Minutes 2005/12/19 8462 Regular Meeting December 19, 2005 Gilroy, California The Mayor led the Pledge of Allegiance to the flag. Pastor Malcolm MacPhail, New Hope Community Church, gave the invocation. The City Clerk noted that the agenda had been posted on December 15, 2005 at 8:45 a.m. Roll Call Present: Paul Correa; Robert T. Dillon; Craig Gartman; Charles S. Morales; Russ Valiquette; Roland Velasco; Al Pinheiro - 7:00 p.rn. Orders of the Day The Mayor reminded everyone that several items including Items YD. & YE. will be continued to January 23,2005. The Youth Commission gave a report on their activities. Presentation by members of the public for items not on the agenda, but within the subject matter jurisdiction of the City Council. There were no comments by the public. Consent Calendar Motion was made by Councilman Correa, seconded by Councilman Morales and carried to approve the Consent Calendar. The City Administrator presented a recommendation to award the bid for Two (2) New Model Year Ford F-450 2WD Regular Cab and Chassis Trucks, bid #06-ASD-123, to Bob Lynch Ford in the amount of$106,128.62. Motion was made by Councilman Dillon, seconded by Councilman Correa and carried to award the bid for Two (2) New Model Year Ford F-4502WD Regular Cab and Chassis Trucks, bid #06-ASD-123, to Bob Lynch Ford in the amount of$106,128.62. Glen Loma Group A continued Public Hearing on a Zone Change request to change the zoning of 1.02 acres from RI (Single Family Residential) to RI-PUD (Single Family Residential- Planned Unit Development) on property located at 1645 Anson Court. Glen Loma Group (c/o Tim Filice), applicant, Z 04-15. A continued Public Hearing on a Tentative Map request to sub-divide 1.02 acres into six single family residential lots, located at 1645 Anson Court on property zoned RI (Single Family Residential). Glen Lama Group (c/o Tim Filice), applicant, TM 04-18. Architectural & Site review to allow the construction of 6 single family homes located at 1645 Anson Court, on property zoned RI (Single Family Residential). Glen Loma Group (c/o Tim Filice), applicant, A/S-PUD 04-70. Councilman Velasco recused himself from discussion and vote on this matter due to property ownership near this development, stepped down from the dais and left the room. The staff report was noted and further explained by Planner II Casper. The Mayor opened the Public Hearing. Tim Filice reviewed the original project. He noted that they met with the neighbors and have revised the project after that meeting. He stated that he feels that this is a good compromise solution. John Troini acknowledged that a lot of effort was put in by Mr. Filice to accommodate the project. He still feels that there should be no more than two single story homes. Ray Berzins distributed information on the project and reviewed it with the Council. He stated that the neighbors would like single story ranch style homes. He stated that there has been inadequate compromise on behalf of the developer. The Mayor closed the Public Hearing. Motion was made by Councilman Dillon, seconded by Councilman Correa and carried (Councilman Velasco absent) to approve the Mitigated Negative Declaration, with 8 mitigation measures, finding that (a) it is completed in compliance with CEQA; (b) it reflects the independent judgment of the City; and (c) there is no substantial evidence that the project will have a significant effect on the environment. Motion was made by Councilman Dillon, seconded by Councilman Valiquette and carried ( Councilman Velasco absent) to direct staff to prepare an ordinance approving Z 04-15. Motion was made by Councilman Dillon, seconded by Councilman Correa and carried (Councilman Velasco absent) to direct staff to prepare a resolution approving TM 04-18, with additional conditions. Motion was made by Councilman Dillon, seconded by Councilman Correa and carried (Councilman Velasco absent) to direct staff to prepare a resolution approving A/S-PUD 04-70, with additional conditions. 8464 Councilman Velasco returned to his seat at the dais. South County Housing A continued Public Hearing on a Zone Change text amendment request to section 50.62(b)(3) of the Gilroy Zoning Ordinance to allow projects that seek an affordable housing exemption from the RDO (Residential Development Ordinance), to have flexibility in the number of units requested. South County Housing, c/o Karen Saunders, applicant, Z 05-15. Mayor Pinheiro recused himself from discussion and vote on this item due to business dealings with the applicant, stepped down from the dais and left the room. The staff report was noted and further explained by Planner II Durkin for Z 05-15 and ARE 05-02. Mayor Protempore Valiquette opened the Public Hearing. Dennis Lalor spoke in favor ofthe request. He gave a history of the Residential Development Ordinance and the types of units that are applied for. He stated that this is an outdated ordinance. He reviewed the request for changes to the Zoning Ordinance. He stated the need for flexibility in the ordinance, and understands the Council's concern for possible abuse. Jan Lindenthal stated that this project is exceptional. She stated that 80% of their clients are from Gilroy. She stated that this is an opportunity to showcase the Neighborhood District Policy. Judy Hess expressed her thanks to South County Housing for giving her the opportunity to purchase her home. She stated that this is a great opportunity for citizens to become homeowners. Bernadette Arellano discussed the meaning of affordable housing. She stated that the City of Gilroy should use the term "affordable" in a positive term. She explained that this is something that is heard all the time. She stated that affordable housing means that it is affordable to middle class individuals. She noted that Gilroy has shown an incredible dedication to bring affordable housing to Gilroy. Mayor Protempore Valiquette closed the Public Hearing. Motion was made by Councilman Morales, seconded by Councilman Correa and the motion did not carry (Councilmembers Dillon, Gartman, and Velasco voting no and Mayor Pinheiro absent) to direct staff to prepare an ordinance approving Z 05-15. South County Housing A continued Public Hearing on an Affordable Housing request to allot 303 housing units on property zoned ND (Neighborhood District), located on Monterey Road, north and south ofCohansey Avenue. South County Housing, c/o Karen Saunders, applicant, ARE 05-02. Motion was made by Councilman Gartman, seconded by Councilman Velasco and the motion did not carry (Council members Correa, Morales, and Valiquette voting no and Mayor Pinheiro absent) to prepare a resolution denying ARE 05-02. At 9:04 p.m. Mayor Protempore Valiquette called for a recess, after which he recalled the meeting to order. Motion was made by Councilman Morales, seconded by Councilman Correa and carried (Council members Gartman and Velasco voting no and Mayor Pinheiro absent) to direct staff to prepare a resolution approving ARE 05-02. Mayor Pinheiro returned to his seat at the dais. 8465 City of Gilroy - Zoning Ordinance A continued Public Hearing on a Zoning Ordinance text change, amendments to accommodate changes to the City's right-of-way standards, sections 11.23, 19.23 and 23.23. City of Gilroy, applicant, Z 05-06. Request for adoption of the 2005 City of Gilroy Right-of-Way Standards. Motion was made by Councilman Valiquette, seconded by Councilman Correa and carried to continue this request to January 23, 2006 at the request of staff. City of Gilroy - Ordinance Codification A Public Hearing to consider adopting an ordinance amending the Gilroy City Code, Chapter 20 by adding a new Article X entitled "Maintenance and Repair of Public Use Easement Area" regarding street tree and sidewalk maintenance, repair, and liability. Motion was made by Councilman Valiquette, seconded by Councilman Correa and carried to continue this request to January 23, 2006 at the request of staff City of Gilroy - Police Department A Public Hearing on a request to consider a report by the Gilroy Police Department recommending projects/programs for funding under the State Law Enforcement Block Grant monies for the 2005-2006 Fiscal Year. The staff report was noted and further explained by the City Administrator. The Mayor opened the Public Hearing. There being no comments from the public, the Mayor closed the Public Hearing. Motion was made by Councilman Velasco, seconded by Councilman Valiquette and carried to accept the funding for projects/programs as recommended. Miller Avenue Reorganization A Public Hearing on a Zone Change request to pre-zone approximately 5.5 acres from County A-I to Rl (Single Family Residential) located at 5875 & 5885 Miller Avenue, at the Thomas and Mesa Road intersection. A Public Hearing on an annexation request of approximately 5.5 acres of land located at 5875 & 5885 Miller Avenue, at the Thomas and Mesa Road intersection. Chappell/Sargenti (c/o Martin Chappell), applicant, A 03-01. The staff report was noted and further explained by Planner II Polubinsky. The Mayor opened the Public Hearing. There being no comments from the public, the Mayor closed the Public Hearing. Motion was made by Councilman Gartman, seconded by Councilman Valiquette and carried to certify the final Environmental Impact Report (EIR) finding that (a) it is completed in compliance with CEQA; (b) that the final EIR was presented to the City Council and that the City Council has reviewed and considered the information contained in the final EIR prior to approving the project; and ( c) the final EIR reflects the independent judgment and analysis of the City. Motion was made by Councilman Gartman, seconded by Councilman Valiquette and carried to direct staff to prepare a resolution preparing Specific Findings with respect to each significant effect identified within the EIR, and to include a statement of overriding considerations for those significant effects that are unavoidable. Motion was made by Councilman Gartman, seconded by Councilman Morales and carried to direct staff to prepare a resolution approving A 03 -0 I. 8466 BarberiILuchessa Road A Public Hearing on a Zone Change request to prezone 27.7 acres from County A-I to ND (Neighborhood District) at the southwest corner ofLuchessa Avenue and Monterey Road. Luchessa Road, LLC, applicant, Z 05-07. A Public Hearing on an Urban Service Area amendment to amend the Urban Service Area boundary to include 27.7 acres ofland at the southwest corner ofLuchessa Avenue and Monterey Road. Luchessa Road, LLC, applicant, USA 04-02. The staff report was noted and further explained by Planner II Casper. The Mayor opened the Public Hearing. Lee Wieder thanked staff for the staff report and stated that he concurred with the findings. He stated that this area will have its own master plan and an ag mitigation program. He noted the tour for the LAFCO commissioners last week, showing them growth areas of Gilroy. The Mayor closed the Public Hearing. Official Canvass of the Registrar of Voters for the November 8,2005 Special Municipal Election. Motion was made by Councilman Gartman, seconded by Councilman Valiquette and carried to adopt Resolution No. 2005-93 Declaring the Total Vote and Elected Officers. RESOLUTION NO. 2005-93 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING AND ADOPTING THE REGISTRAR OF VOTERS' CANVASS OF THE GENERAL MUNICIPAL ELECTION AND DECLARING RESULT OF SUCH ELECTION HELD IN THE CITY OF GILROY ON NOVEMBER 8, 2005. RESOLVED, by the City Council of the City of Gilroy, California that; WHEREAS, by order of this Council a general municipal election was held and conducted in the City of Gilroy on Tuesday, the 8th day of November, 2005 as required by law and the Charter of said City as amended; and WHEREAS, it appears that notice of said general election was duly and legally given; voting precincts were properly established; election officers were appointed and election supplies furnished; and in all respects the election was held and conducted and the votes cast thereat received and canvassed, and the returns thereof made, determined and declared in time, form and manner as required by the Charter of said City as amended 8467 and the general laws of the State providing for and regulating municipal elections in said City; and WHEREAS, the Registrar of Voters did conduct the canvass of the returns of said municipal election and did count the absentee ballots cast thereat, pursuant to direction and order of the City Council of said City; and WHEREAS, said canvass was duly completed and the results thereof were certified by the Registrar of Voters and submitted to this Council. NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, as follows: 1. Said municipal election was held and conducted in the City of Gilroy, County of Santa Clara, State of California on Tuesday, November 8, 2005 in the time and in the form and manner as required by law. 2. The whole number of votes cast in said City of Gilroy at said municipal election was 8,986 (including 3,680 absentee votes). 5. The names of the persons voted for, the offices for which they were voted, the number of votes received by each of said persons in each of said precincts and by absentee votes, are shown on said Exhibit "A", hereto attached. 6. At said general municipal election held in the City of Gilroy and Election held on November 8, 2005, the following persons were elected to the following offices: PETER ARELLANO was elected a member of the City Council to hold office for a term of four years, from and after Monday, December 19, 2005, and continuing until his respective successor shall qualify. DION BRACCO was elected a member of the City Council to hold office for a term of four years, from and after Monday, December 19,2005, and continuing until his respective successor shall qualify. CRAIG GARTMAN was elected a member of the City Council to hold office for a term of four years, from and after Monday, December 19, 2005, and continuing until his respective successor shall qualify. 7. The City Clerk is hereby directed to make out and deliver to each of the persons elected a certificate of election signed by her and duly authenticated. She shall also impose the constitutional oath of office and have them subscribe thereto. 8. That the City Clerk is hereby instructed to enter this resolution in full in the minutes of this Council as a statement of the result of said general municipal election. City Administrator's Report The City Administrator distributed the right of way standards document that is scheduled to be heard on January 23, 2006. City Attorney's Report The City Attorney wished everyone a Merry Christmas. .council Members Report Councilman Gartman reviewed his request to possibly agendize transferring the 70 downtown residential units to the Small Project Exemption. It was agreed to add this to the retreat agenda. He also requested a review of the RDO ordinance. Councilman Gartman wished everyone Happy Holidays to everyone and a safe Holiday season. Councilman Valiquette welcomed his new colleagues and wished everyone a Happy Holiday season. 8471 Councilman Arellano stated that it was good to be back and wished everyone a Merry Christmas, Happy New Year & Happy Holidays and requested everyone be safe. Councilman Bracco thanked his fellow Council members and the Mayor and staff for welcoming him and Councilman Arellano and stated that he looks forward to working with everyone. Mayor's Report The Mayor reviewed the LAFCO tour. He stated that Staff had made a good presentation before the tour. He commented that he will be sending letters to the full LAFCO board thanking them for attending and questioning where we go from here. He stated that he would like to continue the open dialog between the two bodies. He welcomed the new members and Councilman Gartman and thanked them for joining the Council. He stated that he looks forward to making Gilroy a better place. He wished all citizens a Happy New Year, Merry Christmas, Happy Holidays, and asked everyone to be safe.
