Report Robert Dillon, Vice-Chairman of the Library Commission, noted the growth in circulation and the expanded hours at the Gilroy Library. He thanked Councilmember Arellano for her work on the Library Joint Powers Authority. He noted the increase in the Adult and Family Literacy program. He commented on the proposed expansion of the Library, including the need for additional parking. The Mayor deviated from the regular order of the agenda to accommodate interested persons in the audience. Falcon Cable The Mayor noted a request to approve a proposed cable system change of Transfer to control from Falcon Communications, L.P. to Charter Communications Holding Charter Com. Company, LLC. The City Administrator and Sue Buske, consultant, reviewed the actions required for the three cities (Gilroy, Hollister, and San Juan Bautista) to approve the transfer. The City Attorney noted that in Section 2, the date should be changed to November 5, 1999, and that the attached "Transfer Agreement" should be noted as "Proposed" . Res. 99-85 Motion was made by Councilmember Gifford, seconded by Councilman Morales and carried to adopt Resolution No. 99-85 approving a proposed cable system change of control from Falcon Communications, L.P. to Charter Communications Holding Company, LLC. RESOLUTION NO. 99-85 RESOLUTION OF THE CITY OF GILROY APPROVING PROPOSED CABLE SYSTEM CHANGE OF CONTROL FROM FALCON COMMUNICATIONS, L.P. TO CHARTER COMMUNICATIONS HOLDING COMPANY, LLC. Bid-Consultant The City Administrator presented recommendations to award a contract for Services consultant services for a Downtown Specific-Site Re-Use Plan and Market Evaluation to Economics Research Associates in the amount of$48,377.00 and recommendation to award contract for consultant services for a Downtown Streetscape Vision and Conceptual Plan to RRM Design Group in the amount of $41,119.00. ,7 4 .3~ Motion was made by Councilmember Arellano, seconded by Councilman Morales and carried to award a contract for consultant services for a Downtown Specific-Site Re-Use Plan and Market Evaluation to Economics Research Associates in the amount of $48,377.00 and to award a contract for consultant services for a Downtown Streetscape Vision and Conceptual Plan to RRM Design Group in the amount of$41,119.00. Hearing GPA 99-01 The Mayor stated it was the time and place scheduled for a continued Public Hearing on a General Plan Update and Amendment request. The proposed 1999 Update of the City of Gilroy's General Plan document is the first comprehensive update of the General Plan since its initial adoption in November, 1979. The proposed 1999 General Plan Update provides a guide for the physical development of the City, and brings the Plan into conformance with changes in State law and other legal requirements; reflects changes in the local population and economy since 1979; incorporates the most recent projections and assumptions regarding future growth; and responds to the issues, challenges and opportunities created by recent trends and developments. The proposed 1999 General Plan includes goals, policies and programs regarding State-mandated General Plan elements (Land Use, Circulation, Housing, Open Space, Conservation, Safety, and Noise), and "optional elements" (Agriculture, Air Quality, Cultural Facilities, Economic Development, Growth Management, Historic Preservation, Parks and Recreation, Scenic Highways, Schools, and Water Supply and Quality) to the year 2020. City of Gilroy, applicant, GP A 99-01. The Mayor explained that the Council had not received any recommendation as yet from the Planning Commission, and would be continuing this request. He asked if anyone in the audience would like to speak on this request, and there was no comment from the audience. Motion was made by Councilman Morales, seconded by Councilmember Arellano and carried to continue the Public Hearing to December 6, 1999. Homeless Shelter The Mayor noted a request to approve Homeless Shelter Guidelines to set Guidelines forth criteria for the location and operation of homeless shelters within the City of Gilroy. City of Gilroy, applicant, M 99-02. The City Administrator noted the homeless shelter siting policy, and that the study being prepared by Santa Clara County has not been completed. Planner II Durkin reviewed a map and noted areas in Gilroy where a homeless shelter could be located. Florence Trimble noted that the Gilroy volunteers want a better place for the people that they are serving. She stated that it was never a thrust from San Jose that Gilroy have a homeless shelter. She agreed that there are different needs for families and single men and women. She noted that no one has set a size that the shelter should be. She commented that it would be better on a management basis and cost basis to have both families and singles under one roof, but in different areas of the facility. Ray Tovar, Emergency Housing Consortium, noted that they had 100 units occupied with 70% of those from Gilroy. He invited the Council to visit the Reception Center in San Jose. He noted that families can stay 90 days, with a possible extension. He gave an update on the Ochoa Center, and stated that they have 90 families waiting for the San Martin Center. Lee Neish, pastor at Gilroy Methodist Church, thanked Melissa Durkin for her work on this policy. He asked the Council to move forward quickly on this issue, and offered his services on gathering data. Father Dan Derry, St. Mary's Catholic Church, thanked the Council for taking this issue so seriously and trying to find solutions to this problem. He asked the Council to understand all the different people who use these services. Motion was made by Councilmember Gifford, seconded by Councilwoman Rowlison and carried to table this item until a future study session date, with the caretakers to provide data, and whether or not the proposed study has been completed. Com. Facilities The Mayor noted a resolution calling a Special Election and ballot measure District No. 1 wording for the City of Gilroy Community Facilities District No. 1 (Emergency Medical Services). The City Administrator reviewed the actions to be taken. (At 9: 10 p.m. Councilwoman Rowlison left the Council Chambers and returned at 9: 12 p.m.) Council agreed to change the wording regarding a 2% cap and change the word "incidental" to "related". Res. 99-86 Motion was made by Councilmember Gifford, seconded by Councilman Springer and carried (Councilman Sudol voting no) to adopt Resolution No. 99-86 calling a Special Election and ballot measure wording for the City of Gilroy Community Facilities District NO.1 (Emergency Medical Services). RESOLUTION NO. 99-86 RESOLUTION CALLING A SPECIAL ELECTION AND BALLOT MEASURE WORDING FOR THE CITY OF GILROY COMMUNITY FACILITIES DISTRICT NO.1 (EMERGENCY MEDICAL SERVICES). PASSED AND ADOPTED this 1st day of November, 1999, by the following vote; AYES: COUNCILMEMBERS: ARELLANO, GIFFORD, MORALES, ROWLISON, SPRINGER, and GILROY NOES: COUNCILMEMBERS: SUDOL ABSENT: COUNCILMEMBERS: NONE At 9: 16 p.m. the Mayor called a recess, after which he recalled the meeting to order. Street Sweeping The Mayor noted a proposed Street Sweeping Contract with South Valley Disposal and Recycling, Inc. The City Administrator noted the proposed street sweeping contract. John Nicoletti stated that they will not increase the cost due to any increase in the road mileage. In answer to a question, he agreed to also discuss during negotiations the possibility of steam cleaning the sidewalks in downtown. Motion was made by Councilman Sudol, seconded by Councilmember Arellano and carried to direct staff to enter into contract negotiations and that the franchise agreement be amended to include street sweeping to the list of services. The Mayor asked if there was anyone in the audience wishing to speak on any item not on the agenda. There was no comment from anyone in the audience. The City Administrator distributed the Third Quarter Reports. The Mayor noted the dedication of Las Animas Veterans Park on November 11, 1999. He wished all candidates "good luck" in tomorrow's election. Safe Drinking Councilwoman Rowlison noted the Safe Drinking Water, Clean Water, Water Watershed Protection and Flood Protection Act of 1999 on the ballot in March 2000. She noted that on the November 2000 ballot will be a measure to continue the special benefit assessment tax that we currently pay on our tax bills. Councilwoman Rowlison stated that the Council on Aging is requesting a new representative from Gilroy, and it was pointed out that a representative has been appointed. She commented on the new $1.50 per ton AB 939 fee for household hazardous waste collections education and sites. Councilman Morales thanked staff for hosting Mr. Medina last Friday and also Jordan School students for their violin concert. He welcomed Joe Klein Jr. back to Gilroy. Councilman Sudol questioned the hours of operation for the Train Depot, stating that the operator is not following the proposed hours. He also noted signs in all the windows, which detracts from the beauty of the building. Councilmember Arellano agreed with Councilman Sudol that the signs are bad at the Train Depot. She stated that she is going to the San Jose Manufacturing Group Housing Summit on Thursday night and Friday. She reminded everyone to vote tomorrow.
