Call to Order Mayor Pinheiro called the meeting to order at 6:02 p.m. and led the Pledge of Allegiance. The Invocation was given by Ruth Bretone of the Gilroy Baha'i Community. City Clerk Freels reported that the agenda had been on September 14, 2011 at 4:00 p.m. Roll Call Present: Council Member Dion Bracco; Council Member Bob Dillon; Council Member Peter Leroe-Munoz; Mayor Pro Tempore Cat Tucker; Council Member Perry Woodward; Mayor AI Pinheiro Absent/Excused: Council Member Peter Arellano M.D. Mayor Pinheiro announced that Council Member Arellano had called earlier in the day to explain that he was ill and would not be attending the meeting. Proclamations, Awards and Presentations Mayor Pinheiro read a certificate of appreciation for Dennis Bolger thanking him for his service on the Parks and Recreation Commission. III. Annual Presentation by the Physically Challenged Appeals Board The presentation was given by Sue Rodriguez of the Physically Challenged Appeals Board. IV. REPORTS OF COUNCil MEMBERS Council Member Bracco announced that the park management company of Gilroy Gardens Park, Cedar Fair had recently been sold, explaining that more information on the new company would be shared as it became available. Appointment of Fred Tovar as Gilroy Unified School District Representative to the Housing Advisory Committee for a Two (2) Year Term Beginning October 1, 2011 B. Review of Proposed Revisions to the Santa Clara Valley Habitat Plan Framework and Plan Economic Impact Analysis 9388 The staff report was presented by Senior Planner Stan Ketchum. Ken Schreiber of the Santa Clara County Habitat Conservation Plan presented additional information on the plan. Public comment was opened; there being no comments, public comment was closed. The Council received the report. B. Appointment of Seven (7) Youth Commission Members There were no public comments. Motion on Item IX.B. Motion: to Appoint the 12th graders to the Youth Commission for 1-year Terms, Expiring September 30,2012, and the remaining five (5) applicants for 2-year Terms, Expiring September 30,2013 Moved by Council Member Perry Woodward, seconded by Council Member Peter leroe-Munoz. Vote: Motion carried 6-0-1. City Attorney Callon spoke on the enforcement provisions proposed. There were no public comments. Motion on Item X.A. Motion: to direct staff to return to the Commission to review the proposed ordinance revisions in Section 2 regarding contributions per resident, Section 8 regarding civil actions, and to return to Council with a report on the financial impacts of the program Moved by Council Member Perry Woodward, seconded by Council Member Peter leroe-Munoz.
