Minutes 2001/11/09 7808 Meeting November 9,2001 Gilroy, California The Mayor called the meeting to order. Roll Call Present: Councilmembers: Guadalupe Arellano, Peter D. Arellano, Charles S. Morales, Al Pinheiro, Anthony C. Sudol III, Roland Velasco, and Thomas W. Springer - 12:30 p.m. The Mayor stated that the Council would adjourn to closed session regarding Public Employee Performance Evaluation for the City Administrator, pursuant to Government Code Section 54957. The Mayor reconvened the meeting and announced that no action had been taken. At 2:00 p.m., the Mayor announced that the City Attorney requested an additional matter be agendized pursuant to California Government Code section 54954.2(b)(3), which allows for such an action when there is a need to take immediate action on an item, and the matter came to the City's attention subsequent to the posting of this agenda. The City Attorney explained that the matter is whether to intervene in the lawsuit filed with the Supreme Court of California on behalf of the petitioners from Morgan Hill challenging the redistricting of South County, and that her office had been told by a clerk of the Supreme Court that any such petition for intervention should be filed immediately. The City Council then voted unanimously to add the matter to the agenda. Adjournment At 2:05 p.m. the Mayor adjourned the meeting to a closed session pursuant to Government Code Section 54956.9(c): CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION One potential case. Dennis Kennedy, Steve Tate, Larry Carr, petitioners v. Gray Davis, et ai, in the Supreme Court of California. Thereafter, the Mayor reconvened the meeting and announced that the City Council directed that a Petition to Intervene be filed on behalf of the Mayor and City Councilmembers in the lawsuit known as Dennis Kennedy, Steve Tate, Larry Carr, petitioners v. Gray Davis, et ai, in the Supreme Court of California regarding redistricting for the Assembly, Senate and Congressional districts, and further adjourned the meeting at 2:35 p.m. Respectfully submitted, ;r i~- '. ;' // !
