The City Clerk noted that the Agenda had been posted on September 10, 1999 Agenda at 9:30 a.m. Present: Councilmembers: Lisabeth A. Gifford, Charles S. Morales, Suellen C. Rowlison, Thomas W. Springer, Anthony C. Sudol III (arrived at 6:47 p.m.), and K. A. Mike Gilroy; Absent: Councilmember Guadalupe Arellano - 6:45 p.m. The Mayor noted an emergency ordinance amending Chapter 18 of the Gilroy City Code, regarding Public Park and Recreational Facilities and Rules and Regulations therefore regarding the skate park facility. The City Administrator and City Attorney reviewed the emergency ordinance, noting the need to properly post the requirement to wear safety equipment to have qualified immunity for 14 years of age and older. It was noted that it will be five more days before the Police Department will start to cite users. The City Administrator stated there will be directed enforcement at various times. The City Attorney noted that this is a hazardous recreational activity and you skate at your own risk. She stated that the State is collecting information on a yearly basis on injuries incurred at this type offacility. She also noted that some cities require waivers for the user and the parent to sign if the user is under 18 years of age. 741 The Mayor stated that he was under the impression that when the Council approved this, that the City had immunity and was covered for all ages. Councilman Morales noted that the facility is becoming a regional draw. Ord. 99-14 Motion was made by Councilman Sudol, seconded by Councilman Springer and carried (Councilmember Arellano absent) to adopt emergency Ordinance No. 99-14 amending Chapter 18 of the Gilroy City Code, regarding Public Park and Recreational Facilities and Rules and Regulations therefor [skate park facility], and to come back quickly with additional information. ORDINANCE NO. 99-14 AN EMERGENCY ORDINANCE OF THE CITY OF GILROY AMENDING CHAPTER 18 OF THE GILROY CITY CODE, REGARDING PUBLIC PARK AND RECREATIONAL FACILITIES AND RULES AND REGULATIONS THEREFOR. [SKATE PARK FACILITY] PASSED AND ADOPTED this 13th day of September, 1999, by the following vote; AYES: COUNCILMEMBERS: GWFORD, MORALES, ROWLISON, SPRINGER, SUDOL and GILROY COUNCILMEMBERS: NONE COUNCILMEMBERS: ARELLANO . NOES: ABSENT: Skate Park Facility The Mayor noted an Ordinance of the City of Gilroy amending Chapter 18 of the Gilroy City Code, regarding Public Park and Recreational Facilities and Rules and Regulations therefor regarding the skate park facility. Motion was made by Councilman Sudol, seconded by Councilman Morales and carried (Councilmember Arellano absent) to read the Ordinance by title only and waive further reading of the ordinance. The City Clerk read the Ordinance by title only. Motion was made by Councilman Springer, seconded by Councilman Sudol and carried (Councilman Arellano absent) to introduce the Ordinance amending Chapter 18 of the Gilroy City Code, regarding Public Park and Recreational Facilities and Rules and Regulations therefor. [Skate park facility] Councilwoman Rowlison noted the need for more trash cans, benches, and recycling bins at this facility.
