Steinmetz,Ci~ Clerk City of Gilroy 7351 Rosanna Street Gilroy, CA 95020 v NO FEE PER GC SEC 27383 11329173 A G R E E MEN T This Agreement is made and entered into this 13th day of April 19~, by and between the CITY OF GILROY, a municipal corporation, in the County of Santa Clara, State of California (herein designated as CITY), and Donald G. and Elizabeth Trinchero (herein designated as OWNER. A. The CITY agrees that OWNER will receive: 300 gallons per day sewer treatment plant capacity allocation in consideration for the payment of $ paid gallons per day peak water use allocation in consideration for the payment of $ paid 6,000 for APN 841-15-111 (herein designated as "Lot", see attached map marked Exhibit A.) B. For the above sewer capacity and peak water use allocations, OWNER agrees to the following: 1. That it will be the OWNER'S responsibility to see that any and all present and future occupants, users, and owners of said building(s) agree not to use more than the above allotted allocations. Penalty: OVERUSE OF THE SEWER TREATMENT PLANT CAPACITY ALLOCATION AND/OR THE PEAK WATER USE ALLOCATION SHALL BE PENALIZED UNDER THE RULES AND REGULATIONS ADOPTED BY THE GILROY CITY COUNCIL. 2. That OWNER will make any and all end users who will occupy the building(s) on said Lot aware of the terms and conditions of this Agreement. 3. That the terms and conditions of this agreement are valid until said Agreement is terminated by the mutual consent of both parties, or until OWNER fails to abide by any part of this agreement. Once this Agreement is terminated for either of the above-stated reasons, the sewer capacity allocation and/or the peak water use allocation made in "A" above will be null and void. 4. That OWNER shall investigate and consult with CITY as to the possible use of internal reclamation systems and water-saving devices. 5. That OWNER shall have the option of measuring sewer effluent by: a. Installing and maintaining a sewer effluent meter. Said meter shall meet City standards and specifications for both installation and maintenance. Should the sewer meter fail to function, the sewer billing will be based on the water consumption as shown on the water meter. b. Measuring the building's water consumption. (NOTE: Irrigation meters are available.) 6. This agreement supersedes all previous water and sewer allocations relating to this parcel. 7.
