Mayor Pinheiro announced that Item VII.F. would follow Item V.C. and Item VII.D.
would follow Item V.F. He stated that Item III.N. is being pulled from the agenda and
will be reagendized. He announced that the Suzuki violin group will be playing some
songs from their cultural exchange to the Azores.

Mayor Pinheiro noted certificates for retired Board and Commission members:

Mayor Pinheiro noted a Certificate of Recognition for Ryan Edward Ludwick upon
his achievement of the rank of Eagle Scout, which was previously presented to him.
Dia Hoshida, Arts and Culture Commissioner, gave a report on their activities.

Yvonne Hyatt distributed information regarding pit bull restrictions and to request a
dog law proposal to make citizens accountable for the actions of their animals.

City of Gilroy - Impact Fees
A continued Public Hearing to review the Traffic and Water Development Impact
Fees and set the rate for the Traffic and Water Impact Fees.
The staff report was noted and further explained by City Administrator Baksa and
City Engineer Smelser.
The Mayor opened the Public Hearing.
Beverley B. Bryant, Home Builders Association of Northern California, stated that if
the costs go down, then she requested that the fees also be reduced.
The Mayor closed the Public Hearing.

carried to adopt Resolution No. 2006-50 increasing the Water Development Impact Fees
and the Traffic Impact Fees as revised, with clarifying wording regarding the increase.

South Valley Disposal & Recycling
Public Hearing to consider placement of liens for non-payment of charges for the
collection of garbage, rubbish and refuse in the City of Gilroy.
The staff report was noted and further explained by Finance Director Murphy and
Phil Couchee.

Art Pua noted that his tenants did not pay their bill, and the City is now asking the
owner to pay and this is not fair. He stated that they should just cut off their service.

Joe Burch, PSI Development, distributed information how the 32 units would fit on
the site. He stated that these homes would fill a niche for first time home buyers.
Jeanette Coran, architect, stated that she was at the Planning Commission and felt that
they were unable to make a decision because they did not have a concept drawing, so
they brought this concept sketch to help the Council make a decision.
The Mayor closed the Public Hearing.
Motion was made by Councilman Gartman, seconded by Councilman Velasco and
the motion did not carry (Councilmembers Arellano, Bracco, Correa, Valiquette, and
Pinheiro voting no) to deny GP A 05-03.

resolution approving GP A 05-03.

prepare an ordinance approving Z 05-12 as requested.
At 9:45 p.m. the Mayor called for a recess, after which he recalled the meeting to
order.
Gilroy Unified School District
Public Hearing on a Zoning Ordinance text amendment request to amend the Gilroy
Zoning Ordinance, Section 50.63(c)(3) to allow an ROO (Residential Development
Ordinance) exemption category for Gilroy Unified School District properties. Gilroy
Unified School District, clo Steve Brinkman, applicant, Z 06-07.
The staff report was noted and further explained by Planner II Casper.
The Mayor opened the Public Hearing.
Steve Brinkman, GUSD, clarified that at their neighborhood meeting they did not say
that there was "affordable housing" in the area but rather that at their neighborhood
meeting there was strong objection to affordable and also to apartments. He stated that
. quality schools are required for a high quality of life. He stated that they were unable to
collect enough money from impact fees to be able to construct their schools. He stated
that an additional funding source is land sales. He urged approval of the zoning text
amendment.
John Donahoe, RJA, noted information on the ROO allocation process.
Eleanor Villarreal noted that she is a strong proponent of Gilroy public education.
She noted a school bond was previously proposed and failed. She noted that another
bond was proposed and passed to allow for school construction. She asked the Council to
approve the request to allow construction of the new elementary school and high school.
John Donahoe noted that there may be two densities, with a higher density along
Wren Avenue.
Jaime Rosso, businessman in Gilroy, speaking on behalf of the School Board, stated
that there is a critical need for the School District to complete the facilities plan and build
the new high school. He urged support of this application.
Lee Wieder stated that the school district needs the Council's help. He stated that
public safety and public education are very important. He stated that there also needs to
be accountability.
Denise Apuzzo stated that Gilroy High School is ridiculously overcrowded. She
stated that 85 units on the Las Animas School site is perfect.

carried (Councilman Gartman voting no) to direct staff to prepare an ordinance approving
Z 06-07, subject to minor revisions to the language in the ordinance.

Residential Development Ordinance exemption request for an allotment of 99

Councilman Velasco recused himself from voting on the Unfinished Business items,
since he was not present at the meeting when the Public Hearings were held.

Recommendation for approval of Property Exchange Agreement between the City of
Gilroy and Gilroy Garlic Festival Association and 7600 Monterey LLC for Exchange of
Downtown Properties.
The staff report was noted and further explained by Community Development
Director Rooney.
Motion was made by Councilman Velasco, seconded by Councilman Correa and
carried to approve the Property Exchange Agreement between the City of Gilroy and
Gilroy Garlic Festival Association and 7600 Monterey LLC for exchange of downtown
properties.
City Administrator's Report
City Administrator Baksa distributed the staff report on the draft Alcohol in the Parks
ordinance and noted that they should have already received the Las Animas Park Master
Plan. He stated that he will email the PowerPoint report on the sprinkler ordinance to the
Council on Tuesday or put it in the mail box.
Council Members Report
Councilman Arellano noted his appreciation to Bonfante Gardens for hosting the
recent triathlon.

Mayor's Report
Mayor Pinheiro invited the Councilmembers to a cocktail reception by the Sister City
Association on July 27,2006 at 7:00 p.m. at the Portuguese Hall to welcome the sister
cities representatives to the Garlic Festival.
City of Gilroy - Zoning Ordinance
The Mayor noted that on Item VIlD. there was a recommendation by the Planning
Commission to recommend the elimination of Section 50.63(c)(3), previously used by
Bonfante Gardens.
Councilman Valiquette recused himself from discussion and vote on this item due to
financial interests due to his employment with Bonfante Gardens, stepped down from the
dais and left the room.
Motion was made by Councilman Velasco, seconded by Councilman Arellano and
carried (Councilman Valiquette absent) to direct staff to start the process to eliminate
Section 50.63(c)(3) from the Zoning Ordinance.
Councilman Valiquette returned to his seat at the dais.
