Orders of the Day Mayor Protempore Gartman noted that Items V.F. and VII.A. would be continued to May 2, 2005. He stated that Item I.D.5. would immediately follow Item I.D.l. Mayor Protempore Gartman led the Pledge of AIlegiance to the Flag. Mayor Protempore Gartman announced that the Council had adjourned from a Closed Session regarding Conference with Labor Negotiator, pursuant to Government Code Section 54956.9(b) and that no action had been taken. Regular Meeting April 18, 2005 Gilroy, California 8379 8380 The following new employees were introduced: Betsy Brewer, Police Records Technician, Police Department; Regina Adams-Brisco, Housing Planner I, Community Development Department; and James Dempsey, Firefighter II, Fire Department. Presentations & Proclamations Mayor Protempore Gartman noted a proclamation for National Volunteer Month - - April, 2005. Mayor Protempore Gartman presented a proclamation for Fair Housing Month- April, 2005 to Veronica Navarro. Mayor Protempore Gartman noted a presentation by the Housing Trust of Santa Clara County. (This presentation will be rescheduled to May 16, 2005.) Mayor Protempore Gartman presented the Employee Award for the Month of April, 2005 to John Garcia, Recreation Supervisor, Community Services Department. Mayor Protempore Gartman noted a presentation by South Valley Disposal & Recycling, Inc. of the 2004 Business Recycler of the Year to Saint Louise Regional Hospital, the 2004 Residential Recycler of the Year to the Denham Family, and of the Unincorporated Santa Clara County Business Recycler of the Year to Rancho de Solis Winery. Presentations by members of the public for items not on the agenda, but within the subject matter jurisdiction of the City Council. There were no presentations by the public. Consent Calendar Motion was made by Councilman Dillon, seconded by Councilman Valiquette and carried (Mayor Pinheiro absent) to approve the Consent Calendar. Hazard Mitigation Plan Public Hearing to adopt the City of Gilroy Hazard Mitigation Plan and endorse the ABAG Report "Taming Natural Disasters." The staff report was noted and further explained by Community Development Director Rooney. Mayor Protempore Gartman opened the Public Hearing. There being no comments, he closed the Public Hearing. Motion was made by Councilman Dillon, seconded by Councilman Morales and carried (Mayor Pinheiro absent) to adopt Resolution No. 2005-29 adopting the City of Gilroy Hazard Mitigation Plan and endorsing the ABAG Report "Taming Natural Disasters. " RESOLUTION NO. 2005-29 A RESOLUTION OF THE CITY OF GILROY ADOPTING THE CITY OF GILROY HAZARD MITIGATION PLAN AND ENDORSING THE ABAG REPORT "TAMING NATURAL DISASTERS," OF WHICH THE GILROY HAZARD MITIGATION PLAN IS CONTAINED WITHIN. 8381 PASSED AND ADOPTED this 18th day of April, 2005, by the following vote: AYES: COUNCILMEMBERS: CORREA, DILLON, MORALES, VALIQUETTE, VELASCO, and GARTMAN NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: PINHEIRO Gilroy General Plan Public Hearing on a request to adopt the City of Gilroy Neighborhood District Policy as recommended by the Neighborhood District Task Force. Motion was made by Councilman Valiquette, seconded by Councilman Correa and carried (Mayor Pinheiro absent) to continue the Public Hearing to May 2, 2005 to allow the Neighborhood District Task Force to reconvene. Zoning Ordinance Public Hearing on a request for a text amendment to the City of Gilroy's Zoning Ordinance C2 (Central District Commercial) use table to amend the uses in the Downtown District. City of Gilroy, applicant, Z 05-01. The staff report was noted and further explained by Planner II Polubinsky. Mayor Protempore Gartman opened the Public Hearing. There being no comments, he closed the Public Hearing. Motion was made by Councilman Dillon, seconded by Councilman Morales and carried (Mayor Pinheiro absent) to direct staff to prepare an ordinance approving Z 05-01. Melia, Augustine Public Hearing on a Pre-Zone Change request to pre-zone 53 acres to Ml (Limited Industrial) on property located north of Las Animas Avenue, between Monterey Road and Murray Avenue. Motion was made by Councilman Valiquette, seconded by Councilman Morales and carried (Mayor Pinheiro absent) to continue to the meeting of May 16,2005 due to continuance at the Planning Commission. Motion was made by Councilman Valiquette, seconded by Councilman Dillon and carried (Mayor Pinheiro absent) to continue the Public Hearing for M 05..()2 to May 2, 2005. Economic Incentive Program Consideration of approving modifications to the City's existing Economic Incentive Program to incorporate a Limited Term Program that partially waives impact fees for small/medium multi-tenant and single entity tax or TOT generating commercial and industrial businesses. The staff report was noted and further explained by Community Development Director Rooney. 8382 Motion was made by Councilman Dillon, seconded by Councilman Valiquette and carried (Mayor Pinheiro absent) to approve the modifications to the City's existing Economic Incentive Program. Gilroy General Plan Request for minor modifications to the Residential Development Ordinance relating to the City of Gilroy Trails Master Plan as recommended by the Trails Master Plan Task Force. City of Gilroy, applicant, M 05-03. Motion was made by Councilman Valiquette, seconded by Councilman Dillon and carried (Mayor Pinheiro absent) to continue M 05-03 to May 2,2005. City Administrator's Report The City Administrator noted the headline regarding the overtime by the Fire Department. He explained that he has asked the Fire Chief to give a brief review at the May 16, 2005 study session regarding this issue. Council Members Report Mayor Protempore Gartman noted concerns regarding the timeline for the two block area construction of downtown to see if it can be reduced or shifted. The City Administrator explained that those downtown merchants with concerns should attend the outreach meetings and stated that the timeline was created to start after the Christmas season.
