Minutes 2005/08/11 8423 Special Meeting August 11, 2005 Gilroy, California The Mayor led the Pledge of AIlegiance to the flag. The City Clerk noted that the agenda had been posted on August 8,2005 at 2:56 p.m. Roll Call Present: Paul Correa; Robert T. Dillon; Craig Gartman; Charles S. Morales; Russ Valiquette; Roland Velasco; AI Pinheiro - 6:01 p.m. The Mayor noted that the Council held a closed session prior to this meeting, which will be continued to follow the close of this meeting, and that there was no reportable action taken in the closed session. Consent Calendar Acting City Attorney Faber explained that the property in question has two addresses, so Item III.B. is a second resolution to be adopted to cover the additional address on the property. Motion was made by Councilman Dillon, seconded by Councilman Morales and carried to approve the Consent Calendar. Property Improvement Agreement No.: 2005-14, Tract 9653, Masoni Orchard, Llagas Creek Investor LLC, APN: 810-23-002 and 810-23-003. A Resolution of the City Council of the City of Gilroy declaring its intention to sell the property owned by the City of Gilroy, located at 7600 Monterey Street, Gilroy, California. RESOLUTION NO. 2005-60 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY DECLARING ITS INTENTION TO SELL THE PROPERTY OWNED BY THE CITY OF GILROY, LOCATED AT 7600 MONTEREY STREET, GILROY, CALIFORNIA. PASSED AND ADOPTED this 11 th day of August, 2005, by the following vote: AYES: COUNCILMEMBERS: CORREA, DILLON, GARTMAN, MORALES, V ALIQUETTE, VELASCO, and PINHEIRO NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE City Charter Request to adopt resolutions amending Section 1004 of the City of Gilroy Charter to eliminate binding arbitration in the event of an impasse in contract labor negotiations with police or firefighters. The staff report was noted and further explained by Acting City Attorney Faber. Jim Buessing, on behalf of Local 2805, stated that they look forward to meeting with the Council on this subject. Jim Callahan, GPOA, stated that they will hold off on any statement, and anticipate setting a date and time to meet and confer and look forward to the discussion. Motion was made by Councilman Velasco, seconded by Councilman Dillon and carried to direct our negotiators to continue in their efforts to meet and consult with the POA and the IAFF on the issue of possible charter amendments concerning interest arbitration, and to continue consideration of these proposals to a time next year after the meet and consult process has either been successfully concluded or has been terminated with no agreement. The Mayor read a prepared statement regarding the agenda issue of interest arbitration. 8424 City Charter Request to adopt resolutions amending Section 1004 of the City of Gilroy Charter to provide that under certain circumstances the City Council may submit to the electors of the City for approval or disapproval provisions of a decision rendered by an arbitration board following an impasse in contract labor negotiations with police or firefighters. Motion was made and carried on the previous item, which covers this item also. Adjourn to Closed Session At 6: 17 p.m. the Council adjourned into closed session. Adjourn to Open Session At 7:24 p.m. the Council adjourned to open session and announced that there was no reportable action taken in the closed session.
