The City Clerk noted that the Agenda had been posted on September 27,2000 at 9:38 a.m. Present: Councilmembers: Guadalupe Arellano, Peter D. Arellano, Charles S. Morales, Al Pinheiro, Anthony C. Sudol III, Roland Velasco, and Thomas W. Springer - 7:01 p.m. The Mayor stated that he will hear Consent Item D. after the regular Consent Calendar items, to allow the claimant to address the Council. The Mayor introduced new employees Liana Coehlo, Accounting Assistant I, Finance Division, Administrative Services Department and Jeffrey Roccaforte, Police Officer, Police Department. Avelyn Ines, Police Records Technician I, Police Department was not available for introduction. Proc.-Domestic The Mayor presented Daniel Suniga with a proclamation for Domestic Violence Violence Awareness Month, October, 2000. Awareness Month Proc.-Women in The Mayor presented Ellen Larson with a proclamation for Women in Construction Construction Day, October 7, 2000. Day Emp. Award The Mayor continued presentation of the Employee of the Year Award for 1999-2000 to Bob Bozzo, Facilities Maintenance Specialist, Administrative Services Department to the October 16, 2000 meeting. Amos Brown spoke regarding the deceptive practices of the Police Department. He stated the Council votes by Councilmembers G. Arellano and P. Arellano should not be valid. He questioned the Council approving the business to allow radioactive waste in Gilroy. Motion was made by Councilman Pinheiro, seconded by Councilman Morales and carried that the following items under the Consent Calendar be approved, removing Item B. Motion was made by Councilman Sudol, seconded by Councilman Morales and carried to deny the claim of Karen Rogers. Phys.Challenged Lael McCormack stated that the Board has been working on completing ADA Bd.of Appeals improvements, and have 8 more years to complete the list of projects. She noted Report that the doors to the Council Chambers have been improved, that curb cuts in the sidewalks are being completed, and handicapped spaces at the train depot are being transferred to the north side. She commented that the Board has been invited to tour Bonfante Gardens to review their handicap access at the Park. She stated that she is proud of what Gilroy has done. Bid-Library Expansion The City Administrator presented a recommendation for a request to initiate contract negotiations with Fields Devereaux as the Library Design Consultant for the Gilroy Library Expansion and Renovation Improvements, and if unsuccessful to initiate contract negotiations with Noll & Tam, Oshima & Yee, and Group Four in succession until a contract can be negotiated. Facilities and Parks Development Manager Headley recognized the selection committee and introduced Tom Howard and Isabel Jewell and thanked Lani Yoshimura for her assistance. Pub.Hearing LLEBG The Mayor stated it was the time and place scheduled for a Public Hearing on a request to consider a report from the Gilroy Police Department recommending projects/programs for funding under the State Law Enforcement Grant monies for the 2000-01 Fiscal Year, and the Federal Local Law Enforcement Block Grant (LLEBG) monies for the 1999-2001 Fiscal Years. The staff report was noted and further explained by the City Administrator and Police Chief Giusiana. The Mayor opened the Public Hearing. Amos Brown stated that this money should not be granted, as they have not proved that they need it. The Mayor closed the Public Hearing. Motion was made by Councilman Morales, seconded by Councilman Pinheiro and carried to accept the funding for projects/programs as recommended. 7/' o r" '\ .,' Sunrise Drive The Mayor noted residents concerns regarding Sunrise Drive speeding and motorists not stopping at the stop signs in place at Sunrise Drive and Kite Drive. Pam Charron, 1491 Sunrise Drive, stated that the "problem vehicles" are only 20% of the vehicle load. She commented that there are 30 small children between Kite Drive and Rancho Hills Drive. She requested speed calming measures be implemented. Mike Park thanked the Council for the implementation of the stop sign, but stated that vehicles are not stopping at it. He stated that this is not necessarily an enforcement issue, but that he would like to have more of a Police presence on Sunrise Drive. He commented that this is more of a design issue. He requested more speed signage and suggested speed lumps be placed on the street and possibly a median or chicane. Dwayne Carpenter, Sunrise Drive, stated that speed is a problem. Keith Price, Sunrise Drive, commented that the street is too wide. He stated his concern that a child or parent is going to be hit by a car. He explained that he doesn't want the Police Officers out on Sunrise Drive writing tickets, but rather something done to the roadway to make it safer. Todd Avey, Sunrise Drive, stated that he would be worried ifhe had children. He commented that vehicles would not have time to brake if a child ran into the street. Jeff Stainton, Sunrise Drive, reaffirmed everyone else's feelings. He stated that no one pays attention to stop signs, and that too often it takes a tragedy for something to be done. He commented that some low cost measures can be taken. It was requested that Staff come back with suggestions at the October 16 or November 6,2000 meeting. Pam Charron and Barbara Park requested to be the persons to contact on this issue. 2000 Emergency The Mayor noted a resolution of the Council of the City of Gilroy adopting the Operations 2000 Emergency Operations Plan. Plan The City Administrator reviewed the 2000 Emergency Operations Plan. Chief Gillespie and Acting Fire Division Chief Bozzo commented on the SEMS plan that this is based on. (At 8:28 p.m. Councilman Sudol left the Council Chambers, and returned at 8:30 p.m.) Res.2000-68 Motion was made by Councilman Sudol, seconded by Councilman Morales and carried to adopt Resolution No. 2000-68 adopting the 2000 Emergency Operations Plan. Motion was made by Councilman Pinheiro, seconded by Councilman Morales and carried to direct staff to prepare an ordinance revising Chapter 9 of the City Code. The Mayor noted a recommendation to amend Section 19. 102 of the City Code regarding Sewers and Sewage Disposal-Prohibited Wastes. The City Administrator explained the local limits for commercial and industrial users and the need to periodically update the local limits study and set new limits. Motion was made by Councilman Morales, seconded by Councilman Pinheiro and carried (Councilmember G. Arellano voting no) to direct staff to prepare revisions to City Ordinances and City Codes reflecting the change in the Local Limits for the sewer system. The minutes of the Personnel Commission meeting of August 14, 2000 were 8-14-00 noted. The City Administrator distributed a list of meetings and times. He distributed background information for next Monday's meeting on the cost analysis study. The Mayor questioned whether the Council would consider taking positions on the ballot issues for November. The consensus of the Council was to not take positions. He stated that he will be unable to attend the ABAG General Assembly on Thursday and Friday this week in San Francisco, and requested a volunteer to go from the Council. No Councilmember was available to attend. He reminded everyone to register to vote. He commented on the Oakland As game that he attended on Saturday, and congratulated the As for winning their division. Council Chairs Councilmember G. Arellano reported on the purchase of new chairs for the Council Chambers, and the need for additional funds. She stated that she will continue to research the purchase. Councilmember G. Arellano stated that it is Breast Cancer awareness month and reminded all women to get a mammogram. Councilman Pinheiro requested staff look into the issue of the furniture on downtown sidewalks. He requested the City approve a sister city from Portugal, and stated that he will provide information for a future agenda item. Councilman P. Arellano commented on Breast Cancer Awareness Month, and requested all women to use self examination monthly. Councilman Morales noted that he had talked to residents regarding the chip seal program. Councilman Velasco commented that the Tee Off for Youth golf tournament was held last Friday, and that he will provide a more detailed report at the next meeting.
