The Mayor recused himself from discussion and vote on agenda Item 111.1. due to financial interests in property near the proposed site, and Councilmember Gartman recused himself from discussion and vote on agenda Item 111.1. due to employment with the Gilroy Unified School District, and both stepped down from the dais and left the room. Mayor Pinheiro and Councilman Gartman returned to their seats at the dais. Youth Commission Report David Bress, Chair of the Youth Commission and other members gave a report on the activities of the Youth Commission and introduced current members. They presented the Mayor, Councilmembers, and staff members with caramel apples. Chris Cote Public Hearing on a Zone Change request to re-zone 0.61 acres from Rl (Single Family Residential) to R1-PUD (Single Family Residential-Planned Unit Development), located at the northerly terminus of Wayland Lane. Chris Cote, applicant, Z 04-11. The staff report was noted and further explained by Planner II Durkin for Z 04-11, TM 04-12, and NS 04-42. She recommended removal of Tentative Map condition #22. The Mayor opened the Public Hearing. Chris Cote stated that he was a first time home builder. He stated that with less than $500 per home, he can employ energy saving features, with the costs recovered in energy savings. He stated that he has learned the importance of giving back to his community. 8322 Arthur Barron stated that the benefits of the project should be a model for future projects. He stated that there is a need for below market rate housing. He noted that Mr. Cote is committed to giving funds to the Eigleberry Neighborhood Association. Eleanor Villarreal stated that she is involved in the community. She noted that with the increase of solar energy for these homes, that it will be attractive for the neighborhood. Joan Spencer stated that this is a good project and will set an example for years to come. Crystal Mickler stated that she has visited this project and viewed the homes in the area. She noted the homes in relation to the trees to be used for solar energy. She stated that the trees are currently in poor shape, but an arborist is going to work with the trees. Leah Halper stated that she is the closest neighbor to this project. She commented that she has a less enthusiastic view of the project. She noted that there are no real amenities and that several neighbors are not in support of this project. She commented that she is horrified with the density and proposed traffic increase. She stated that four houses are still too dense, and commented that the project does not meet the minimums. She noted that the houses will be crammed on the lot. She explained that this project, due to previous grading, is 3' above her home, and that the adjacent two-story home will tower over her home. Brent Lotten stated his concerns with the oak trees and explained that there is a drainage problem. He commented that the zoning should stay R1 and not be changed to a PUD. Peter Arellano stated that this project is visionary and good for the environment and Gilroy. He explained that we need in-fill housing. He commented that the homes will save energy all year around, and that there are more plusses than minuses. He stated that the developer is setting the bar high. Bruce Morasca stated that he supports this project. He commented that he would like to see solar use expanded in our community. He stated that this is an example for home developers in Gilroy. Ron Biddlecom stated that he is a local builder, and noted that solar panels are the way to go in the future. He stated that this project is built around the environment, and will be a great project. I Michael Davis, designer of the project, thanked Melissa Durkin for her assistance. He stated that he redesigned the project from five homes down to four homes to give more room around the oak trees. He explained the reasons for having detached garages. He stated that he is excited that this is the first solar development in Gilroy. Tom Goff, representing emergency medical personnel, stated that he has never been in a community that an effort such as this has been put forward to retain qualified employees in Gilroy. He asked, on behalf of his medical personnel, for support of this project. Tras Berg requested support of this project. He stated that this is appealing housing and that people would want to buy a house in this community. He asked for approval of this project. The Mayor closed the Public Hearing. The Mayor deviated from the regular agenda to accommodate interested persons in the audience. The staff report was noted and further explained by Planning Division Manager Faus. The Mayor opened the Public Hearing. There being no comments, the Mayor closed the Public Hearing. General Plan Public Hearing on Zone Change text amendments and other modifications of the Zoning Ordinance for consistency with the General Plan, Z 04-06, City of Gilroy, applicant. Motion was made by Councilman Dillon, seconded by Councilman Gartman and carried to continue Z 04-06 to December 20, 2004 due to continuance by the Planning Commission. Personnel Commission Minutes of the Personnel Commission meetings of April 12, 2004, June 28,2004, and July 12, 2004 were noted. City Administrator The City Administrator distributed the agenda for Friday's retreat. He distributed a list of questions submitted on the Hecker Pass Specific Plan. He noted that on December 14, 2004 the South County Regional Wastewater Authority will have a joint meeting with the Santa Clara Valley Water District (SCVWD) at 10:00 a.m., then at 1:30 the SCVWD will hold a meeting in our Council Chambers regarding the Perchlorate issue. He distributed executive summaries on solar power and rubberized asphalt. City Attorney City Attorney Callon gave the Council good news in that the City prevailed and the Judge ruled against the WalMart suit. She noted a second lawsuit filed by Fonseca which will be heard on November 23,2004 regarding the Housing Element. She commented on a citizen, Carl Vincent-Shook, who spoke a couple of times regarding the citation procedures in the Municipal Code. She stated that the language is correct, but that the Penal Code section is cited incorrectly and will be corrected. She also noted that the law has changed, and the City can now charge up to $1,000 rather than up to $500 for misdemeanor violations. 8326 Council Members Report Councilman Morales stated that Thanksgiving is coming and asked citizens to give to the Salvation Army and St. Joseph's. He noted the Veterans Day celebration and thanked those who attended the ceremonies. Councilman Velasco asked to add a discussion item to the next Council retreat regarding the RDO. He also asked for a discussion on the next Council retreat on the pros and cons on a greenbelt vs. open space. He stated that he needs more education on greenbelts and whether it should be linked to the Open Space Authority. He thanked the City Attorney for the work on the WalMart decision. He noted an article in last Thursday's Gilroy Dispatch regarding the South County Housing cannery project, commenting that no decisions have been made as yet. Councilman Gartman wished everyone a Happy Thanksgiving. Mayor's Report The Mayor requested all the Council members join him on December 4, 2004 at 5 :00 p.m. at the Chamber offices to start the Christmas season. He requested the members Email him if they are unable to attend. He also thanked the City Attorney for the work on the WalMart issue. It was noted that Melissa Durkin did a great deal of background work on this lawsuit.
