Councilman Velasco recused himself from discussion and vote on the following
item due to absence at that meeting, and stepped down from the dais.
Motion was made by Councilman Dillon, seconded by Councilman Morales
and carried (Councilman Velasco absent) to approve the minutes of the Regular
Council Meeting of November 4,2002.
Councilman Velasco ret.urned to his seat at the dais.
Sherrean Carr, Chair of the Physically Challenged Board of Appeals, thanked
staff for working with the Board. She reviewed the mission and structure of the.
Board, noting that they are looking to add alternate members. She reviewed the>
top 5 critical issues that the Board will review. She acknowledged the other
members of the Board.
The Mayor stated it was the time and place scheduled for a Public Hearing on
a Zone change request from C3-PUD, M2 and HC (Shopping Center Commercial-
Planned Unit Development, General Industrial and Highway Commercial), to
C3/HC/M2-PUD (Shopping Center CommerciallHighway Commercial/General
Industrial-Planned Unit Development), on property located at the southeast corner
of Highways 101 and 152. Regency Realty Group, Inc., applicant, Z 02-06.
Motion was made by Councilman Morales, seconded by Councilman Gartman
and carried to continue this item to December 2, 2002 due to continuance by the
Planning Commission.
The Mayor stated it was the time and place scheduled for a Public Hearing on
a Tentative Map request to subdivide 75.45 acres into 16 commercial and
industrial lots, on property located at the southeast corner of Highways 101 and
152. Regency Realty Group, Inc., applicant, TM 02-06.
Motion was made by Councilman Morales, seconded by Councilman Gartman
and carried to continue this item to December 2, 2002 due to continuance by the
Planning Commission.
The Mayor stated it was the time and place scheduled for a Public Hearing on
approval of a Development Agreement for Regency Realty Group, Inc., applicant,
M 02-13.
Motion was made by Councilman Morales, seconded by Councilman Gartman
and carried to continue this item to December 2, 2002 due to continuance by the
Planning Commission.
The Mayor stated it was the time and place scheduled for a Public Hearing on
a Tentative Map request to create 250 lots (247 lots and 3 remainder parcels), on
property zoned R1/PUD (Single Family ResidentiallPlanned Unit Development),
located at the northwest corner of Santa Teresa Boulevard and Sunrise Drive.

and carried to continue this item to December 16, 2002 due to continuance by the

The Mayor stated it was the time and place scheduled for a Public Hearing on
a Tentative Map request to subdivide 8.35 acres into 9 industrial lots, on property
zoned M1 (Limited Industrial), located at the southeast corner of Las Animas
Avenue and Monterey Road. Lloyd Martin, applicant, TM 02-03.
Motion was made by Councilman Arellano, seconded by Councilman Gartman
and carried to continue this item to December 2, 2002, due to additional
information requested from the Traffic Engineer.

CFD 2002-1 The Mayor noted a Resolution supplementing Resolution No. 2000-91, "A
Resolution authorizing the issuance of special tax bonds, and approving and
authorizing related documents and actions." City of Gilroy Community Facilities
District No. 2000-1 (Highway 152).
The staff report was noted and further explained by the City Administrator.
Motion was made by Councilman Dillon, seconded by Councilman Morales
and carried to adopt Resolution No. 2002-81 supplementing Resolution No. 2000-
91, "A Resolution authorizing the issuance of special tax bonds, and approving and
authorizing related documents and actions." City of Gilroy Community Facilities
District No. 2000-1 (Highway 152).

The Mayor noted a request to allow properties located at 7590 Princevalle
Street (Michael and Bente Hewitt, applicants, MA 01-02); 7405 Eigleberry Street
(Linda Ramirez, applicant, MA 02-02); and 7560 Monter~y Street (La rue Trust
c/o Jeffery & Pamela Martin, applicants, MA 02-03) to enter into a Mills Act
property tax r~f contract with the City of Gilroy.
The staffr~~(U1: was noted and further explained by Planner II Durkin.
Bente Hewitt, 7590 Princevalle Street, questioned whether the yearly amounts
can be banked and told that they could be.
Motion was made by Councilman Velasco, seconded by Councilman Morales
and carried to approve entering into a Mills Act property tax relief contract with
the City of Gilroy, Michael and Bente Hewitt, applicants, MA 02-01, subject to
two conditions.

The Mayor noted that Item IX.B.3 is agendized for Planning Commission
action on November 21,2002. It was noted that if the Council had concerns
regarding the approval, the application could be appealed to the Council.

Staff Report on the Village Green Conditional Use Permit (CUP 02-08) to

The minutes of the South County Regional Wastewater Authority meeting of
October 22, 2002 were noted.
The report ofthe Arts and Culture Commission meeting of November 12,
2002 was noted.
The Mayor noted an appointment to the vacant position on the Public Arts
Committee.
Motion was made by Councilman Pinheiro, seconded by Councilman Dillon
and carried to appoint Trudie Conrotto to the vacant position on the Public Arts
Committee.
Proposed Rev. The City Administrator noted proposed revisions to LAFCO policies.
LAFCO Policies
Power Task The City Administrator noted a request to create three small "Power Task
Force Groups Force" groups to work on Planning Division issues.
The Mayor requested that on the Agricultural Mitigation Task Force that the
Chamber of Commerce be changed to the Land Trust, and on the Downtown
Specific Plan Task Force that the Hispanic Chamber be added to the list. It was
also agreed that an additional citizen at large be added to each task force.
Motion was made by Councilman Velasco, seconded by Councilman Morales
and carried to create the three Power Task Forces as modified. For the
Agricultural Mitigation Measure Policy Power Task Force, the application
deadline will be December 5, 2002 at 5:00 p.m., with interviews on December 9,

2002 at 7:30 p.m., and appointment on December 16, 2002. For the Downtown
Specific Plan, the application deadline will be January 9,2003 at 5:00 p.m., with
interviews on January 13,2003 at 7:00 p.m., and appointment on January 21,
2003. For the Neighborhood District, the application deadline will be February 6,
2003 at 5:00 p.m., with interviews on February 10, 2003 at 6:30 p.m., and
appointment on February 18,2003.
The City Administrator distributed the agenda for Friday's mini-retreat.
Military Leave The Mayor noted a request for consideration of a Military Leave Benefits
Benefits Program.

Motion was made by Councilman Morales, seconded by Councilman Dillon
and carried to direct staff to research this concept.
The Mayor noted that the Veteran's Day celebration was great.
Councilman Dillon thanked the Mayor for his words on Veteran's Day, and
noted that Councilman Morales' daughter was on the podium.
Councilman Morales thanked the VFw for their work on the Veteran's Day
celebration. He thanked Joe Kline for the information on Channel 17. He noted
that the IOOF Children's Home sponsored a lunch. He commented that
Thanksgiving is coming up, and that turkeys are needed. He also noted that
Christmas is approaching and that citizens can ring the bell for the Salvation Army.
Councilman Arellano also noted that Thanksgiving is coming up.
Councilman Pinheiro wished everyone a happy Thanksgiving.
Councilman Velasco asked staff to check the timing at the signal at First Street
and Westwood Drive. He noted that streetlight #409 at W elburn Avenue and
Taryn Lane is out and also the one at Santa Teresa Boulevard and EI Dorado.
The Mayor noted that if anyone sees a streetlight out, that they can call City
Hall with the pole number and location to have it fixed. He asked to remember
others at Thanksgiving and help others out.
