Hughanat 8:02 p.m. Present: Councilmeniliers: Sharon A. Albert, Donald F. Gage, Paul V. Kloecker, Larry Hussallem, John E. Pate, Pete Valdez, Jr. and Roberta H. Hughan. Motion was made by Councilman Gage seconded by Councilman Pate that the following items under the Consent Calendar be approved bv the following Roll Call Vote: Ayes: Councilmembers: Albert, Gage, Kloecker, Mussallem, Pate, Valdez and Hughan: Approved the Minutes of the Regular city Council Meeting of September 16, 1985; Adopted Ordinance No. 85-16, Zoning Test Amendment to Section 22.30 to allow additional Conditional Uses in the M2 (General Indus- trial) Zoning Districts that have adopted specific plans. ORDINANCE NO. 85-16 AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTION 22.30 OF THE ZONING ORDINANCE TO ALLOW ADDITIONAL CONDITIONAL USES IN THE ~2 (GENERAL INDUSTRIAL) ZONING DISTRICTS THAT HA'.ffi ADOPTED SEPCIFIC PLANS. Noted recommendation of four (4) Multipiezometer rejected and specifications that bids for constructing and equipping Observation Wells Project 1985-5 be reanalyzed and readvertised. Motion was made by Councilman Gage seconded by Councilman Mus- sallem and carried that the bids received for the Multipiezomter Observation Wells Project 1985-5 be rejected as recommended. Noted recommendation that the bid of Pacific Pipeline Survey in the amount of $5,910.32 be awarded for Smoke Testing of Sanitary Sewer project 1985-6. Motion was made by Councilman Gage seconded by Councilman Mussallem and carried that the bid of Pacific Pipeline Survey in the amount of $5,910.32 be awarded for the Smoke Testing Sanitary Sewer Project 1985-G as reco~mended. Noted recommendation that bids for a.midi-pumper and accessory equipment be ~ejected and readvertised. Motion was made by Councilman Gage seconded by Councilman Mussallem and carried that the bids received for the midi-pumper and accessory equipment be rejected as recommended. Noted recorr~endation that the bid of Terra-Sol, Ltd., in the amount of $6,222.00 for :CE~ contract bid for G'?P. 85-11 (Glen-Lorna Corp./Norton Farms) be awarded. Motion Has mo.de by Council.man Pate s,,=conded by Councilman Mussallem and carried that the bid of Terra-Sol, Ltd., in the amount of $6,222.00 be awarded for the IR contract bid for GPA 85-4 as recommended. 5182 Pub.Hear. re: Appeal of Kaiser for CUP The Mayor stated that it was the time and place scheduled for a Public Hearing on Appeal of Kaiser Foundation Health Plan regarding the Planning Commission's denial of their Conditional Use Permit application to allow medical offices in an M2 (General Industrial) District on property located at 7530 Arroyo Circle, south of Leavesley Road. The Staff Report, Initial Study, Traffic Analysis was noted and further explained by Associate Planner Myer. The Traffic Analysis was further explained by City Engineer Allen. - City Administrator Baksa noted that Councilmembers who are members of a Kaiser Health Plan could take part in the discussion and Council action - that this would not constitute a conflict of interest. -- Noted letter from M. McAfee in favor of granting the Con- ditional Use Permit to Kaiser for locating a medical clinic in Gilroy. The Mayor asked if there was anyone present in the audience wishing to speak in favor of the proposal. Mr. Bob Eiseman, representing Kaiser Permanente, addressed the Council urging the Council to grant a Conditional Use Permit to allow the Kaiser Clinic in Gilroy. Ms. Janet Espinosa, local resident, addressed the Council and presented and read a letter from nineteen (19) local residents requesting reconsideration to approve the proposed medical clinic previously denied by the Planning Commission. Ms. Janet Patterson addressed the Council in favor of Kaiser locating in Gilroy. Ms. Kathy Sakai, local resident, addressed the Council sup- porting the Kaiser Clinic in Gilroy and noting few complaints re- ceived regarding traffic from the present medical facilities located on Wren Avenue and at Sixth and princevalle Streets. ...... - Mrs. Agnus Ternasky, former Kaiser nurse and presently a Public Health Nurse representing local senior patients, addressed the Council noting that the present travel involved to Kaiser facilities is overwhelming for senior patients and urges Council to approve the proposed local facility. Mr. George Grant, local resident and thirty-year member of Kaiser, addressed the Council urging approval of Kaiser locating in Gilroy. The Mayor asked if there was anyone present in the audience wishing to speak against the proposal. There was no comment from anyone in the audience. The Mayor asked for a show of hands of those present in the audience in favor of Kaiser facility locating in Gilroy. The majority of the audience indicated in favor of Kaiser locating in Gilroy. Motion was made by Councilman Gage seconded by Councilman Kloecker and carried that the Public Hearing be closed. ..... Discussion was had on the matter by Council. Councilman Pate indicated that he is opposed to mitigation Measure No.1; however, would not vote against the project. 'li,,~ Motion was made by Councilman Mussallem seconded by Council- man Gage and carried that the Conditional Use Permit application of Kaiser be approved to allow medical offices in an M2 (General Industrial) District on property located at 7530 Arroyo Circle to include the three (3) mitigation measures recommended by Staff. Res. #85-67 - - Intro. Bldg. Sec. Ord. Res. #85-68 Housing Assistance Plan - - Plan. Com. Apptmts. - 5183 Councilwoman Albert noted that she is opposed to any further commercial type of development not specifically designated at this location. The Mayor noted her concurrence. Motion was made by Councilman Mussallem seconded by Councilman Valdez that the reading of Resolution 85-67 be waived and that it be adopted disapproving the Palnning Commission's action regarding the Kaiser Conditional Use Permit application. Motion was made by Councilman Gage seconded by Councilman Pate and carried that Royston, Hanamot, Alley & Abey be approved as landscape architects for the Las Animas Park Addition as re~om- mended. Tenth Street Traffic Analysis City Administrator Baksa presented a Traffic Analysis for Tenth Street, further explained by City Engineer Allen. IIIiIIIIII Motion was made by Councilman Gage seconded by Councilman Kloecker and carried that the Staff recommendations 1 through 5 be accepted, noting desire to complete signalization at the Tenth and Church Street intersection as soon as the funds become avail- able; sooner than two years, if possible. Annual Audit Motion was made by Councilman Gage seconded by Councilman Kloecker and carried that the Arthur Young & Company fiscal year audit ended June 30, 1985, be approved and accepted as submitted. City Administrator Baksa inquired of Councilmembers request- ing filing cabinets. Tenth Street Bridge - Council Chambers .... Man-of-the- Year Adjournment - .... 5185 City Administrator Baksa obtained a menu order from Council for the break between the 5:00 p.m. Study Session October 1, 1985, and the 7:30 p.m. Joint Special Council Meeting with Morgan Hill City Council. City Administrator Baksa presented a cost analysis for the pro- posed Tenth Street Bridge noting that the Corps of Army Engineers would finance $500,000.00 for the 28' bridge; 36 ft. City cost - $140,000; 64' City cost - $510,000, and enlargement at a later date, 10-20% increase in costs. City Administrator Baksa noted that the Municipal Court desires to use the Council Chambers on Tuesdays in addition to Fridays and that this may present a problem for the City needing the facility on Tuesdays. It was suggested that the City charge for use of this facility and use by outside agencies only if not in conflict with city use. City Administrator Baksa noted that the Sewer Allocation Summary of the Council Study Sessions did not show the'29,500 gallons of sewer capacity remaining. City Administrator Baksa noted an update on revised Sewer Treatment Plant EIR schedule noting the Joint Public Hearing is scheduled for December 18, 1985. Council requested that same.be referred to the Joint Powers Sewer Advisory Committee for recommendation. City Administrator Baksa noted the County Librarian is open for suggestions from Council regarding their three element formula (assessed valuations/population/circulation) and requests.Council to submit any suggestions to him so that he can direct a letter to the County. He noted that he would furnish Council with a copy of the County's letter. City Administrator Baksa distributed information regarding emer- gency preparedness workshop at a recent Department Head Meeting. Councilman Kloecker noted that a Cal-Trans locomotive has been named after Gilroy. The Mayor noted the League of California Cities' Annual Conference, San Francisco - October 6-9, 1985. Noted the Gilroy City Council Study Session October 1, 1985 at 5:00 p.m. re: sewer allocation process. Noted the Joint Gilroy/Morgan Hill City Council Special Meeting, October 1, 1985 - 7:30 p.m., Gilroy Council Chambers re: Financing Alternatives for Long-term Sewer Treatment Plant Construction Project. The Mayor congratulated Councilman Gage for recently receiving the "Man-of-the-Year" Award sponsored by the Gilroy Chamber of Commerce. At 10:00 p.m., the Mayor adjourned to a continued Closed Session re: Personnel Matters.
