RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
APPROVING AND ADOPTING THE REGISTRAR OF VOTERS' CANVASS
OF THE SPECIAL MUNICIPAL ELECTION AND DECLARING RESULTS
OF SUCH ELECTION HELD IN THE CITY ON NOVEMBER 7, 2000.
RESOLVED, by the City Council of the City of Gilroy, California that;
WHEREAS, by order of this Council a special municipal election was held and
conducted in the City of Gilroy and consolidated with the Statewide Presidential
General Election, on Tuesday, the 7th day of November, 2000 as required by law
and the Charter of said City as amended; and
WHEREAS, it appears that notice of said special election was duly and legally
given; voting precincts were properly established; election officers were appointed
and election supplies furnished; and in all respects the election was held and
conducted and the votes cast thereat received and canvassed, and the returns
thereof made, determined and declared in time, form and manner as required by the
Charter of said City as amended and the general laws of the State providing for
and regulating municipal elections in said City; and
WHEREAS, the Registrar of Voters did conduct the canvass of the returns of said
municipal election and did count the absentee ballots cast thereat, pursuant to
direction and order of the City Council of said City; and
WHEREAS, said canvass was duly completed and the results thereof were
certified by the Registrar of Voters and submitted to this Council.
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, as
follows:
1. Said municipal election was held and conducted in the City of Gilroy, County of
Santa Clara, State of California and consolidated with the Statewide Presidential
General Election held throughout Santa Clara County on Tuesday, November 7,
2000 in the time and in the form and manner as required by law.
2. That there were established twenty-three (23) voting precincts for the purpose
of holding said municipal election.
3. The canvass of the returns of the votes cast and the counting of absentee ballots
cast in said City for Measures Q and R was duly held by the Registrar of Voters in
accordance with the order of the Council and in accordance with law and said
Registrar of Voters has executed a certificate certifYing to the results of such
canvass, which certificate is hereto attached, marked Exhibit "A" and by this
reference is made a part hereof. Said certificate has been examined and is hereby
approved and adopted by this Council as the official canvass of said municipal
election.
4. The whole number of votes cast in said City of Gilroy at said municipal election
was 11,644 (including 2,339 absentee votes).

5. The measures voted upon, the number of votes received in favor of and against
said measures in each of said precincts and by absentee votes, together with the
whole number of votes which the measures received in the entire city, are shown
on said Exhibit" A", hereto attached.
6. At said municipal election certain measures failed to wit:
Q TRANSIENT OCCUPANCY TAX. Shall the ordinance of the City of
Gilroy authorizing the increase in the rate of the City's existing Transient
Occupancy Tax from 9% to 10% be approved?
R ADMISSION TAX. Shall the Admission Tax Ordinance of the City of
Gilroy authorizing the enactment and imposition of a new general tax in the
form of an admission tax of 5% of the Admission charge for certain events held
within the City of Gilroy be approved?
7. That the City Clerk be, and she is hereby, instructed to enter this resolution in
full in the minutes of this Council as a statement of the result of said special
municipal election.

The Mayor stated it was the time and place scheduled for a Public Hearing to
establish the City of Gilroy Community Facilities District No. 2000-1 (Highway
152) under the Mello-Roos Community Facilities Act of 1982, as amended to
provide for the financing of the construction and/or acquisition of certain public
street and highway improvements to be financed through the imposition and levy
of a special tax to be apportioned on the properties in the District on property
generally located between Highway 101 and Llagas Creek, on the north and south
sides of Highway 152.
The Mayor asked if there were any property owners or registered voters in the
District who wished to file written protests. He acknowledged that no written
protests were filed.
The staff report/Community Facilities District Report was noted and further
explained by Administrative Services Director Dorn.
The Mayor opened the Public Hearing. There being no comment from anyone
in the audience, the Mayor closed the Public Hearing.
Steve Casaleggio, Bond Counsel, explained that the City incurs bonded
indebtedness on behalf of the property owners. He stated that the City is not liable
for the debt, but rather the property involved is liable. He reviewed the bond
reserve fund.

the Ordinance adopting an Ordinance of the City Council of the City of Gilroy
Levying Special Taxes Within Community Facilities District No. 2000-1 (Highway
152).
The Mayor stated it was the time and place scheduled for a Public Hearing on
a request to consider a report by the Gilroy Police Department recommending
projects/programs for funding under the Federal Local Law Enforcement Block
Grant (LLEBG) monies for the 2000-2002 Fiscal Years.
The staff report was noted and further eXplained by Chief Giusiana.
The Mayor opened the Public Hearing, There being no comment from the
audience, the May~r closed the Public Hearing.
Motion was made by Councilman Sudol, seconded by Councilman Pinheiro
and carried to accept the funding for projects/programs as recommended.
The Mayor stated it was the time and place scheduled for a Public Hearing on
a Zone Change request to change the City of Gilroy Zoning Map from Al
(Agriculture) to R3-PUD (Medium Density Residential-Planned Unit
Development) on approximately 22.3::1:: acres ofland located at the southeast
corner of Santa Teresa Boulevard and Hecker Pass Highway. Coastal Rim
Properties, applicant, Z 00-07.
It was noted that the location of the project is at the southwest corner, not the
southeast corner, of Santa Teresa Boulevard and Hecker Pass Highway.
Acting City Attorney Faber stated that Councilman Velasco can vote on this
continuance, since it would not fall under a conflict of interest.
Motion was made by Councilman Sudol, seconded by Councilman P. Arellano
and carried to continue the Public Hearing to January 16,2001 due to continuance
by the Planning Commission,
The Mayor stated it was the time and place scheduled for a Public Hearing on
a Tentative Map request to subdivide approximately 22.3::1:: acres ofland into a 13-
lot residential (senior housing) subdivision on property proposed for rezoning from
Al (Agriculture) to R3-PUD (Medium Density Residential-Planned Unit
Development) located at the southeast corner of Santa Teresa Boulevard and
Hecker Pass Highway. Coastal Rim Properties, applicant, TM 00-08.
Motion was made by Councilman Sudol, seconded by Councilman Morales and
carried to continue the Public Hearing to January 16, 2001 due to continuance by

Motion was made by Councilman Morales, seconded by Councilman Sudol and
carried to introduce the Ordinance amending Chapter 20 of the Gilroy Municipal
Code regarding "Right-of-Way Encroachments".
Investment Policy The Mayor noted a request for adoption of the City of Gilroy Investment
For 2001 Policy for 2001.
The City Administrator stated that this is the yearly process for review of the
City of Gilroy Investment Policy. Administrative Services Director Dorn reviewed
the Investment Policy for 2001.
Motion was made by Councilman Sudol, seconded by Councilman Velasco and
carried to adopt the City of Gilroy Investment Policy for 2001.
Bd./Com. The Mayor noted discussion for appointments of Board Members and
Appointments Commissioners for terms expiring December 31, 2000 and unexpired vacancies.
Motion was made by Councilman Sudol, seconded by Councilmember G.
Arellano and carried to accept with regrets a letter of resignation from Paul
Kloecker, Physically Challenged Board of Appeals.
By consensus, the Council agreed to appoint Leonard C. Pugh to the Arts and
Culture Commission, Edward Merrell and Victor Valdez, Jr. to the Library

Motion was made by Councilmember G. Arellano, seconded by Councilman
Morales and carried to appoint Paul A. Correa to the Planning Commission.

Motion was made by Councilman G. Arellano, seconded by Councilman
Pinheiro and carried (Councilman Sudol absent) to set February 2,2001 at 5:00
p.m. as the deadline to receive applications for those board and commission
vacancies not filled, set February 12,2001 at 6:00 p.m. for interviews, and set
February 20,2001 for appointments.

The minutes of the Parks & Recreation Commission meeting of November 14,

The minutes of the Senior Advisory Board meeting of November 20,2000
were noted.
The minutes of the Youth Commission meeting of November 28,2000 were
noted.
The City Administrator distributed sign ordinance information as requested.
He distributed Council retreat topics.
Hecker Pass The Mayor noted a request for clarification on the Hecker Pass Specific Plan
Specific Plan process.
The City Administrator stated that questions have been received from citizens
regarding what the City's role should be in the Hecker Pass Specific Plan process
now that the City has a financial interest in it. He distributed a letter from
Ruggeri-Jensen-Azar and Associates, clarifYing the Hecker Pass Property Owners
Association's intent to make the Hecker Pass Specific Plan an open public process
requiring community participation.
Councilman Velasco recused himself from discussion and vote on this issue
due to the proximity of his residence to this area, and stepped down from the dais.
Ernie Filice, representing his family's trust in this process, stated that he knows
that there is a stake by the City of Gilroy. He noted that his group is aware of
what is required for this process.
Councilmembers G. Arellano and Pinheiro requested to be a part of the
committee.

The Mayor noted that the Council consensus was that the Council requests the
property owners follow a process for open meetings, that no more than three
Councilmembers will attend the meetings to ensure that the process is followed,
and that the City Council does not have to approve the make up of the committee.
Councilman Velasco returned to his seat at the dais.
The City Administrator noted that the January 17,2001 meeting has been
moved to January 22, 2001 regarding the RDO study session. He wished the
community a nice holiday season.
Acting City Attorney Faber reported on litigation regarding the City's actions
on the City Plaza project, noting that the court found in favor ofthe City, that the
City acted properly.
The Mayor noted that a donation of$1,700.00, the residual from the Measure
M Committee campaign, has been donated to the Family Resource Center on
behalf of the City Council and firefighters. He asked that the community share
with another member ofthe community.
Councilman P. Arellano noted that a Martin Luther King Jr. Association
chapter has opened in Gilroy. He stated that tickets are available for the January
15,2001 Freedom Train from San Jose to San Francisco, which will start in
Gilroy. He stated that round trip tickets are available for $5.00. He explained that
the train will leave Gilroy at 7:00 a.m. to arrive in San Jose, which will then leave
at 10:30 a.m. for San Francisco.
Councilman Morales wished everyone a Merry Christmas and Happy New
Year. He noted the Salvation Army is looking for donations and contributions as
well as St. Joseph's Center.
Councilman Velasco wished everyone a happy holiday season and noted that
he looks forward to next year.
Councilmember G. Arellano wished everyone Happy Holidays and Avoid the
