copies of the Public Art Policy & Mural Guidelines, and Jesse Garcia, Vice-
Chairperson of the Arts and Culture Commission, reviewed the history of the
Public Art Policy & Mural Guidelines, noting that in the near future a study session
will be held to review this. It was noted that a study session will be in January or
February, 2000

and carried to continue this item to December 20, 1999.
The Mayor stated it was the time and place scheduled for a continued Public
Hearing on a General Plan Update and Amendment request. The proposed 1999
Update ofthe City of Gilroy's General Plan document is the first comprehensive
update of the General Plan since its initial adoption in November, 1979. The
proposed 1999 General Plan Update provides a guide for the physical development
of the City, and brings the Plan into conformance with changes in State law and
other legal requirements; reflects changes in the local population and economy
since 1979; incorporates the most recent projections and assumptions regarding
future growth; and responds to the issues, challenges and opportunities created by
recent trends and developments. The proposed 1999 General Plan includes goals,
policies and programs regarding State-mandated General Plan elements (Land Use,
Circulation, Housing, Open Space, Conservation, Safety, and Noise), and
"optional elements" (Agriculture, Air Quality, Cultural Facilities, Economic
Development, Growth Management, Historic Preservation, Parks and Recreation,
Scenic Highways, Schools, and Water Supply and Quality) to the year 2020. City
of Gilroy, applicant, GP A 99-01.
Motion was made by Councilman Morales, seconded by Councilman Springer
and carried to continue the Public Hearing to January 24,2000.
The Mayor noted a continued Public Hearing on a Zoning Ordinance Text
Amendment to the City of Gilroy's Zoning Ordinance to "clean up" Zoning
Ordinance Section 18.30 Commercial Use Table, Section 34 Fences and
Obstructions, and Section 35 Antennas and Windmills. City of Gilroy, applicant, Z
99-05.
The revised staff report was noted and further explained by Planner I Stice.

7:31 p.m.)
The Mayor opened the Public Hearing. There was no comment from anyone in
the audience. The Mayor closed the Public Hearing.
Motion was made by Councilman Springer, seconded by Councilmember
Arellano and carried to direct staff to prepare an ordinance approving Z 99-05.

The Mayor stated it was the time and place scheduled for a Public Hearing on
a Zoning Ordinance Text Amendment request to amend Zoning Ordinance Section
37 Sign Regulations, to set forth standards for Regional Commercial Uses. City of
Gilroy, applicant, Z 98-07.
Motion was made by Councilman Morales, seconded by Councilman Springer
and carried to continue the Public Hearing to December 20, 1999 at staff's
request.

The Mayor stated it was the time and place scheduled for a Public Hearing on
an appeal ofa denial ofa Variance request from Zoning Ordinance Section 34.34
Fences and Obstructions, Section 34.40 Prohibited Materials, and Section 34.43
Wire Mesh Fences, to allow a fence over three (3) feet high within fifteen (15) feet
of the front property boundary; to allow a fence over three (3) feet high within five
(5) feet of the side yard property boundary adjacent to a street; and to allow a wire
mesh fence within the front yard setback area and within the side yard setback area
adjacent to a street, on property located at 264 Martin Street, zoned RI-HS
(Single Family Residential-Historic Site). Patty Sweeney, applicant, V 99-05.
Motion was made by Councilman Springer, seconded by Councilman Sudol
and carried to continue the Public Hearing to February 22, 2000.
Pub. Hearing The Mayor stated it was the time and place scheduled for a Public Hearing on
SLESF Funds a request to consider a report by the Gilroy Police Department recommending
projects/programs for funding under the State Law Enforcement Block Grant from
the Supplemental Law Enforcement Services Fund (SLESF) monies for the 1999-
00 Fiscal Year.
The staff report was noted and further explained by City Administrator Baksa.
The Mayor opened the Public Hearing. There was no comment from anyone in
the audience. The Mayor closed the Public Hearing.
Motion was made by Councilman Sudol, seconded by Councilman Morales and
carried to accept the funding for projects/programs as recommended.
Falcon Cable The Mayor noted an Ordinance adopting a franchise agreement between the
City of Gilroy and Falcon Cable Systems Company II, L.P., a wholly owned
subsidiary of Charter Communications Holding Company, LLC.
Councilman Sudol recused himself from this issue, because Charter
Communications is a customer of his employer, and left his seat at the dais.

Motion was made by Councilman Morales, seconded by Councilman Springer
and carried (Councilman Sudol absent) to adopt Ordinance No. 99-23, adopting a
franchise agreement between the City of Gilroy and Falcon Cable Systems
Company II, L.P., a wholly owned subsidiary of Charter Communications Holding
Company, LLC.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
APPROVING AND ADOPTING THE REGISTRAR OF VOTERS CANVASS
OF THE GENERAL MUNICIPAL ELECTION AND DECLARING RESULT
OF SUCH ELECTION HELD IN THE CITY OF GILROY ON NOVEMBER 2,
1999.
RESOLVED, by the City Council of the City of Gilroy, California that;
WHEREAS, by order of this Council a general municipal election was held and
conducted in the City of Gilroy on Tuesday, the 2nd day of November, 1999 as
required by law and the Charter of said City as amended; and
WHEREAS, it appears that notice of said general election was duly and legally
given; voting precincts were properly established; election officers were appointed
and election supplies furnished; and in all respects the election was held and
conducted and the votes cast thereat received and canvassed, and the returns
thereof made, determined and declared in time, form and manner as required by the
Charter of said City as amended and the general laws of the State providing for
and regulating municipal elections in said City; and
WHEREAS, the Registrar of Voters did conduct the canvass of the returns of
said municipal election and did count the absentee ballots cast thereat, pursuant to
direction and order of the City Council of said City; and
WHEREAS, said canvass was duly completed and the results thereof were
certified by the Registrar of Voters and submitted to this Council.
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, as
follows:
1. Said municipal election was held and conducted in the City of Gilroy,
County of Santa Clara, State of California on Tuesday, November 2, 1999 in the
time and in the form and manner as required by law.
2. That there were established fourteen (14) voting precincts for the purpose
of holding said municipal election consisting of either regular election precincts
established for holding state or county elections, or a consolidation of some or all
of such precincts, as follows:

certifying to the results of such canvass, which certificate is hereto attached,
marked Exhibit "A" and by this reference is made a part hereof Said certificate
has been examined and is hereby approved and adopted by this Council as the
official canvass of said municipal election,
4. The whole number of votes cast in said City of Gilroy at said municipal
election was 4,926 (including 875 absentee votes).
5. The names ofthe persons voted for, the offices for which they were voted,
the number of votes received by each of said persons in each of said precincts and
by absentee votes, are shown on said Exhibit" A", hereto attached.
6. At said general municipal election held in the City of Gilroy and Election
held on November 2, 1999, the following persons were elected to the following
offices:
THOMAS W. SPRINGER was elected Mayor of the City Council to hold
office for a term of four years, from and after Monday, December 6, 1999, and
continuing until his respective successor shall qualify.

shall also impose the constitutional oath of office and have them subscribe thereto.
8. That the City Clerk be, and she is hereby instructed to enter this resolution
in full in the minutes of this Council as a statement of the result of said general
municipal election.

The Mayor presented a proclamation for Retiring Mayor Gilroy, proclaiming
him Mayor Emeritus, and Mayor Emeritus Gilroy presented the Mayor with the
key to City Hall.

Motion was made Councilman Morales, seconded by Councilman Velasco and
carried to appoint Councilmember Lupe Arellano Mayor Protempore from
December 6, 1999 to August 7, 2000.
The Mayor noted various representative appointments to Council Advisory
Committees
Motion was made by Councilmember Arellano, seconded by Councilman
Morales and carried to approve Council representatives to Advisory Committees
as recommended.
The City Attorney noted FPPC 700 forms will need to be filed.
The Mayor asked if there was anyone in the audience wishing to speak on any
item not on the agenda.
Don Perino questioned if Thomas road will be discussed at this meeting, and it
was noted that it will be discussed under the Mayor's report.
Mary Yates stated her concerns regarding the lack of street sweeping and leaf
collection. The City Administrator noted that in two weeks, this item will be on
the agenda for a proposal by South Valley Disposal and Recycling. He noted that
the City is trying to keep up with the leaves.
The Mayor noted a letter from Linda Rodriguez, Gilroy Family Resource
Center, requesting a letter of support to the Santa Clara Board of Supervisors in
an effort to expedite the search for a new location for their staff
Eric Westphal spoke on the request and distributed a letter. Katina Martin
gave a testimonial to the help she has received from the Gilroy Family Resource
Center. Zoraida Rivas clarified that the Center has been here for four years, and
the Center has affected a lot of the community. Salvador Saucedo spoke in
Spanish, with a translator, thanking the Center for the programs that have been
offered, and noted that he would like the Center to have a permanent place to hold
their classes. Sue Abramson spoke on behalf of this request, stating that they have
been out of the building for 13 weeks now. Edward P. Sanchez spoke on behalf of
this request.
The Mayor offered to call Supervisor Gage tomorrow to see what the options
are and what can be done.
Motion was made by Councilmember Arellano, seconded by Councilman
Morales and carried that a letter be written tomorrow and sent requesting a speedy
resolution to this issue, so that critical resources can be provided to our
community.

Council on Aging The minutes of the Council on Aging Advisory Council meeting of November
11-1-99 1, 1999 were noted.
The City Administrator distributed the sign regulations staff report for the next
agenda. He distributed the Arts Policy to the three new Councilmembers. He
distributed an update memo on the EMS issue from the City of San Jose. He
noted the formal Public Hearing on the General Plan was continued to January 24,
2000, and noted that the Council will meet on January 10,2000 for a Study
Session and move the Public Art Study Session to a later date. He noted it would
be beneficial to have each Councilmember list what items each is interested in
discussing, and distributed a list of General Plan identified issues the Planning
Commission wanted to discuss. He noted that they will probably deal with the
Public Hearing for the General Plan on a topic basis. He noted the Fire Master
Plan Task Force is moving along, noting that they are using the 5 minute 95%
response time standard as their major parameter. He noted that the December

Special Olympics The City Administrator discussed the City's relationship with Special
Olympics of Northern California. He noted that Special Olympics has put the City
of Gilroy on notice that they are putting us under their umbrella. He noted that the
programs will be run out of Santa Clara County, and all money must now go
through them.
The City Administrator stated he is still trying to set up the half day new
Councilmember orientation for January 5, 2000.
Councilman Morales asked the City Administrator to keep the Council
informed regarding the issue of sewer service for the new high school in the
Morgan Hill area.
Amicus Brief The City Attorney noted a request for participation in Amicus Brief in Zelig v.
County of Los Angeles, Supreme Court No. S081791, Review Granted October
20, 1999.
Motion was made by Councilman Morales, seconded by Councilman Sudol and
carried to join the amicus brief.

Thomas Road The Mayor requested Council direction regarding renaming a portion of
Thomas Road,
Connie Rogers, Sandoe Hanna, Don Perino, Jean Lance, Lynn Lance, Mildred
Hanna, and Lillian Crocker spoke in favor of the request.
Consensus of the Council was to reagendize this item for February 22, 2000
with staff to bring back information as to the cost to rename the street again, and
also to allow citizens to gather information.
Councilmember Arellano distributed a list for the Councilmembers for bell
ringing for the Salvation Army for December 11. She stated there is a VT A Policy
Advisory Committee meeting scheduled for this Thursday, and asked that Mayor
Springer call to say that he is planning to attend. She welcomed the new
Councilmembers.
Councilman Sudol stated that he attended the Planning Commission meeting
last week regarding the General Plan. He also welcomed the new
Councilmembers.
Councilman Pinheiro thanked everyone for electing him to this position and
stated he will do his best the next four years.

Councilman Arellano thanked the Mayor and Councilmembers for the warm
welcome and stated that he is looking forward to working and serving the people
of Gilroy.
Councilman Morales congratulated the Mayor and Councilmembers and noted
his farewell to the retiring Mayor and Councilmembers. He asked the citizens to
keep a spirit of giving, noting that the Salvation Army needs bell ringers, there is a
need for assistance for St. Josephs, and Toys for Tots.
Councilman Velasco thanked everyone and stated that he is willing to work
hard.
