"# ~iEREAS, the Council of the City of Gilroy did on June 21~ 1976, adopt Resolution No. 76-27 declaring its intention to proceed under the Public Service Easements Vacation Law; Goverrunent Code Section 50430, et. ~. to vacate the emergency access easement, but not the public utilities easement~ in the City of Gilroy between and near the western termini of El Dorado Drive and Calabrese Way as shown upon the map attached hereto, and WHEREAS, notices of the adoption of such resolution were published and posted as required by law, and WHEREAS, no objection to the proposed vacation of the emergency access easement was filed at or before the hearing by the Council on July 19, 1976, at 8:00 p.m. in the Council Chambers in the City Hall at 7390 Rosanna Street, Gilroy, California, the time and place fixed for the hearing in said notices, and the hearing having been duly held, and the Council having duly considered the evidence pre- sented as to the vacation of the emergency access easement described herein; The Council does hereby find that the described emergency access easement is unnecessary for present or prospective public use. The Council further finds that public convenience and necessity require the reservation of rights of way for all public utilities across, above and under the described easement. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Gilroy that the described emergency access easement be vacated, but -1- RESOLUTION NO. 76-35 NO FEE " C 213 PAGf294 that permanent easements for all public utilities across, above and under the described easement be reserved to the City.
