Minutes 2000/03/13 Posting Agenda Roll Call Pub. Hearing 75 .j ! Special Meeting March 13, 2000 Gilroy, California The Mayor led the Pledge of Allegiance to the Flag. The City Clerk noted that the Agenda had been posted on March 9, 2000 at 12:21 p.m. Present: Councilmembers: Guadalupe Arellano, Peter D. Arellano, Charles S. Morales, Al Pinheiro, Anthony C. Sudol III, Roland Velasco, and Thomas W. Springer - 7:01 p.m. The Mayor stated it was the time and place scheduled for a continued Public Hearing on a General Plan Update and Amendment request. The proposed 1999 Update of the City of Gilroy's General Plan document is the first comprehensive update ofthe General Plan since its initial adoption in November, 1979. The proposed 1999 General Plan Update provides a guide for the physical development of the City, and brings the Plan into conformance with changes in State law and other legal requirements; reflects changes in the local population and economy since 1979; incorporates the most recent projections and assumptions regarding future growth; and responds to the issues, challenges and opportunities created by recent trends and developments. The proposed 1999 General Plan includes goals, policies and programs regarding State-mandated General Plan elements (Land Use, Circulation, Housing, Open Space, Conservation, Safety, and Noise), and "optional elements" (Agriculture, Air Quality, Cultural Facilities, Economic Development, Growth Management, Historic Preservation, Parks and Recreation, Scenic Highways, Schools, and Water Supply and Quality) to the year 2020. City of Gilroy, applicant, GPA 99-01. The City Administrator noted that tonight's issues are primarily for discussion of the industrial uses east of the freeway. Planning Division Manager Faus reviewed the staff report regarding the issues for the meeting tonight. He noted the vacant land inventory for the Ml and M2 zones and the information regarding campus industrial land use designation for this General Plan. He stated that discussion for this meeting will focus on the following issues 1) location of Campus Industrial land use; 2) Rancho 101 land use designation; 3) Industrial designation for land east of Outlets, 20-year boundary; and 4) Traffic, Level-Of-Service (LOS) "C" or "D". Traffic Engineer Abrams reviewed the Level of Service (LOS) "C" and "D" proposed for various areas for the General Plan. In answer to a question, Pascal Valet, General Plan traffic consultant, stated that there was no specific methodology for setting LOS ratings for specific areas, but rather negotiation and a compromise. In answer to a question, David Driskell, General Plan consultant, reviewed the charge for setting the various boundaries, and why the City wants to stay within specific boundaries. He noted that they did a land use survey, and noted what was developed on each parcel. The Mayor opened the Public Hearing. Lee Wieder, Access Land Development Services, introduced Cathy Monahan assisting with the presentation, and noted that the location of the acres for campus industrial and a Comprehensive Plan for potentially developing those acres will address the vision of Gilroy. He reviewed three goals and seven objectives regarding land east of the outlet areas for inclusion in the 20 year boundary. He stated that he supports the designation of campus industrial east of the outlets, and noted that the City of Gilroy has the opportunity to study the merits of this and recirculate the EIR. ,,~ "7f:,(,/ oJ '.J .- At 8:06 p.m. Councilman Morales left the Council Chambers, and returned at 8:08 p.m.) (At 8: 17 p.m. Councilman Sudol left the Council Chambers, and returned at 8:19 p.m.) Councilman P. Arellano thanked Mr. Weider for meeting with him this week. Al Navaroli, 721 Fourth Street, Gilroy, noted the land ea&t of the outlets is not prime ag land. He stated that local growers cannot compete with the large, corporate growers. He requested the City Council bring this into the 20 year area. Jeff Martin, partner in the Rancho 101 property, stated that he accepts the residential neighborhood designation that the GPUC has recommended for this property. He requested to be a part of the discussion clarifying what the residential neighborhood designation definition is. Arti O'Connor, GPUC member, reviewed the compromise clause wording for exceptions for the Plan for this area regarding the boundary line. She noted that the GPUC charge was to create a vision for Gilroy. She noted that a majority of the GPUC members chose to place the boundary line at this location. Sylvester Heinberg, 1390 Llagas Avenue, Morgan Hill, stated that there is probably a lot of information that the GPUC did not have. He reviewed the land use for the area to the northeast of Gilroy. He stated that this is not an agriculture area, and hoped that there would be industrial jobs for our future graduates provided in this area. (At 8:44 p.m. Councilman P. Arellano left the Council Chambers, and returned at 8:46 p.m.) David Collier stated he is in favor of some agricultural use in this area, as it is an important part of our economy. He stated his concerns with residential use near the freeway. He stated his reasons for not placing industrial uses east of the outlets. He stated if additional industrial land is needed that it should be in the Rancho 101 area. Jacqueline Keaveney, 726 Fifth Street, noted the history of her family including farming the land east of the outlets. She asked that this land be included in the 20 year boundary. She stated that her land will be included in an area plan. At 9:20 p.m. the Mayor called for a ten minute break, after which he recalled the meeting to order. Carolyn Tognetti, 820 Carignane Drive and member of the GPUC, stated that the GPUC voted by a 2-1 margin to not expand the 20 year boundary. She reviewed reasons the GPUC made this decision. (At 9:35 p.m. Councilman P. Arellano entered the Council Chambers.) Ralph Santos, 1250 Old Bolsa Road, Gilroy, noted he is a local farmer. He noted that the GPUC did not seek input from local growers. He stated that the current trends in farming are serious, and changing. He noted that he supports the land south of Leaves ley Road and east of the outlets to be included in the 20 year boundary. He submitted a letter with this request with many other farmers listed in support of this. Marie Rajkovich Hoffman, noted her family's farming interests over the past decades. She noted that agriculture as we know it cannot survive anymore. She noted that this area needs campus industrial areas to prosper. 7h; 7, , ..) I., .,.' Autumn Bernstein, Greenbelt Alliance, 1922 The Alameda, San Jose, stated that Greenbelt Alliance works to protect agricultural land. She requested the General Plan be adopted as recommended and not increase the industrial land at the expense of agricultural land. Dawn Zintel, stated that she is opposed to developing the ag land east of the outlets. She noted that agriculture is California's #1 industry. Bill Lindsteadt, 8174 Kelton Drive, Gilroy, stated that he was a member of the GPUC and a signer of the alternative (minority) report. He stated that the areas planned for campus industrial use to the northeast of Gilroy is not the right place for this as there are too many small parcels that would need to be developed together. He stated that he supports the area to the east of the outlets as campus industrial area to be included in the 20 year area. He stated that area to the northeast of Gilroy should be rural residential, rather than campus industrial. He requested that the area near Buena Vista Avenue be designated for light industrial use. Bill Reimal, 7551 Kentwood Court, stated that he was a member ofthe 1979 General Plan Committee and also the current GPUC, that he was a participant of the minority report and he is a realtor. He noted arguments against the GPUC proposed location for campus industrial land use designation north of Las Animas Avenue to Masten Avenue between US 101 and Monterey Road. He stated that the industrial Park designation should be left between Monterey Road and US 101. He requested that the land to the east of the outlets be campus industrial, with his second choice being Rancho 101 for the campus industrial area. Joanne Konezny, 8555 Marcella Avenue, stated that she recently purchased her property and was told by the Planning Department that the area east of the outlets would remain agricultural. She read a letter from Janet Espinosa who could not attend the meeting, opposed to an industrial designation east of the outlets and expansion of the 20 year boundary. Joe Chase stated that the 1979 General Plan had a great deal of land included in it that is not needed for industrial, so the GPUC drew a line that they felt was adequate and he requested that the Council preserve that line. Connie Rogers distributed informational articles from Raymond P . Vasquez who is opposed to including the land east of the outlets into the 20 year area. She explained why the area to the north near the freeway was chosen for industrial designation. She noted the General Plan includes a mechanism to reevaluate the land use after ten years. Robert Miller, Michelle Court, stated that he was on the GPUC for the duration of the project. He stated that the minority report leads to sprawl. He noted hazards such as flooding and seismic problems that does not allow development. He noted that there are lands more suitable for development. At 11:08 p.m., the Mayor called for a ten minute recess, after which he recalled the meeting to order. Dan Gluhaich, stated that he is in favor of inclusion of the land east of the outlets in the 20 year boundary. He stated that it is nearly impossible to get a buyer to put together 40 small parcels for development of a campus industrial site. Sharon Albert stated that she served as a member and chair of the GPUC and also as a member of the 1979 committee. She noted that a majority of the GPUC voted to maintain the integrity of the 20 year plan. She stated that there is currently an adequate amount of industrial land currently in the General Plan. Tony Lupina, South County Realty, noted that he looks forward to development of the campus industrial areas as proposed on the General Plan. '75 ", ~ I li !+ Cathy Monahan, noted her family farms land east of the outlets. She noted that she is representing a group of land owners that currently farm this area, who are in favor of campus industrial for their land. She noted that these lands are in the low to moderate geologic hazard area on Santa Clara County maps. Vie Vanni, 1520 Calabrese Way, noted his support for a campus industrial designation east of the outlets. He stated we need high paying, high tech jobs for Gilroy. Gene Wells noted a considerable difference between campus industrial and industrial park. He stated that there is just a handful of acres that are available for development. He stated that the area proposed for campus industrial is not in a reasonable location. He stated that a campus industrial designation should be placed to the east of the freeway. Kirk Wheeler noted that his firm had reviewed alternatives to allow development in the flood plain to the east of the outlets. Todd Perkins, stated that he served on the GPUC and encouraged the City Council to follow the majority of the GPUC that voted for the proposed General Plan. The Mayor closed the public comment period. In answer to a question, Lee Weider explained that to mitigate the impact fees, he is suggesting that an area plan be done. He stated that during the recirculation of the EIR, the Council could direct a further analysis of the financial considerations of what type of financial mechanisms that can be in place to help finance some of the infrastructure costs. He noted that the analysis could potentially raise fees for all applicants to cover the infrastructure costs. David Driskell reviewed some of the issues that were questioned as far as the accuracy of his research. He explained the difference between the General Plan vs. the Zoning Map. Due to the lateness of the hour, the Mayor questioned whether the Councilmembers wanted to postpone the straw votes on the issues for this meeting. A majority of Councilmembers requested to finish the discussion and vote on the issues tonight (Councilmembers G. Arellano, P. Arellano, and Morales voted to postpone the discussion and vote). Regarding the campus industrial designation for land east of the outlets and including the land in the 20 year boundary, a majority of Council members agreed with this (Councilmembers G. Arellano and P. Arellano voting no). Regarding the Rancho 101 land use designation, a majority of Councilmembers agreed that this area should be Residential Neighborhood designation (Councilman P. Arellano voted to have Y2 of the area Residential Neighborhood and Y2 campus industrial designation). Regarding designating land between Monterey Road to Highway 101 and north to Masten Avenue as campus industrial, a majority of Council members agreed with this area to be designated as light industrial (Councilman Velasco voted for campus industrial designation, but clarified with a memorandum on March 14, 2000 that he meant light industrial) (Councilmembers G. Arellano and Morales voting for campus industrial, and Councilman P. Arellano voting for a combination of campus industrial and residential). Regarding the traffic level of service, this issue was deferred until additional information could be generated for the Council. The Mayor asked if there was anyone in the audience wishing to speak on any item not on the agenda. There was no comment from anyone in the audience.
