Pastor Dennis Nichols, South Valley Community Church, gave the Invocation. The City Clerk noted that the agenda had been posted on April 14, 2004 at 2:50 p.rn. Present: Councilmembers: Paul Correa, Robert T. Dillon, Craig Gartman, Charles S. Morales, Russ Valiquette, Roland Velasco, and Al Pinheiro - 7:00 p.m. Under Orders of the Day, the Mayor noted that the applications for Benassi Oaks would be continued to May 3, 2004. The following promoted employee was introduced: Chad Gallacinao, Sergeant, Police Department. Wes Stanford, Corporal, Police Department, was not able to be present and his introduction will be rescheduled. The Mayor presented the Employee Award for the Month of April, 2004 to Scot Smithee, Captain, Police Department. Due to the uniqueness of the award, Captain Smithee also received citations from the American Police Hall of Fame Life Saving Award, Governor Arnold Schwarzenegger, Supervisor Donald F. Gage, and Assemblymember Simon Salinas. Supervisor Don Gage gave a presentation regarding the Silicon Valley Manufacturing Group. Proc.-Financial The Mayor noted a proclamation for Financial Literacy Month - April, 2004, Literacy Mo. which was previously mailed to the recipient. Hearing Eminent Domain The Mayor stated it was the time and place scheduled on a continued Public Hearing for the purpose of adopting a Resolution of Necessity authorizing the City Attorney of the City of Gilroy to file eminent domain proceedings for the acquisition ofa fee interest in the real property identified by APN 783-37-066, property located at 1138 Del Oro Way owned by Johnella Schackelford, APN 783-37-067, property located at 1136 Del Oro Way owned by Vidal and Filberto Fonseca, and APN 783-48-103, property located at 9320 Benbow Drive, owned by William Abraham and Claudia Diaz-Abraham. The staff report was noted and further explained by Senior Civil Engineer Goodhue. The Mayor opened the Public Hearing. JohnellaShackelford stated that she was present to answer any questions. She explained that she signed a letter on January 23, 2004 to the City allowing the construction of the soundwall and use of her property. The Mayor closed the Public Hearing. The Mayor opened the Public Hearing. Larry Benson thanked staff for their report and noted that they are in agreement to all the conditions for approval of this project. He asked for approval of the request. Steve Garrido, Carriage Drive, encouraged the Council to go to the minutes and Planning Commission tapes to review the meetings. He thanked the Planning Commission members who walked the site with him. He noted problems associated with this project. Arminta Jensen, RJA Associates, responded to a couple of possible solutions to the problems noted. She noted the original site plan. The Mayor closed the Public Hearing. Motion was made by Councilman Morales, seconded by Councilman Dillon and carried (Councilmembers Gartman and Valiquette voting no) to direct staff to prepare a resolution approving TM 03-07. The Mayor deviated from the agenda to accommodate interested persons in the audience. RD 01-19 The Mayor noted an RDO amendment request to modify the attached townhouse units to detached Z-lot townhouse units, on property zoned R1-PUD (Single Family Residential-Planned Unit Development) located at Carriage Drive and Acorn Way. Master Plans The Mayor noted approval of the City of Gilroy Master Plans, including: Police, Library, Parks, City Hall, Corporation Yard, Civic Center, Storm Drainage, Sewer, Water, and Traffic. The staff report was noted and further explained by City Engineer Smelser. Beverley B. Bryant asked for time to review the final Master Plan documents that she received tonight. She noted that the City needs to know that the funds are available at the time when the City projects are proposed to be built. Motion was made by Councilman Morales, seconded by Councilman Dillon and carried (Councilman Gartman voting no) to approve the City of Gilroy Master Plans, including: Police, Library, Parks, City Hall, Corporation Yard, Civic Center, Storm Drainage, Sewer, Water, .and Traffic. Sam Kekaha The Mayor noted a letter of resignation from Sam Kekaha, Building Board of Appeals member. Motion was made by Councilman Valiquette, seconded by Councilman Dillon and carried to accept the resignation with regrets. Interest The Mayor noted an Ordinance of the City Council of the City of Gilroy amending Section 2.41 of Chapter 2, Section 22.27 of Chapter 22; Section 25A7 of Chapter 25A; and Sections 26B.25, 26B.26, 26B.28, 26B.30 and 26B.31 of Chapter 26B of the Gilroy City Code, pertaining to the interest to be paid on certain delinquent tax and other payment obligations and correcting typographical errors, The staff report was noted and further explained by Mayor Pinheiro. Motion was made by Councilman Valiquette, seconded by Councilman Correa and carried to read the ordinance by title only and waive further reading of the Ordinance. The City Clerk read the ordinance by title only. The minutes of the 'Personnel Commission meetings of February 9/10,2004, 2-9/1 0-04 February 19, 2004, and March 30, 2004 were noted. 2-19-04 3-30-04 Councilman Morales noted that he will be in Sacramento with the Silicon Valley Manufacturing Group on legislative issues next week, and then will be at the ABAG Spring Assembly in Oakland on housing issues with Councilman Correa on Friday. Councilman Gartman stated that the Memorial Day parade is coming up. He stated that if anyone would like to participate, they should contact him. He again commented on the Gavila.n College event on May 7,2004 at 8:00 p.m. for the: Council to perform in a skit. He requested to have a study session or retreat to discuss having City streets meet City standards. He asked the Council to consider the Benassi Oaks project be planned as a Master Plan. He noted the Small Project Exemption on Hecker Pass, and asked the City Administrator to review it. He discussed having housing units downtown; and the Mayor noted that there will be a study session on this. . The Mayor requested to set June 11, 2004 as the next Council mini-retreat, and the Council agreed to the date and to have it in the morning. He reminded everyone of the Hecker Pass Specific Plan study session next Monday.
