Committee, and it was noted that she sent this to them.
Councilmember Gifford noted the customer service letter to the Police
Department regarding the vacation watch.

watching their home and property while they were on vacation;

The minutes of the Library Commission meeting of December 9, 1998 were
noted.
The minutes of the Parks & Recreation Commission meeting of December 15,
1998 were noted.
The minutes ofthe Personnel Commission meeting of November 8, 1998 were
noted.
The minutes of the Physically Challenged Board of Appeals of December 17,
1998 and January 19, 1999 were noted.
The report of the Planning Commission meeting of January 7, 1999 was noted.
The City Administrator distributed the Fourth Quarter Reports. He noted
several meetings, including February 8 on Numerical Limits, February lion the
Affordable Housing Policy, and February 22 on the Neighborhood Revitalization
Strategy. He announced that he will be attending the City Managers' meeting in
Monterey on Wednesday through Friday of this week. He stated that Supervisory
training will start next Tuesday and run for four weeks. He noted the bonds closed
on the assessment district, at a lower interest rate than expected.
The City Attorney noted a request by the Town of Mammoth Lakes to join in
Amicus Brief supporting use of a program EIR - Friends of Mammoth v. Town of
Mammoth Lakes, California Court of Appeal.
Consensus of the Council (Councilmember Arellano voting no) was to approve
joining in Amicus Brief supporting use of a program EIR - Friends of Mammoth v.
Town of Mammoth Lakes, California Court of Appeal.
Mayor Pro Tern Sudol noted the 90 day City Council calendar, a list of
upcoming meetings. He noted a letter from Larry Wilson, ChairIBoard of
Directors, Santa Clara Valley Water District, requesting the City of Gilroy
designate a representative and alternate to the District Flood Control Zone
Advisory Committee and the Santa Clara Valley Water Commission.
Motion was made by Councilman Morales, seconded by Councilmember
Arellano and carried (Mayor Gilroy absent) for Councilwoman Rowlison to
represent and Norm Allen as the Alternate on the Santa Clara Valley Water
District Flood Control Zone Advisory Committee and also for Councilwoman
Rowlison to represent and Councilman Springer as the Alternate on the Santa
Clara Valley Water Commission.
Councilman Springer requested the SCRW A meetings be noted on the 90 day
calendar.

GPUC Com. Mayor Pro Tern Sudol noted a recommendation to appoint six (6) members to
the General Plan Update Committee.

Motion was made by Councilwoman Rowlison, seconded by Councilman
Morales and carried (Mayor Gilroy absent) to appoint the following six (6)
members to the General Plan Update Committee - Rose Lepetich, Alfred Navaroli,
Connie Rogers, Carl McGeehon, William Reimal, and Chris Vanni.
Councilman Springer requested a certificate be given to Denise Apuzzo for her
work on the General Plan Update Committee. The City Administrator suggested
the City Clerk work with the Planning Division to see what can be done at the end
of the process.
City Flag
Mayor Pro Tern Sudol noted a request for a discussion of a proposal for City
of Gilroy flag.
Councilmember Arellano asked for support from the Council for a City of
Gilroy flag. Councilmen Morales and Springer agreed to assist on a committee to
set up a contest for sixth graders to design a flag.
RDO Exemption Mayor Pro Tern Sudol noted a request to modify Section 4.03 (E) of the City's
"RDO Affordable Housing Exemption Procedure for Private Developments"
policy.
Councilman Springer stated that this will be dealt with in the meetings on
February 8 and 11, 1999.
Councilmember Arellano stated that she attended a JP A meeting last week
regarding money for library expansions and she noted that the City Managers are
keeping on top of this. She noted that the Citizens Advisory Committee will only
be meeting two times a year. Consensus of the Council was to have
Councilmember Arellano ask that this issue be revisited.
Councilmember Gifford discussed the Arts and Culture Commission and their
study of downtown murals. She stated that the City needs some immediate
approval process of murals downtown. The City Administrator stated that staff
has met on this and that the Commission will have a Public Hearing on this issue.
Councilman Morales noted that some cities have ordinances on laser lights and
questioned whether the City of Gilroy wants to review this. The consensus of the
Council was that if information comes to the City Administrator, he will pass it on.
He thanked the PAL for the PAL newspaper.
Councilwoman Rowlison stated that she attended a water commission meeting,
the Cities Association meeting, and the League Peninsula Division dinner meeting.
She stated that she will not be at the February 22 meeting. She stated that she has
tickets for the February 19 Bach to Blues faculty fundraiser for Gavilan College
music department.
Mayor Pro Tern Sudol noted the following meetings/events:
Study session - February 8, 1999, 7:30 p.m., Gilroy Senior Center, 7371
Hanna Street, Gilroy, California to review the Residential Development Ordinance
(RDO) Numerical Limits and the Affordable Housing Exemption.
Study session - February 22, 1999, 7:00 p.m., location to be determined, to
review the Neighborhood Revitalization Strategy.
