In response to a statement regarding notification of residents as to the changes that are proposed, the City Attorney stated that individual noticing is not required for a General Plan Amendment such as this. She stated the noticing is satisfied by law, with publishing in the newspaper. The Mayor explained the process for the General Plan hearings, noting that if someone has already given testimony on an issue, they do not need to give the same testimony, but rather a summary, as the Councilmembers have reviewed Planning Commission testimony already received. The staff report was noted and further explained by Planning Division Manager Faus regarding the new Residential Neighborhood designation. The Mayor stated it was the time and place scheduled for a continued Public Hearing on a General Plan Update and Amendment request. The proposed 1999 Update of the City of Gilroy's General Plan document is the first comprehensive update of the General Plan since its initial adoption in November, 1979. The proposed 1999 General Plan Update provides a guide for the physical development of the City, and brings the Plan into conformance with changes in State law and other legal requirements; reflects changes in the local population and economy since 1979; incorporates the most recent projections and assumptions regarding future growth; and responds to the issues, challenges and opportunities created by recent trends and developments. The proposed 1999 General Plan includes goals, policies and programs regarding State-mandated General Plan elements (Land Use, Circulation, Housing, Open Space, Conservation, Safety, and Noise), and "optional elements" (Agriculture, Air Quality, Cultural Facilities, Economic Development, Growth Management, Historic Preservation, Parks and Recreation, Scenic Highways, Schools, and Water Supply and Quality) to the year 2020. City of Gilroy, applicant, GPA 99-01. Present: Councilmembers: Guadalupe Arellano, Peter D. Arellano, Charles S. Morales, Al Pinheiro, Anthony C. Sudol III, Roland Velasco, and Thomas W. Springer - 7:01 p.m. The City Clerk noted that the Agenda had been posted on January 27,2000 at 9:17 a.m. The Mayor requested a moment of silence for those persons flying on Alaska Airlines flight from Puerto Vallarta to San Francisco that crash landed in the ocean near Los Angeles this afternoon, as family members of Gilroy citizens possibly were on that flight. The Mayor led the Pledge of Allegiance to the Flag. Special Meeting January 31, 2000 Gilroy, California 7473 Pub. Hearing GPA 99-01 Roll Call Posting Agenda 7474 The Mayor opened the Public comment period. Jim Gailey, 7560 Hanna Street, requested two lots be rezoned near Fifth and Eigleberry Streets to be R2 rather than C 1. The Mayor explained that this will be reviewed at the meeting on March 27,2000. Tom Houts, 8485 Burchell Road, recommended removing the Burchell Road area from the General Plan, or at least not having it designated Rl. John Donohoe, RJA Associates, on behalf of Glen Loma Group, noted positive elements in the Neighborhood District, but negative elements as the District is being proposed. He stated the District is too broad based. He recommended changing the concept of the District to an overlay district, keeping land use designations, and also keeping the target mix, but removing the minimum mix. He stated that the City should establish minimum and maximum ranges for each of the residential districts. He commented that the Neighborhood District should not be applied to the Glen Loma Ranch, but rather a Specific Plan to that area. He noted the RDO is an impediment to land use planning, and that the City should look for ways for the RDO to work in tandem with a Specific Plan. Owen Byrd, on behalf of Melissa Bruins, 8440 Burchell Road, noted the 20- year line and the City limit line would be coterminous in the Burchell road area. He stated that some golfers are requesting that this request be dropped. He stated that he would like the Planning Commission recommendation followed. Louise Conroy, 8525 Burchell Road, noted that this is one of the prettiest areas in the County, and that she would hate to see development and a golf course expanded in this area. David Collier, 1495 East Hillview, stated that the Planning Commission felt obligated to set minimum mix numbers. He noted a shift to an integrated base, to have a range of densities. He questioned whether we really need this in the document. He noted problems with small parcels being able to achieve the densities. He suggested phasing areas to achieve this minimum. He stated that he would like joint integrated proposals to be applied for together, and noted that incentives could be allowed for joint proposals in the RDO. Tim Filice, Glen Loma Ranch, stated his concern with setting minimums, and how the implementation will occur. He noted that details need to be addressed for the Neighborhood District. Steve Rider questioned why the Neighborhood District is being created. He stated problems will be presented in designing projects for this District. (At 8:40 p.m. Councilman Morales left the Council Chambers, and returned at 8:42 p.m.) Carolyn Tognetti, 820 Carignane Drive, read a portion of the vision of Gilroy, page 3-3 of the General Plan, which discusses the diversity of housing opportunities. (At 8:52 p.m., Councilman P. Arellano left the Council Chambers, and returned at 8:53 p.m.) The staff report on the three parcels to be redesignated was noted and further explained by Planning Division Manager Faus. (At 9:09 p.m., Councilman Sudol left the Council Chambers, and returned at 9:12 p.m.) Eric Smith, 1657 EI Dorado Drive, thanked the Planning Division for their help in providing options for this property on Westwood Drive. 74 I' '5 Planning Division Manager Faus noted a change on the map for the Burchell Road area to include additional area. Tim Filice noted that the southeast corner of Wren and First Streets area is well served by grocery stores and therefore no further grocery stores are needed here. He noted that a residential development will be a good mix for this area, with hopefully about 25% for senior citizens. Nancy Hilton, Trenton Place, questioned the trees on the Wren Avenue site, and it was noted that all the trees will be saved. At 9: 17 p.m., the Mayor closed the public comment period, which will be reopened on March 13, and called for a five-minute break, after which he recalled the meeting to order. The Council was unanimous in their agreement to follow the Planning Commission recommendation to approve the Wren Avenue/First Street and Westwood Drive issues of changing the General Plan to High Density Residential. Councilman Pinheiro noted that Denise DuffY's memo states that no further environmental work will need to be done on this issue. Regarding the Burchell Road issue of removing the municipal golf issue from the General Plan, Councilwoman G. Arellano supported the Planning Commission recommendation to remove that area, Councilman Sudol stated that he has come to no conclusion, and Councilmembers P. Arellano, Morales, Pinheiro, Velasco and Springer would like the area left in the General Plan. Regarding the Residential Neighborhood designation, Councilmembers G. Arellano, P. Arellano, Velasco, and Springer support it, Councilman Morales reserved his decision, and Councilmen Pinheiro and Sudol stated that they could not support it. The City Administrator stated that staffwill create a map of the Neighborhood District to show where development currently is located. He stated that he will get with David Driscoll and talk to him about implementation plans of this concept from other places. Councilmembers G. Arellano, P. Arellano, Morales, and Sudol supported the minimum mix wording in the General Plan being retained. Councilmen Pinheiro and Velasco stated that the minimum mix wording should be modified to be used as a flexible guideline. Mayor Springer stated the minimum mix wording should be moved to the implementation strategy. Councilmembers G. Arellano and Sudol stated that the target mix should be removed, and Councilmembers P. Arellano, Morales, Pinheiro, and Velasco stated that the target mix should be left in the General Plan (Mayor Springer did not comment). Councilmen P. Arellano and Sudol stated that no implementation task force is needed. Councilmembers G. Arellano, Pinheiro, and Velasco stated that an implementation strategy is needed. Councilman Morales reserved making a decision regarding the task force and implementation strategy. Mayor Springer did not comment on the issue of an implementation task force. The Mayor asked if there was anyone in the audience wishing to speak on any item not on the agenda. There was no comment from anyone in the audience.
