Minutes 2002/03/11 7870 Posting Agenda Roll Call GPA 99-01 Special Meeting March 11, 2002 Gilroy, California The Mayor announced that tomorrow at 3:00 p.m. and 7:00 p.m. at the Civic Center in the Council Chambers, the VT A will be holding two special meetings to survey citizens on fare increases and service reductions which would take effect July 1,2002. He also stated that the beginning ofthe application period for the Citizens Advisory Committee (CAC) has begun for the Redevelopment Agency area for the downtown. He noted that if citizens want to apply to be on the CAC, they must live in the City limits or own property or a business in the City limits. He stated that applications are available in City Hall. He also noted that on the agenda tonight is the issue regarding adoption of the Parks and Recreation Master Plan. He stated that staff needs additional time to work on responses to the EIR, and the Council will not be certifying the EIR tonight but rather at a future meeting. He commented that the Parks & Recreation Master Plan cannot be adopted tonight, but rather after the EIR has been certified. The Mayor led the Pledge of Allegiance to the Flag. The City Clerk noted that the agenda had been posted on March 6, 2002 at 11:45 a.m. Present: Councilmembers: Peter D. Arellano, Robert T. Dillon, Craig Gartman, Charles S. Morales, Al Pinheiro, Roland Velasco, and Thomas W. Springer - 6:34 p.m. The Mayor noted a continued Hearing on the General Plan Update. The proposed 2001 Update of the City of Gilroy's General Plan document is the first comprehensive update of the General Plan since its initial adoption in November, 1979. The proposed 2001 General Plan Update provides a guide for the physical development of the City, and brings the Plan into conformance with changes in State law and other legal requirements; reflects changes in the local population and economy since 1979; incorporates the most recent projections and assumptions regarding future growth; responds to the issues, challenges and opportunities created by recent trends and developments. The proposed 2001 General Plan Update includes goals, policies and programs regarding State-mandated general plan elements (Land Use, Circulation, Housing, Open Space, Conservation, Safety, and Noise), and "optional elements" (Agriculture, Air Quality, Cultural Facilities, Economic Development, Growth Management, Historic Preservation, Parks and Recreation, Scenic Highways, Schools, and Water Supply and Quality) to the year 2020. City of Gilroy, applicant, GPA 99-01. The City Administrator stated that he and Planning Division Manager Faus will facilitate the Council discussions regarding questions in relation to issues on the General Plan update. Planning Division Manager Faus reviewed the Primary Issues of the 660 site, including the two elements that the Planning Commission recommended regarding a condition that 65% of the Campus Industrial uses, west of Highway 101, be developed and occupied, prior to development of the 660 site, and also regarding incorporating the Campus Industrial Specific Plan Policy within the General Plan. Motion was made by Councilman Morales, seconded by Councilman Gartman and carried to reject Option #1 of the Primary Issues that the 660 site be incorporated into the General Plan with a condition that 65% of the Campus Industrial and/or industrial uses, west of Highway 101, are developed and occupied, prior to development of the 660 site. Motion was made by Councilman Pinheiro, seconded by Councilman Dillon and carried (Councilmembers Arellano and Morales voting no) that this development must bear all on and off site infrastructure costs of development within the City limits and Sphere, but not regional issues, as noted in the traffic circulation element. 7871 (At 8:03 p.m. Councilman Dillon left the Council Chambers, and returned at 8:05 p.m.) (At 8:05 p.m. Councilman Morales left the Council Chambers, and returned at 8:06 p.m.) Motion was made by Councilman Pinheiro, seconded by Councilman Gartman and the motion did not carry (Councilmembers Arellano, Morales, Velasco, and Springer voting no) to not include the Campus Industrial Specific Plan Policy (Exhibit A) into the General Plan. Motion was made by Councilman Morales, seconded by Councilman Velasco and carried (Councilmembers Dillon and Gartman voting no) to include the Campus Industrial Specific Plan Polic,(Exhibit A) into the General Plan, with #E. changed to read: Potential traffic circulation element impact and mitigations. The Council discussed the Secondary Issues relating to the General Plan, and took actions on each as noted below. Motion was made by Councilman Pinheiro, seconded by Councilman Gartman and carried (Councilmembers Arellano and Morales voting no) to incorporate the 1 st, 2nd, and 3rd Errata Lists for General Plan issues. Motion was made by Councilman Morales, seconded by Councilman Gartman and carried to incorporate the Michael Bonfante amendment, involving approximately 32 acres to include the area within the Hecker Pass Specific Plan. Motion was made by Councilman Pinheiro, seconded by Councilman Dillon and the motion did not carry (Councilmembers Arellano, Gartman, Morales, and Springer voting no) to change back to residential approximately 70.7 acres west of Rancho Hills Drive. (At 8:33 p.m. Councilman Pinheiro left the Council Chambers, and returned at 8:35 p.m.) (At 8:35 p.m. Councilman Gartman left the Council Chambers, and returned at 8:39 p.m.) (At 8:44 p.m. Councilman Dillon left the Council Chambers, and returned at 8:46 p.m.) Motion was made by Councilman Pinheiro, seconded by Mayor Springer and carried (Councilmembers Arellano and Morales voting no) to encompass the changes discussed, including the area from Buena Vista on the north side will be designated Commercial, north of that will be designated Rural Residential as far north as Masten Avenue, the area from Buena Vista on the south will remain designated as Industrial Park, with a friendly amendment to re-designate to Rural Residential seven parcels on the north and south side of Cohansey Avenue east of Monterey Road. (At 9:26 p.m. Councilman Arellano left the Council Chambers, and returned at 9:28 p.m.) Motion was made by Councilman Dillon, seconded by Councilman Pinheiro and carried (Councilman Arellano absent) to delineate the City's Urban Service Area (USA) line on the General Plan Land Use Map. At 9:27 p.m. the Mayor called a five minute recess, after which he recalled the meeting to order. Motion was made by Councilman Pinheiro, seconded by Councilman Dillon and carried (Councilman Arellano voting no) to direct staff to not re-designate Bonfante Gardens as "PF" (Public Facility) at the present time, to leave the designation as it is for now and look at the possibility in the future to change to "PF" . l i 7872 Parks and Recreation Master Plan Adjournment Motion was made by Councilman Pinheiro, seconded by Councilman Gartman and carried to refer back to the Planning Commission an amendment to re-designate the McCormick parcel, located at Santa Teresa Boulevard & Miller Avenue to the highest and best land use designation, and that the property owners be notified. At 10:07 p.m. Councilman Gartman left the Council Chambers, and returned at 10:08 p.m.) Motion was made by Mayor Springer, seconded by Councilman Pinheiro and carried to re-tract the 20-year boundary, presently proposed to be moved to the ridge line west of Eagle Ridge, back to the border of the Eagle Ridge open space boundary, as delineated in the current General Plan. Motion was made by Councilman Gartman, seconded by Councilman Dillon and carried (Councilmembers Arellano and Morales voting no) to designate all roadways east of Highway 101 as LOS (Level-of-Service) "D". The Council agreed to continue this item to April 22, 2002 at 6:30 p.m. The Mayor noted adoption of the Parks and Recreation Master Plan. This item was continued to April 22, 2002.
