Hampshire Construction .,; /&'0 '" CONTRACTUAL AGREEMENT FORM FOR EXPANSION AND INTERIOR RENOVATIONS FOR CITY OF GILROY CITY HALL (ARCHITECT'S JOB #89-11) THIS AGREEMENT, made and entered into this 15th day of May , 19 -2.Q, by and between Hampshire Construction , herein called "Contractor" and the CITY OF GILROY, herein called "City"; WITNESSETH: WHEREAS, the City Council of said City has awarded a contract to Contractor for performing the work hereinafter mentioned in accordance with the sealed proposal of said Contractor. NOW, THEREFORE, IT IS AGREED AS FOLLOWS: 1. Scope of Work: The Contractor shall perform all the work and furnish all the labor, materials, equipment and all utility and transportation services required to complete all of the work of construction and installation of the improvements more particularly described in a motion adopted by the City Council of City on the items and quantities of which are more particularly set forth in the contractor's bid on file in the office of the City Clerk, except work done or to be done by others. In general, the work to be done consists of all necessary labor, materials and equipment sections as noted below: Base Bid Alternate tll Alternate #3 Alternate tiS Net Bid $572,600. 150,600. 238,000. 21,000. $982,200. Time of Performance: The Contractor shall begin installation at the site within 10 calendar days after written notice to proceed with the work. Contractor to proceed with the work and shall diligently EXPANSION AND INTERIOR RENOVATIONS FOR CITY OF GILROY CITY HALL prosecute the same completion before the expiration of 180 working days. The Contractor will pay to the City the sum of Four Hundred Dollars ($400.00) per day for each and every working day that work called for under the contract is not substantially completed or finished. For each working day the Contractor finishes the work ahead of the time of completion, the City will pay the Contractor the sum of Four Hundred Dollars ($400.00). 3. Component Parts: This contract shall consist of the following documents, each of which is on file in the office of the City Clerk and all of which are incorporated herein and made a part thereof by reference thereto: a) This Agreement b) Notice Inviting Sealed Bids or Proposals c) Proposal Submittals d) Technical Specifications e) Plans and Drawings f) General Provisions g) Special Provisions h) Contract Faithful Performance Bonds i) Certificates of Insurance 4. Wage Scale: Reference'is hereby made to the rate of prevailing wage scale established by the State of California, a copy of which is on file in the office of the City Clerk of the City of Gilroy, the provisions of which are hereby specified as the rate of prevailing wage to be paid workmen on this project, and the provisions of Article 2, Chapter 1, Part 7, Division 2 (commencing with Section 1770) of the Labor Code shall be complied with. Hours of Labor: The Contractor shall forfeit, as penalty to City, Twenty-five Dollars ($25.00) for each workman employed in the execution of the contract by him or by any subcontractor, for each calendar day during which any workman is required or permitted to labor more than eight (8) hours in anyone calendar day and forty (40) hours in anyone calendar week, in violation of the provisions of Article 3, Chapter 1, Part 7, Division 2 (commencing with Section 1810) of the Labor Code of the State of California. 6. Apprentices: In accordance with the provisions of Section 1777.5 of the Labor Code, and in accordance with the regulation of the California.Apprenticeship Council, properly indentured, apprentices may be employed in the prosecution of the work. Information relative to number of apprentices, identifications, wages, hours of employment and standards of working conditions shall be obtained from the Director of the Department of Industrial Relations, who is the Administrative Officer of the California Apprenticeship Counc il . 7. Labor Discrimination: Attention is directed to Section 1735 of the Labor Code, which reads as follows: "No discrimination shall be made in the employment of persons u~on public works because of the race, color or religion of such persons and every contractor for public works violating this section is subject to all the penalties imposed for violation of this chapter."
