Minutes 2002/06/03 7916 Posting Agenda Roll Call Regular Meeting June 3, 2002 Gilroy, California The Mayor led the Pledge of Allegiance to the Flag. The City Clerk noted that the agenda had been posted on May 29,2002 at 2:40 p.m. Present: Councilmembers: Robert T. Dillon, Craig Gartman, Charles S. Morales, Al Pinheiro, Roland Velasco, and Thomas W. Springer; Absent: Councilmember Peter D. Arellano (excused) - 7:02 p.m. The Mayor noted that after the Arts & Culture Commission report, he would move forward Item X.A.l., and then Item VIII.B. would follow that item. He noted that Councilman Dillon would recuse himself on Item v.A. New Employee The Mayor introduced new employee Ruben Landeros, Multi-Service Officer, Police Department. Emp. Award Vol. Award Proc. - Italian Republic Charter Com. Consent Calendar Budget Minutes The Mayor presented the Employee Award for the Month of May, 2002 to Nina Sheleman, Property and Evidence Technician, Police Department. The Mayor presented the Volunteer of the Month of May, 2002 award to Vickie Seaton, Fire Department. The Mayor noted a proclamation for the 56th Anniversary of the Founding of the Italian Republic - June 6, 2002. The Mayor noted an update by Dan McGough on the Charter Communications upgrade. The Mayor asked if there was anyone in the audience wishing to speak on any item not on the agenda. There was no comment from anyone in the audience. Motion was made by Councilman Morales, seconded by Councilman Dillon and carried that the following items under the Consent Calendar be approved, by the following Roll Call Vote: Ayes: Councilmembers: Robert T. Dillon, Craig Gartman, Charles S. Morales, Al Pinheiro, Roland Velasco, and Thomas W. Springer; Absent: Councilmember Peter D. Arellano: Budget Amendments/Transfers as recommended; and Minutes of the Regular Council Meeting of May 20, 2002; Arts & Culture Donna Pray, Chairperson, Arts and Culture Commission reviewed the last six months arts and culture activities in Gilroy, including the production "Red, Blonde, and Blue", the Young Artists Show, and Kids Discover Arts. She noted they kicked off the summer concert series last night. She commented on the progress on the new Cultural Facility. The Mayor deviated from the regular order of the agenda to accommodate interested persons in the audience. Public Art The Mayor noted a recommendation for approval of the proposed public art Mural Project mural concept. Donna Pray introduced Arline Silva, Chairperson of the Public Arts Committee (P AC), who in turn introduced Richard Young and Julie Franco, two other members of the PAC present for tonight's presentation. She reviewed the activities ofthe PAC for outreach for the public art mural project. She requested that the Council approve the concept design and approve the artist contract. 7917 Richard Young reviewed one of three proposed panels for the mural at Seventh and Monterey Streets, which will include murals from the "Past, Present, and Future". Motion was made by Councilman Velasco, seconded by Councilman Dillon and carried (Councilman Arellano absent) to approve the proposed public art mural concept, with the additional two panels to be reviewed by the City Council. Andrea Habing reviewed the budget for the PAC mural. Motion was made by Councilman Morales, seconded by Councilman Dillon and carried (Councilman Arellano absent) to approve the budget for the PAC mural and that the City will match the funds dollar for dollar that the PAC raises, up to $4,500.00. NS 02-10 The Mayor noted a Planned Unit Development Architectural & Site Review request to construct a 148,663 square foot wholesalelretail building on 15.11 acres, and to request additional sign area, on property zoned C3-M2IPUD (Shopping Center Commercial-General IndustrialIPlanned Unit Development), located at 7251 Camino Arroyo. Costco Wholesale Corp., applicant, NS 02-10. The staff report was noted and further explained by Planner II Casper. David Rogers stated that they plan to bring a state of the art facility to Gilroy. He stated that they will bring 200 new jobs, 50% to be full-time employees. He stated that Costco is very involved in the community. He noted that he appreciated the assistance by staff. David Babcock noted that most commercial centers use 15 gallon box trees and one gallon shrubs, but that their plans are to use 24 gallon box trees and 5 gallon shrubs. He committed to consider working with the Police and Fire Departments with their radio system. Motion was made by Councilman Dillon, seconded by Councilman Morales and carried (Councilman Arellano absent) to direct staff to prepare a resolution approving NS 02-10, amending the wording of conditions #23 and #37 and to include the commitment to consider working with the Police and Fire Departments with their radio system. The Mayor returned to the regular order of the agenda. Bid-Custodial The City Administrator presented a recommendation to award the bid for the Services Custodial Services Contract (02-ASD-548) to Cleaning Services of Gilroy in the amount of $272,744.00 (originally $297,553.00). Councilman Dillon recused himself from discussion and vote on this item, due to a conflict of interest, and stepped down from the dais. Motion was made by Councilman Gartman, seconded by Councilman Morales and carried (Councilmembers Arellano and Dillon absent) to award the bid for the Custodial Services Contract (02-ASD-548) to Cleaning Services of Gilroy in the amount of $272,744.00. Councilman Dillon returned to his seat at the dais Pub.Hearing Civic Center The Mayor stated it was the time and place scheduled for a Public Hearing on a review of the six phases of the Civic Center Master Plan, and specifically the location and site design for the Gilroy Public Library; and the CEQA Initial Study for the Civic Center Master Plan. City of Gilroy, applicant, M 01-11. The staff report was noted and further explained by Planner I Polubinsky. Larry Wolff reviewed the formulation of the Civic Center Master Plan complex. 7918 The Mayor opened the Public Hearing. Ruth Sacco asked whether Seventh Street would be closed, and was told that it would not be closed. The Mayor closed the Public Hearing. Motion was made by Councilman Morales, seconded by Councilman Dillon and carried (Councilman Arellano absent) to approve the Mitigated Negative Declaration, finding that (a) it is completed in compliance with CEQA; (b) it reflects the independent judgment of the City; and ( c) there is no substantial evidence that the project will have a significant effect on the environment. Res.2002-39 Motion was made by Councilman Dillon, seconded by Councilman Morales and carried (Councilman Arellano absent) to adopt Resolution No. 2002-39 approving MOl-II, an application for approval of the Civic Center Master Plan, covering approximately 14 acres, APN s 799-17-043, 799-17-044, 799-17-045, 799-17-066, 799-17-069, 799-17-070, 799-08-054 and 799-08-058. RESOLUTION NO. 2002-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING M 01-11, AN APPLICATION FOR APPROVAL OF THE CIVIC CENTER MASTER PLAN, COVERING APPROXIMATELY 14 ACRES, APNS 799-17-043, 799-17-044, 799-17-045, 799-17-066, 799-17-069, 799-17- 070, 799-08-054 AND 799-08-058. Hearing Z 01-09 The Mayor stated it was the time and place scheduled for a Public Hearing on a Zone Change request to amend the City of Gilroy Zoning Map from Rl (Single Family Residential) designation to PF (Public Facility) on five Dowdy Street lots of approximately .88 acres (owned by the City of Gilroy), and overlay the Planned Unit Development (PUD) zoning designation across the entire Civic Center complex, on property located between Church and Dowdy Streets, and Sixth and Seventh Streets to allow for PUD design flexibility in the proposed Civic Center complex. A/S 02-05 The Mayor noted a Planned Unit Development Architectural & Site Review approval for a new 53,231 square foot library facility to be constructed on the existing library site, located at 7387 Rosanna Street. City of Gilroy, applicant, A/S 02-0'5 The staff report was noted and further explained by Planner I Polubinsky and Facilities & Parks Development Manager Headley. Com. 5-23-02 7919 (At 8:45 p.m. Councilman Dillon left the Council Chambers, and returned at 8:47 p.m.) Motion was made by Councilman Morales, seconded by Councilman Velasco and carried (Councilman Arellano and Dillon absent) to direct staff to prepare a resolution approving AlS 02-05. The Mayor returned to the regular order of the agenda. The Mayor stated it was the time and place scheduled for a Public Hearing on a Zoning Ordinance text amendment to Section 50.60 to add an RDO exemptiQn for transitional housing units. City of Gilroy, applicant, Z 02-02. - - - Motion was made by Councilman Dillon, seconded by Councilman Gartman and carried (Councilman Arellano absent) to continue the Public Hearing to June 1 7, 2002 due to staff scheduling. The Mayor noted a letter of resignation from Evangeline Moniz, Public Art Committee member Motion was made by Councilman Morales, seconded by Councilman Dillon and carried (Councilman Arellano absent) to accept the resignation with regrets. Motion was made by Councilman Dillon, seconded by Councilman Morales and carried (Councilman Arellano absent) to open a 90 day application period. The following informational items were noted with no separate discussion on same: Legislation: Letter to Assembly Member Roderick Wright in opposition to AB 1866; and Letter to Assembly Member John Dutra in opposition to AB 2292. Customer Service: Email of thanks from Tish Fallis to Rick Brandini, Randy Newell, and Bob Bozzo for assistance in moving paper boxes; and Letter of thanks from Bill Lindsteadt to Jay Baksa for attending the 6th Annual Partnership Luncheon. Informational items: Email from Jan Kersten, Holland, noting that our web site is nice and informative; and Notice of filing of applications for gas and electric revenue increases: Cost of Capital (COC), and Annual Earnings Assessment (AEAP) for Pacitic Gas and Electric Corn.pany (PG&E). The minutes of the Arts and Culture Commission meeting of May 14, 2002 were noted. The report of the Planning Commission meeting of May 23,2002 was noted. The City Administrator noted that the joint City Council/Planning Commission mini-retreat scheduled for June 10 had been cancelled He commented that Thursday, June 13, LAFCO will hold a hearing on the Sports Complex from 1:15 to 2:00 p.m. Councilmembers Dillon, Gartman and Springer stated that they would attend, as well as City Attorney Callon. The City Administrator stated that he would set up a meeting to discuss the item prior to June 13. 7920 Full Spectrum The Mayor noted a memorandum from the Director of Community Machining Development denying an Economic Incentive request for Full Spectrum Machining. The staff report was noted and further explained by Community Development Director Allen Craig Filice stated that Full Spectrum Machining plans to purchase the building, but only occupy one-half of the building. He noted that the company is expanding their use. Motion was made by Councilman Morales, seconded by Councilman Dillon and carried (Councilman Arellano absent) to continue this item to June 17, 2002 at the request of the applicant. The Mayor advised the City Council that VT A is considering placing a measure on the Novemher 2002 ballot for the formal endorsement of the VTP 2020 program which includes the roadway improvements for Gilroy. He noted that this would be an opportunity to apply any future Measure B funds that expire by the year 2006, should there be any left over, to some additional roadway improvements, and that there is a small possibility that Gilroy might receive some of tllose futlds.
