The Mayor led the Pledge of Allegiance to the Flag.
The City Clerk noted that the Agenda had been posted on November 18, 1999
at 10:30 a.m.
Present: Councilmembers: Guadalupe Arellano, Lisabeth A. Gifford, Charles
S. Morales (entered at 6:05 p.m.), Suellen C. Rowlison, Thomas W. Springer,
Anthony C. Sudol III, and K. A. Mike Gilroy - 6:00 p.m.
The Mayor stated it was the time and place scheduled for a Public Hearing to
consider adoption of a franchise agreement between the City of Gilroy and Falcon
Cable Systems Company II, L.P., a wholly owned subsidiary of Charter
Communications Holding Company, LLC.

City Administrator Baksa noted actions to be taken and noted that the other
two cities have held their Public Hearings.
Councilman Sudol recused himself and stepped down from the dais, due to the
fact that Charter Communications is in partnership with his company.
Sue Buske, consultant, thanked everyone who helped with this long process.
She stated the business transaction closed on November 12, 1999 for Charter
Communications purchase of Falcon Cable Systems. She stated that Falcon Cable
Systems is the proper legal name of the local cable company, and until Charter
Communications changes the name it will remain.
In answer to a question, Linda Kimberly, Falcon Cable Systems, stated that all
credits for any outages should have been completed by last August, 1999.
The Mayor opened the Public Hearing. There was no comment from anyone in
the audience. The Mayor closed the Public Hearing.
Ord.99-22 Motion was made by Councilman Springer, seconded by Councilmember
Arellano and carried (Councilman Sudol absent) to adopt Emergency Ordinance
No. 99-22 adopting a franchise agreement between the City of Gilroy and Falcon
Cable Systems Company II, L.P., a wholly owned subsidiary of Charter
Communications Holding Company, LLC.
ORDINANCE NO. 99-22
AN EMERGENCY ORDINANCE ADOPTING A FRANCHISE AGREEMENT
BETWEEN THE CITY OF GILROY AND FALCON CABLE SYSTEMS
COMPANY, II, L.P., A WHOLLY OWNED SUBSIDIARY OF CHARTER
COMMUNICATIONS HOLDING COMPANY, LLC.
PASSED AND ADOPTED this 22nd day of November, 1999, by the following
vote;
AYES: COUNCILMEMBERS: ARELLANO, GIFFORD, MORALES,
ROWLISON, SPRINGER, and GILROY
NOES: COUNCILMEMBERS: NONE
ABSENT: COUNCILMEMBERS: SUDOL
Motion was made by Councilman Springer, seconded by Councilmember
Arellano and carried (Councilman Sudol absent) to read the Ordinance adopting a
franchise agreement between the City of Gilroy and Falcon Cable Systems
Company II, L.P., a wholly owned subsidiary of Charter Communications Holding
Company, LLC by title only and waive further reading of the ordinance. The City
Clerk read the Ordinance by title only.
Motion was made by Councilman Springer, seconded by Councilmember
Arellano and carried (Councilman Sudol absent) to introduce an Ordinance
adopting a franchise agreement between the City of Gilroy and Falcon Cable
Systems Company II, L.P., a wholly owned subsidiary of Charter Communications
Holding Company, LLC.
Councilman Sudol returned to his seat at the dais.
