Al Navaroli, Vice-Chairperson of the Parks and Recreation Commission, gave
a report on activities the Commission has worked on, including the skateboard
park, Parks Master Plan, Gilroy Sports Park, and Youth Commission Bylaws. He
noted they are working on a policy on amplified music, a Veteran's flag pole
installation, including an avenue of flags to include sister city flags and the Vietnam
War POW flag, and a symphony concert in the park. He stated that the
Commission also held a retreat to discuss future issues.

The Mayor stated it was the time and place scheduled for a Public Hearing on
Report and Assessments for Weeds and Refuse Abatement.
The Mayor opened the Public Hearing. There was no comment from anyone in
the audience. The Mayor closed the Public Hearing.
Res. 99-66 Motion was made by Councilman Morales, seconded by Councilman Sudol and
carried (Councilmember Gifford absent) to approve Resolution No. 99-66
Confirming Report of Fire Chief and Levying Assessments.

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
CONFIRMING THE REPORT OF THE CHIEF OF THE FIRE DEPARTMENT
SETTING FORTH THE DESCRIPTION OF PROPERTY, THE OWNERS
THEREOF, AND THE COST OF ABATING THE NUISANCE CAUSED BY
THE GROWING OF WEEDS AND ACCUMULATION OF REFUSE IN THE
CITY OF GILROY, AND PROVIDING THAT SUCH COST SHALL
CONSTITUTE ASSESSMENTS AGAINST THE RESPECTIVE OWNERS OF
LAND.

Lien Procedure The Mayor noted an Ordinance of the City Council of the City of Gilroy
Garbage amending Chapter 12 of the Gilroy City Code, regarding garbage and refuse
Collection collection and disposal, and procedures for the collection of delinquent garbage
and refuse customer billings as special assessment liens.

The staff report was noted and further explained by Administrative Services
Director Dorn.
John Nicoletti gave an update on the outstanding bills, noting that it is not
getting any better. In answer to a question, he stated that they do not require a
deposit.
Terry Feinberg, Tri-County Apartment Association, stated they are opposed to
this concept, but are aware of the problem. He stated that he appreciates the effort
to allow his Association to comment on the development of this process. He
asked that the property owner be notified. He asked that the Administrative fees
be borne by the City of Gilroy or South Valley Disposal.

8:07 p.m.)
Councilmembers discussed the civil procedure for recovering losses, sign-up
deposit possibilities, administrative fees, and the possible need for requiring a
larger container for some accounts.
The City Attorney noted a possible change to the ordinance to notify the
property owner and the renter after 30 days delinquency.
Motion was made by Councilwoman Rowlison, seconded by Councilman
Morales and carried (Councilmember Gifford absent) to read the Ordinance by title
only and waive further reading of the Ordinance. The City Clerk read the
ordinance by title only.
Motion was made by Councilwoman Rowlison, seconded by Councilman
Morales and carried (Councilman Springer voting no and Councilmember Gifford
absent) to introduce the Ordinance approving amending Chapter 12 of the Gilroy
City Code, as amended to include 30 days notice to the property owner and renter.
Motion was made by Councilmember Arellano, seconded by Councilman
Morales and carried (Councilman Springer voting no and Councilmember Gifford
absent) to approve an amendment to the franchise agreement for South Valley
Refuse and Recycling, Inc. establishing a lien procedure for delinquent accounts.
MTC and EDA The Mayor noted a presentation and discussion of the Metropolitan
Grants Transportation Commission (MTC) grant approval for the Streetscape
Improvements adjacent to the Monterey Street Train Depot and the Economic
Development Administration (ED A) Planning Grant approval.
The City Administrator noted the approved grants and planned future projects.
Community Development Director Allen reviewed the grants, time schedules, and
the areas planned for improvements through these grants, noting that no City funds
will be required.
The Mayor asked if there was anyone in the audience wishing to speak on any
item not on the agenda. There was no comment from anyone in the audience.

Community Development Department - Planning Division Monthly Report of
Long-Range Applications and Status ofRDO Allocation & Activity, June 11,
1999;
Letter to Supervisor Donald F. Gage regarding Measure B Draft Base Case
Implementation Plan; and
Approval by the Public Utilities Commission of the State of California of the
sale and conveyance by Pacific Gas and Electric Company of its streetlight system
to the City of Gilroy.
The minutes of the South County Regional Wastewater Authority meeting of
June 8, 1999 were noted.
The City Administrator gave an update of the Ballot Measure issue. He noted
that he has discussed this issue with the City Attorney and a tax specialist, and it
was agreed that it will be acceptable to have the election in March. He stated that
under a Mello-Roos process, there is more flexibility than with a parcel tax. He
stated that there will be no need for a benefit finding and no annual hearing. He
reviewed the costs and the steps the City will need to take in the next few months.
He questioned whether this Council wants to deal with this issue or leave it for the
next Council. The consensus of the Council was to press on now.
The City Attorney noted the temporary suspension of enforcement of
Resolution No. 97-43 regarding voluntary expenditure ceilings and limits on
campaign contributions. After Council discussion, it was agreed that the campaign
contribution limit will stay at $250.00 ~
The Mayor noted a report on his meeting with Supervisor Don Gage regarding
proposed Homeless Shelter Guidelines. He distributed a letter of invitation to
surrounding communities to discuss the homeless shelter issue. Council agreed to
switch the July 12 meeting to be on local issues and July 26 for the regional issues
meeting. He distributed a Council Candidate Orientation agenda for July 8, 1999
at the TEEC building.
The City Administrator stated that the draft General Plan will be ready for
distribution next week. It was the consensus of the Council to distribute the
minority report and the draft General Plan next week.

Councilwoman Rowlison stated that she attended the Emergency Preparedntls~ ;^) "'1
Council and noted the Y2K issue was discussed. She noted that the Emergency
Preparedness Council also authorized money for SIMS training in September.
Councilman Morales distributed the Agricultural Conservation Easement
(ACE) Program for Santa Clara County action items. He congratulated the
participants of the softball tournament on July 4. He thanked the committee for
the fireworks show and the community's safe use of fireworks. He thanked Public
Safety employees for their services, and those Community Service employees for
maintaining the parks.
Councilman Sudol stated that he attended the Silicon Valley Manufacturing
Group forum on transit oriented projects. He noted that they are trying to attract
housing nearer the businesses, but there are no services such as grocery store or
gas stations to serve this housing.
Councilmember Arellano noted that the Special Visitors Committee
coordinated a breakfast for Indian Motorcycles on Saturday. She noted the
hospital issue, and that she has been getting a lot of inquiries. She stated that she
would like to have a central place that questions regarding the hospital would go
to. It was noted that this issue will be placed on Channel 34 regarding who to
contact.
Councilman Springer stated that now that we are getting a barrier on Highway
101, this is considered a construction zone. He noted that speeding ticket fines are
doubled in a construction zone. He requested that this be put on Channel 34.
