Approval of the agreement for Deferred Agricultural Mitigation by and between the
City of Gilroy and Luchessa Road, LLC.
The Mayor deviated from the regular order of business to accommodate interested
persons in the audience.
City of Gilroy - Impact Fee
Request for Traffic Impact Fee Exemption from Saint Mary School.
The staff report was noted and further explained by Senior Civil Engineer Abrams.
Marie Blankley stated that they are generating absolutely no trips. She explained
what clearly should be an exception to the Traffic Impact Fee. She reviewed the history
of this project. She stated that the Diocese is willing to place a restriction on the deed
that there will be no change in this use that would increase the traffic impact.
Debbie Ellis stated that the children and parents have donated money to construct this
building. She commented that she does not feel that this impact fee applies to this
project.
Father Derry stated that there is no problem with the methodology. He stated that an
amendment will not require a major change.
Pastor Ron Koch, Good Shepherd Lutheran Church, stated that perhaps an error was
made in the billing process.
John Troini asked that this not be continued, but rather a decision be made tonight.
The school principal stated that they would like to construct the building now.

Motion was made by Councilman Velasco, seconded by Councilman Arellano and
carried that the Council agrees that the ordinance on the Traffic Impact Fee is still valid.
Motion was made by Councilman Velasco, seconded by Councilman Arellano and
carried for staff to bring back to the February 6,2006 meeting an exemption to the
methodology to cover projects with no impact.
At 8:40 p.m. the Mayor called for a recess, after which he recalled the meeting to
order.
Hecker Pass Specific Plan
Recommendation to Caltrans regarding the Hecker Pass Highway Road Alignment.
Planner II Durkin stated that she mailed a notice to property owners in the area. She
also noted that the General Plan supports saving the historic cedar trees. She explained
that the City will prepare environmental documents and review the removal of the trees in
that document. She noted that the trees are eligible for listing on the Historic Register.
Traffic Engineer Dey answered some questions on the impact of driveway shortening
and the impact on the church parking lot.
Rob Oneto, RJA, gave some visual conceptions on what Hecker Pass would look like
with the various alternatives.
David Collier, member of SOS, stated that there is widespread support to save the
beauty of Hecker Pass. He quoted from the General Plan regarding working with
Caltrans to preserve the Deodora Cedar trees.
Connie Rogers noted the previous straw vote of approval of the northern route. She
noted the comment letter submitted to Caltrans by the Historical Society and SOS.
Motion was made by Councilman Velasco, seconded by Councilman Bracco and
carried to approve recommending to Caltrans the proposed Alternative A alignment for
the Uvas Creek bridge.
Josh Bassi stated that it is wrong to increase the road by the church, because it would
impact the animals and the environment.
Susan Bassi noted that she was aware of the process of the Hecker Pass Specific Plan.
She stated that Joel Goldsmith met with the homeowners to explain what the Plan is so
far. She provided a PowerPoint presentation on this request.
Roberta Hughan, Gilroy Historical Society, gave a historic overview of the Deodora
Cedar trees.
David Collier again noted the direction of the General Plan to work closely with
Caltrans to preserve the cedar trees. He emphasized the aesthetic component of the cedar
trees.
Carolyn Tognetti, member of SOS, stated that they hired an arborist to review the
trees. She noted the lifespan of the Deodora Cedars are about 1000 years vs. the City's
arborist who said it was 150 years. She noted the visual of the retaining wall that can
look more natural or vegetation that can be planted. She agreed that no stoplight should
be at the entrance at the church. She stated that they would like natural stone if a wall is
needed. She asked if an option is chosen, would the option chosen now set the option for
the future, and was told that it would. It was noted that if the road needs further
widening, then they would probably follow the southern alignment that would take out
the rest of the trees. She stated that a supplemental EIR needs to be prepared.
Connie Rogers stated that the aesthetic component leads us to a tourist attraction. She
stated that she would like the Council to continue this request to allow additional
information to be received. She noted that two holes at the City golf course may have to
be moved. She noted petitions with 290 signatures regarding this issue.
Doris Sosa read from a fictional traveling brochure regarding the trees along Hecker
Pass Highway.

Pastor Ron Koch, Good Shepherd Lutheran Church, stated that the church property
would be highly impacted by choosing the northerly route.
Rob Oneto responded to some of the questions brought up from some of the speakers.
James Allen, City retained arborist, stated that you can move any tree, but it can be
very expenslVe.
Motion was made by Councilman Velasco, seconded by Councilman Arellano and
carried to continue the request for a recommendation to CalTrans regarding the preferred
alignment for the portion of Hecker Pass Highway that traverses the Hecker Pass Specific
Plan area to a future date, to have a workshop, and come back to the Council with
alternatives.
The Mayor returned to the regular order of the agenda.
Willey Cultural Center
Recommendation to award the bid for the Willey Cultural Center Site Improvements,
Project No. 05-CDD-114, to Perma Green Hydroseeding in the amount of $166,610.00.
The City Administrator presented a recommendation to award the bid for the Willey
Cultural Center Site Improvements, Project No. 05-CDD-114, to Perma Green
Hydroseeding in the amount of$166,61O.00, noting that additional funding for a change
order or construction by City crews will be needed for security fencing.
Community Services Director Andrade-Wax gave a history of the property and
reviewed the scope of work for this project.
Mike Kennedy noted when the City took possession, the porch area was very
dilapidated. He noted that donations of labor and materials reconstructed the porch area.
He stated that by approving this bid it will be in keeping with the intent of the gift of the
building. He noted all the hardscape for this bid has been donated.
Bruce Morasca, current president of Theater Angels Art League, stated that he hopes
that this bid is approved so that the landscaping can be completed.

regarding street tree and sidewalk maintenance, repair, and liability.

The City Administrator distributed information on the upcoming telecommunications
legislation. He noted the retreat packet that was distributed.
City Attorney's Report
The City Attorney noted a case completed this week regarding the siting of cell
towers.
Mayor's Report
The Mayor noted the dinner on Friday night after the retreat will be held at the
Harvest Time Restaurant. He requested Council members contact the City Clerk to let her
know if they will attend. Councilman Velasco stated that he would not be able to attend.
